Good day all,

It's pretty simple, can I be forced to sell my inheritance?

My late pop passed away 4 years ago, he had 11 surviving children from 4 wives, me and my younger brother were the last kids from the last wife...

He left a house in Lagos which we presently reside in but in recent times it's been the topic of sale by other siblings.... our stance remain 'NO SELLING'

Additional info

1-Me and my bro are in our early and mid 20's,we live in one of the apartments

2-The remaining siblings all have families of their own outside Lagos

3- Money is obviously the Motive for selling, but its emotional and psychological for us, dunno if this count, but id also add that my younger brother is a 'son of the soil"here, schooled here and erythane before pop passed, 3 of the siblings have never been here before. Older folks call popman "Baba Shade" we only met at the burial...

We had a Family meeting/reunion mid last year and the house was thrown in a debate, while majority of my siblings choose to sell the house, me, my brother and our eldest brother(2nd born) were against selling...

However, my elder bros and i spoke on new year day and i got to know his stance had changed concerning no selling, he cited heavy pressure from other siblings and he is very tired. And maybe he needs money too...

Which prompted my creation of the thread and asking "can our house be sold without our consent" considering we are in the minority for team "no selling"

Can we be forced to sell? despite having no intentions to do so, and how does the legal system cover for us...

N/B- there is no discord or fight or anything among siblings, we all live in peace and contact mostly through phone calls sometimes.....

It may be with your consent though, because the majority voted for selling of the house. Since they didn't say they are not going to give you guys what belong to you.

Did your late father have a will?

If yes, who was given the house according to the will?

If no, then the house is subject to customary laws, in which situation, according to your custom, who has rights to the house?

Do you and your brother have somewhere else to stay in the event your current house is sold?

Most likely, the majority votes will win in this situation, unless you have legal rights to the house.

no will, and I believe my imediate elder bro have in possesion any relevant paperworks for the house...


And it' not a now thingy, even if it will be sold eventually, not in the next 5 years at least... I just want to know if majority win works in this kinda situation or dosent...

I mean it's an inheritance right, we all have equal rights and all, 8 want to sell, 3 don't want to sell, majority rules say 8 win, but everything I have been reading online says no sale without my "consent"... So I'm thinking like since my "consent" is NO, they can't sell...

Maybe I should add, nobody will cheat anybody in the aftermath of a sale, everyone would get theirs...

My issue is isn't there some clause in the law that covers for a scenario where the property in contention is my home, grew up in it, knew everyone, live and still living with evidence, also I know for a fact that pop will never sell, out of the blue about to be up for sale by people who needed an address and later description when they were coming cuz they needed money....


They just trying to use my house for cash out, why should they? The day they came, they all left except 1, not my fault they like visitors, cuz they never come..

When it comes to issues like this, my only advice to u is just let them go ahead with their decisions over that property, like I always say "mi o le mi wahala" , you still have a long way to go than getting yourself into a mess with ur siblings, and to think u are from a polygamous home, it's better u let them sell, get your share and move on with your life or you ignore the share and plan your own life. I found myself in situation like this(not from a polygamous home) and what I told my other siblings is even when father lives this earth,I'm not interested in his property, they can do anything with it, na me know wetin I dey talk property brouhaha in Nigeria my brother e get as e be o. There is nothing that you can do about it because since other shylocks have agreed to sell the land then it's a done deal.


Tread with caution and start planning on what you will use your own share of the sale to do.

Democracy carries the day.

If those wanting to sell are far more in numbers than those not wanting to sell, then the house should be sold.

The only part I am concerned about is that you and your brother are emotional about selling the house.

You will need to let that emotion go. Let the will of the majority carry the day.

You and your brother can pull resources together and build your own house

They can buy you out (if happy to do so).... Get an independent valuation, then you can work out a deal......


Of what use is an inheritance, if the siblings under financial pressure, contract a hired assassin..............

Be very diplomatic

If the property is very valuable they will do anything to get it sold.. Just try and keep the docs safe.

The Yoruba's need to be careful the rate they sell their properties major buyers being Igbo's.

If the trend continues Igbo's will own Lagos one day.

They will end up selling the house with or without your consent, you just have to pick a side. If you were rich, I'd have have advised you buy it but you're not.
My uncle had 3wives and after his death, the 9children and three wives couldn't agree on anything so all his properties except the storey building they currently reside were sold and money shared amongst all of them.

I have learnt that money can make the most decent of people do some crazy stuff. Honestly the pressure will just continue to increase as time goes on. Take that guy's advice. Build your own

Firstly it's not your home more than it's theirs .. there is no will indicating you as primary custodian of the estate (the house)

So whether you where born and raised there is totally irrelevant.

Yes the house can be sold without your consent and all children are deemed beneficiaries of the estate since you are not stated in any document as executor of the estate hence you have no power above the other children.

The house will be sold.whether you approve or not and it doesn't belong to you it belongs to all biological children of your late father . Whether you live there and get married there is irrelevant the home is not yours !!!

Move out , it is not your inheritance it is all biological children's inheritance

They Are Telling You Now , U Won't Hear

If They Wanna Sell It , Let Then Sell The House , Have Your Share And Move On With Your Life ..... Is It Your Property Isn't it your father house?? You haven't built your own house and u are doing agidi untop general owned house.... Let them sell it ,have your share and plan your life.........

But am surprised why you still stay in your father's house though

My brother, u and your brother, unfortunately, belong to the minority group.
Only two of you do not want the property to be sold and not just that u both
are children of the last wife.

The majority have spoken and it's possible the property is sold against your will.
It's your word against theirs and moreover they will look at you as a mere boy[i](pardon me)[/i]

I will advise you to join the bandwagon unless you are sure you have it takes to prevent them from selling the house.
And since wickedness is more available than good these days, someone might knock you and ur brother off and that property
will be sold.

These guys are mostly ur seniors from another mother, this makes it easy to for them do anything possible to sell.
Especially if your reasons don't make meaning to them.

My advice for u, in order to live longer, please join them so that u don't lose everything.

What does ur custom say about inheritance? It is your custom that determines what happens. In some customs, it is d eldest son that inherits the Father's property (if it is one). Are there no elders in your family that you can relate to for advice?

Its not ur home... It was ur father's home and considering that he sowed his wild oats to different women with 11 different fruits I would say sell.. Don't let this be the bane that drives ur family apart.. Only thing u could av don perhaps is to buy them out...
