You will need a lawyer to help you apply for a letter of administration from the court to take to the bank, the funds will now be moved into an estate account which can now be accessed by a would be signatory but its a process that can take a while, you will also pay 10 percent of the total amount in the accounts to the state treasury before the letter of administration is released to you
U don't need a lawyer. Go to probate, they will tell u what to do. It involves different stages. It is d next of kin that matters here..

You will fisrt write to inform the bank that the guy is dead.
You will submit death certificate both original and photocopy original for sighting.
Then you will get letter of administrator from notary public.
The bank will have to work on these by doing their own investigation.
After they are satisfied you can now be called either to open an account with the bank and the balance on the deseased account will be credited to you.
All these can only be possible if the dead person chose you as next of kin when opening the account initially

First you need to get a Letter of Administration
Then you need to submit it at the bank
After verification, the bank will do the needful

The bank won't even answer you if they check and you are not the next of kin. Go with the wife for the inquiry they will tell her but will never tell u.

When my elder brother died, we couldn't get the atm pin after serious search. I have to come up with the idea of downloading the bank mobile on his phone, I logged into the app and registered with the atm card. I clicked for transfer and an one time password (otp) was sent to his mobile number. I continously used the otp as they were been sent to transfer 680k out of the account. The remaining 200 naira I used it to recharge my line. I was lucky the app registration didn't require physical visit to the bank. I purposely didn't want to mention the bank involved

That might be her undoing. By the time the banks finish with her only a fraction will be left. Try and search maybe he left it in a diary or something.

go to probate sef not u o, as far as he was married they wont answer you. Let the wife do it. And what do you stand to gain from his property? From her reply she doesnt want you involved.

You'll first of all get a death certificate from any recognized hospital & proceed to any media house to publish it in a local tabloid for 21days. Thereafter you'll proceed to the probate registry to get an LOA. Take the LOA to the bank where the account is domiciled to give you statement of account. Take the statement of account back to the probate registry. They'll deduct about 10 percent of the money after which the bank can open an estate account for you.
Note that you mustn't be the next of kin to do this.

What if the next of kin shows up tomorrow... Like the man son and some useless friends has brought your almighty letter of administration, walahi your bank will pay twice, one to the orinigal next of kin and the other to the scammer letter of administrators.

Please guy, before I start chasing shadows trying to recover the money in my late brother's bank account, I would like to know the steps to take. Until his death, he lived in the northern part of Nigeria where the bank is also located.

1. Do I have to travel to his bank location to make necessary procedures or I can do that elsewhere where the bank has a branch?

Truth is, it's not a one size fits all. Some bank have stricter policies than others.

Getting the letter of admin is the first step and may take a while to get, depending on the assests

My personal experience

My dad had accounts act 6 banks. Diamond, access (b4 the merger) union, UBA, First bank, unity

With the LOA, Some were relatively straightfoward eg diamond, access,

It was the first generation banks that gave the most stress, esp union bank and first bank. It was only UBA that went smoothly.

You must not open an estate account the bank can issue a draft in the name of the next of kin as stated in the documents after u obtain court affidavit and letter of administration from probate which the bank will send to the court depending on the instructions on the letter of administration

Well his actually right.

It's the probate court that would decide who will execute the estate and as such grant the LOA to, who may, in some instances, not be the NOK.

If indeed the bank assess the LOA to be genuine but the executors are not explicitly stated as the NOK to the deceased, then it may take time and involve back and forth, but they will pay.

There is no need for a lawyer if the following conditions are met.
1. Get the death certificate
2. The next of kin to the account or first child of the decease.

The next of kin or first child of the decease will now take the death certificate to the court, in other to apply for Letter of Administration. It will cost about 50k plus.
Having secured the Letter of Administration, you will now take it the bank involved. From that point on ,you will have unhindered access to the account.

Go to high court! Probate. The state will take 10% of the money, this process will take up to 2 months! But if you meet a lawyer, he will ask for 40 or 50% of the money, this will take up to one more or less
