yeah you are right, selling is not entirely a bad thing, we don't collect rent, people working beside and outside our house were surprised we were the landlord, me and my bro be Og's mehn, we live our life and bother nobody, only privilege is rent free and you'd think we are just another student...


It's one of the siblings dropped account number for tenants, that's how rent is collected, I never collect rent etc.. .

My late pop passed away 4 years ago, he had 11 surviving children from 4 wives, me and my younger brother were the last kids from the last wife...

He left a house in Lagos which we presently reside in but in recent times it's been the topic of sale by other siblings.... our stance remain 'NO SELLING'

Additional info

1-Me and my bro are in our early and mid 20's,we live in one of the apartments

2-The remaining siblings all have families of their own outside Lagos

3- Money is obviously the Motive for selling, but its emotional and psychological for us, dunno if this count, but id also add that my younger brother is a 'son of the soil"here, schooled here and erythane before pop passed, 3 of the siblings have never been here before. Older folks call popman "Baba Shade" we only met at the burial...

We had a Family meeting/reunion mid last year and the house was thrown in a debate, while majority of my siblings choose to sell the house, me, my brother and our eldest brother(2nd born) were against selling...

However, my elder bros and i spoke on new year day and i got to know his stance had changed concerning no selling, he cited heavy pressure from other siblings and he is very tired. And maybe he needs money too...

Which prompted my creation of the thread and asking "can our house be sold without our consent" considering we are in the minority for team "no selling"

Can we be forced to sell? despite having no intentions to do so, and how does the legal system cover for us...

N/B- there is no discord or fight or anything among siblings, we all live in peace and contact mostly through phone calls sometimes.....

Let me drop my little epistle.

Look at it Logically and not emotional.

- Everyone is entitled to the house.
- if your dad had 10 car stashed away in a different state aside were u reside.. u haven't seen the cars, you have even used any of them.. and u are cash strapped, won't you consider selling some or all of the cars to raise money (now you may not have considered who might have been emotional attached to the car.
- you obviously are at disadvantage being amongst the least siblings. Next of kin will be far from you so you decisions may be rarely consider in grave circumstances.
- money is the root of evil... No you still feel there is no contention... When they are truly pressed for money and the see you as an obstacle... The game will change..
* my 2 cent if they want to sell the house, it purely because they do not have any emotional attachment to it like you do.

Sell it take you share and help yourself

You better listen to majority advise given to you up there already and allow your siblings do whatever they like with the property.

The issue of property or land dispute in Nigeria is always a delicate one and oftentimes leaves a trail of blood, tears and sorrow.

Now that your siblings are asking nicely, you better cooperate and allow them sell the house. Work hard, build your own house and avoid the mistake your father made by not leaving a Will.

Just thread cautiously to avoid story that touches the heart.

And believe me that in some culture, as the children of the last wife, you have little or no say regarding your father's inheritance.

I've experienced what you're going through. It really helps that you guys are civil. FOR NOW! But in the absence of a will, the default in any probate court is a "democracy". One beneficiary, one vote. Thus sell carries the day. Trust me I understand the sentiment to childhood homes, but justice especially fair justice and equity has to be dispassionate.
I get it now, and we are super civil, no discord anything... We live far apart and mostly don't know one another but we all good...

This is not yet your inheritance till the properties are shared . I think the headline should change . Your dad's tradition and the legal system will help to solve this. By the way , what's ERYTHANE ??

For me.I would believe that this is a Muslim family. According to Islamic law, once a decease dies, properties he/she leaves behind should be shared to the legitimate inheritors. You and your siblings all have same claim to the property. Saying they don't know the place or other emotional issues doesn't come to life. You are all entitled to the property and its should be shared SIMPLE. Even it means selling the property. I'm quite happy that all of you are very civil in this case. No threats, harassment or intimidation.

The others feel they're not benefitting anything from father's inheritance.
You and your brother continue to live rent free, and would probably marry and raise family there if not careful. Does that mean the others won't benefit from their inheritance?
they don't feel anything, we have always lived rent free before pops died, I have yet to see anyone pay rents in his father's house...

And it' not a now thingy, even if it will be sold eventually, not in the next 5 years at least... I just want to know if majority win works in this kinda situation or dosent...

I mean it's an inheritance right, we all have equal rights and all, 8 want to sell, 3 don't want to sell, majority rules say 8 win, but everything I have been reading online says no sale without my "consent"... So I'm thinking like since my "consent" is NO, they can't sell...

Maybe I should add, nobody will cheat anybody in the aftermath of a sale, everyone would get theirs...

My issue is isn't there some clause in the law that covers for a scenario where the property in contention is my home, grew up in it, knew everyone, live and still living with evidence, also I know for a fact that pop will never sell, out of the blue about to be up for sale by people who needed an address and later description when they were coming cuz they needed money....


They just trying to use my house for cash out, why should they? The day they came, they all left except 1, not my fault they like visitors, cuz they never come..

You are reasoning with your emotions not logic and therefore being selfish.
All your siblings and your late father's wives are entitled to their their legitimate share of their inheritance.
You are apparently living and benefitting rent free from the house and therefore reluctant to let go - alongside your emotional attachment to it.
You have 3 basic options:
If the property is large enough, then it can be physically divided so that every heir may inherit and do as he/she pleases with his/her share.
If you have enough money, then you can offer to buy the rest out - subject to their consent.
Otherwise, the majority interest should prevail over your minority rights; most courts would uphold their right to sell the property and give you your legitimate share of the proceeds.

Parents should sell their properties when getting old, put the money in trust for each of their kids. This helps to eliminate bad blood between siblings fighting over properties.

I understand. They could share it such that your present apartment goes to you and you can chose not to sell while someone else buys the rest. I once lived in a house owned by three landlords. One lives there, the second rented his out while the third sold his. Issue resolved.

That word "My" in your comment is even my concern. Even a woman married to a man with 2 wives cannot not call the man "my husband" without issues, the right thing to say is "our husband ".
But thank God in your comment you noted and agreed that the inheritance is not yours alone, you even agreed that if the property is to be sold it should not be now (maybe in the next 5yrs) which I believe is a period you selfishly believe you and your younger brother will be able to survive without the house.
Bro, you are simply being selfish. My answer to your question is yes, the inheritance can be sold without your consent, because the inheritance is not yours alone but the family. And it is not mandatory for every single member of a family to agree before a family can take a decision, unless you want to go against the family and make the simple issue messy.

Is that the only property of your dad

Was there a will indicating it belongs to you and your siblings

Where is the documents to the building, is it with your mum or another person or unknown

Your mum is the last wife, so it's possible he married her after those acquisition

You said the whole family lives peacefully, I doubt, there are underlying issues which will start prompting up, the house for sale is one of them

My advice is, find out the formula for sharing, which is supposed to be shared among the four wives, irrespective of how many kids they have for him

So sharing ought to be done in fours not number of children

What about other properties are the going to share those ones too or just the one you are occupying

Well for your own life and peace of mind

Give up, let the share it

It will make you struggle to have yours

Polygamous family is the worst place family politics are played

They target the stubborn one's to eliminate them or render them useless while those who behaves like mumu are set free because they don't interfare in their dubious act

Finally, join them because you can't fight them

Children sell houses built by their parents despite the house been occupied by the owners ,

People sell other person's properties ,


Op it's only a matter of time before that house is sold ...buyer never come ,

when the new owner makes payment don't be caught unaware with a notice of ejection ..

My friends mum twin sister sold their parents properties and vanished into thin air with her husband and kids from 2009- date .

why dont you first find out how much will be accruable to you guys over any sale, you might find it is reasonable selling the "public house" and buying yourself a land, even if it is 40ft container you put in the land and fabricate to your taste. At least, no more noise from any quarters.

What are you even saying! Are you trying to make us believe that house is yours or what! Remember you and your bros are last children from even the last wife, (bitter truth) so you don't have much say self and even when is sold your share of money will be smaller though. Remember the house is not will to you or your bros either and you said others are not residing in Lagos where the house is and you want them to allow you continue staying there, no no no.the house has to be sold because the 11people can't be maintaining a single house it will diapulate, beside it might start causing problems in future through lent collection and economy is bad.[color=#990000][/color]
