If the house is the ONLY house built by ur Father, and the other siblings want to sell it.

Dude I did not get the bolded information from Starboytwo/OP's original post. Where did you get this info from?

If each wife has a house, why would they want to sell just the house of one wife? And one of the last wife's son will also gradually agree? I doubt it.

It's pretty simple, can I be forced to sell my inheritance?

My late pop passed away 4 years ago, he had 11 surviving children from 4 wives, me and my younger brother were the last kids from the last wife...

He left a house in Lagos which we presently reside in but in recent times it's been the topic of sale by other siblings.... our stance remain 'NO SELLING'

Additional info

1-Me and my bro are in our early and mid 20's,we live in one of the apartments

2-The remaining siblings all have families of their own outside Lagos

3- Money is obviously the Motive for selling, but its emotional and psychological for us, dunno if this count, but id also add that my younger brother is a 'son of the soil"here, schooled here and erythane before pop passed, 3 of the siblings have never been here before. Older folks call popman "Baba Shade" we only met at the burial...

We had a Family meeting/reunion mid last year and the house was thrown in a debate, while majority of my siblings choose to sell the house, me, my brother and our eldest brother(2nd born) were against selling...

However, my elder bros and i spoke on new year day and i got to know his stance had changed concerning no selling, he cited heavy pressure from other siblings and he is very tired. And maybe he needs money too...

Which prompted my creation of the thread and asking "can our house be sold without our consent" considering we are in the minority for team "no selling"

Can we be forced to sell? despite having no intentions to do so, and how does the legal system cover for us...

N/B- there is no discord or fight or anything among siblings, we all live in peace and contact mostly through phone calls sometimes.....
If that's the only house ur father built and didn't build for others then u have to sell it

Your statement about decent siblings got me cracking. Nigerians have a default reaction to inherited properties. Ownership and control. Only the weaklings and the down trodden look away because they can't fight.
I have yet to see smart parents who put their house in order before death. (I mean those whose properties are up for inheritance presently.

@OP, I know how painful this might be, having the only property left behind by your father sold.
Seeing the building, which was once yours, becoming another's would probably cause one some heartache, but don't worry, God knows you have done all you could to avoid selling it.

Meanwhile, the property belongs to all & not yours only. So I will advise you let go of the house & focus on becoming a person who matters in the future. Then, you will have enough ego to talk sense into their skull.

That is if you aren't insisting due to the fact that you too are one lazy guy.

In polygamous settings, every outsider and passerby inputs in family issues.

In monogamous settings, the family has more control over who does. At least, there is less random publicity.

If u sell it once money enters there hand, ur family share will be the smallest, apart from that you guys are plenty, u would be surprised when they give u just 1m as ur family share. What can that 1m do for u as accommodation in Lagos.

Even if the sharing option was to come up, they can rent out the other flats while the entire extended family share d rent but selling out ur family house is a Big NO.
I mean, I don't know, people already calling me selfish etc, thats my father's house, when everyone came to Lagos, they had nowhere to .go for meetings or reunion except the place...

Beside how much are they trying to sell for, how much go reach me and my bro...

I'm for renovating or renting or whatever, but outright sale is not good... It's also situated on the best part of that area, azin the house na number 1 for the street...

Azin I tire, sell house for lag, not inside one bush ooo, for a developing community in lag...

Any amount they sell for will be pittance compare to how much it will worth in 5 10 years from now. ..

They will end up selling the house with or without your consent, you just have to pick a side. If you were rich, I'd have have advised you buy it but you're not.
My uncle had 3wives and after his death, the 9children and three wives couldn't agree on anything so all his properties except the storey building they currently reside were sold and money shared amongst all of them.

Firstly it's not your home more than it's theirs .. there is no will indicating you as primary custodian of the estate (the house)

So whether you where born and raised there is totally irrelevant.

Yes the house can be sold without your consent and all children are deemed beneficiaries of the estate since you are not stated in any document as executor of the estate hence you have no power above the other children.

The house will be sold.whether you approve or not and it doesn't belong to you it belongs to all biological children of your late father . Whether you live there and get married there is irrelevant the home is not yours !!!

Move out , it is not your inheritance it is all biological children's inheritance

the main force for pro selling is the eldest female, she is way older and I know for a fact her husbands got a house in ibadan, she would never consent to selling her husband house cuz of hard times, to cater for her children... She has been here once, just once after the funeral and was never there when pop man got sick...

The only people around when pop got incapacitated was my little brother and me, and my eldest bro and one other bro... No one else...

When she was gonna come, i had to go pick her from the bustop, she didn't know I was her brother, she didnt know the said house until I drove her in... But she wants it's sold...

1)Can your own share (or maybe with your brother's share) reach like 3-4mill at least?
So that you get yourself maybe a plot or half and site something to substain you and run from polygamous brouhaha before it starts turning messy!!
2) If they're such decent or learned folks, then you should implore them to come together so 11 of you enter a legal partnership agreement as a consortium or cooperative and then lease the land and/or property. Depending on the location, banks, hotel, school, plaza might be situated on it. Outright sale is loss. Lawyer, bank manager can advise you better on this.
I'm all for anything but outright sale... Thanks for this, I will talk to those I relate with...

And it' not a now thingy, even if it will be sold eventually, not in the next 5 years at least... I just want to know if majority win works in this kinda situation or dosent...

I mean it's an inheritance right, we all have equal rights and all, 8 want to sell, 3 don't want to sell, majority rules say 8 win, but everything I have been reading online says no sale without my "consent"... So I'm thinking like since my "consent" is NO, they can't sell...

Maybe I should add, nobody will cheat anybody in the aftermath of a sale, everyone would get theirs...

My issue is isn't there some clause in the law that covers for a scenario where the property in contention is my home, grew up in it, knew everyone, live and still living with evidence, also I know for a fact that pop will never sell, out of the blue about to be up for sale by people who needed an address and later description when they were coming cuz they needed money....


They just trying to use my house for cash out, why should they? The day they came, they all left except 1, not my fault they like visitors, cuz they never come..
If they sale the house without your permission and you take them to court, you will win but the highest is for them to compensate you.

to be honest I don't deal with the rent and shit, after my dad passed, our apartment was vacant for a year or two before me and my brother decided to come stay last 2 years October 24 2018 to be precise...

I don't like wahala as we have our own thing going for us, we don't know who collect rent or anything, if you asked they'd say an agent blah blah, agent says my dad younger bro, dad younger bro said it's one uncle blah blah, so I left that side since the money they talking about gan self for all of us no reach me and my bro...

So as not to upset any balance of power we left things as he be and not ask questions...

I can tell you for a fact, if you come here and see us, we don't look like landlord or spread influence around, only older people knew who we were, we are just two young fresh boys hustling..

The only benefit I've got here is rent free for a year or so, I swear to God almighty ...

Also this is not some funny scenario, it's just that I think we should not think of selling the house cuz we scrap for cash, I need cash too, don't I? You too... It's in everyones best interest in the long term if it's not sold but leased or whatever, outright sale cuz you temporary need money is stupid... Even p man go vex...

And if you think I have some privileges by not paying rent for 1 year, well there's nothing I can do about that, I'm my father's son after all, I'm not some snow or a bastard, I'm my father's SON... And nobody is stopping any other sons or daughters from having any privileges..

Besides they are only selling cuz of the money, which is good for them, but very bad for us... It's only normal I fight for myself and my brother, selling is bad for us, bad for our family name, bad for my rep, and bad for my father's legacy...

I'm not being selfish or anything, if anything they are the selfish one...

Thank God you eventually find your missing sense. Next time read carefully before commenting on an issue of this magnitude. All your previous comments were totally off point and baseless.No where did the OP mentioned that his dad built four different houses for the four different wives. OP's dad has only a house in Lagos and all the eleven biological children have a stake in that house, whether the other children has an emotional attachment to the house or not, is irrelevant. The best decision is to sell that house and share the proceed to them all with the eldest son having the lion share. OP do not have that house more than others. Even if OP and his mother were the one living in that house with their dad before his demise, it still do not confer on them any right or privilege .

Sincerely they cannot sell it without your consent and if you glance fraud on this issue then you should issue a Calver emptor on news paper declaring you are not selling and paste if on the house and more so my piece of advise.you are still young and you are a lot of things to do in life but if you think the share of the money can get you to buy a house in Lagos of your own please kindly take the money and let them do it cos there are lot of things attached to it.those family member will see you as threat and they would want to use other means spiritual to battle you and if you get your self killed in the means of it then they would sell without you getting any kobo so please use your head and run your calculations right .
