I dont know if i should comment my reserve / reserve my comment but i think the customer doesnt want the item anymore,.. His only looking for an excuse which is understandable. Collect your item and look for another buyer. I understand you are hurt because you already felt the item has been sold BUT then if the item is good and the price is right, you definitely shouldnt have a problem selling it to someone else fast. Of course he will be responsible for waybill to & fro. This is just my own comment!! Please forgive me if it doesnt go to sellers way but i have been into ecommerce business immediately konga & jumia took vendors in.... Infact customers would tell us different stories but of course its not the end of the world... Please NOTE!! This is my own comment please dont take it personal.

Good morning my humble people. Have come this morning in all humility to report a deal i concluded with "Lordraiden" and your honest opinion and judgement would be appreciated. We both concluded and agreed with the full terms and conditions of the deal which was me sending a chip unlock phone to Uyo and used "Localman a.k.a wese90" as the escrow. Only for "Lordraiden" to wake me up this morning retracting back his words and claiming he didn't know it was a chip unlock phone i was sending and that we didn't come to an agreement about a chip unlock phone. Below is our chat. Please house I need your humble opinion and judgement on this.

From those chat he knows the phone is chip unlocked and decide to go ahead with the transaction, so why is he claiming he wasn't aware.

If you are to accept the phone back, make sure it is the phone you sent to him he sent back and check carefully to know there is no default, he covers the escrow service, shipping of phone to and fro.. You will surely sell it to someone else at that good price like my boss said but if he decide not to accept that condition he has no choice than to accept the phone.

you've all said it all, the buyer is no longer interested in the phone, he would have just come out clean and open.

My observation is this,

It could that buyer didn't read/understand that he is buying a chip iPhone Or

It could be that someone made him understand that he is paying more for chip phone. Either way, the buyer doesn't want the phone anymore.

My suggestions
Let seller get the phone back but buyer should be responsible for logistics. Buyer should also ensure to return it in original state.

So why say shall we?? Which literally means can we proceed. Seller never mentioned a factory unlocked phone to you so y give the impression that you want to proceed with the deal. In all honesty, you are totally at fault so don't even think of making a case here. All u should be doing now is to beg seller for your money as it was an error due to your oversight.

He stated clearly it was a chipped phone from the screenshot uploaded. Now you are sounding suspicious as to why you want to return the item. Well like I said, Seller will never be held to ransom anywhere if he fails to accept the device sold in a good working condition to u & stated as chipped or do you think you can tell this story to Ikeja sellers??

This is why I sell my items to selected people here, the ones that can read and comprehend. I've lost some potential buyers but I have my peace of mind, which is better than after sales complaint.

Seller clearly said item is chip unlocked and you said you've had bad experience yet you asked if the deal can go through by saying shall we?. You even nominated the escrow and at the end of the deal you want to back out, feigning ignorance based on reasons best know to only you.

Buyer, in law ignorance is not an excuse. As an adult you need to be responsible for your actions. Here, you failed to comprehend the ad and key points/message posted by the seller during the conversation pre sale which led to the situation at hand.

In my opinion, if I were a Judge in this case, I'll tell escrow to release money to seller with immediate effect. As a seller, there's every possibility that I might accept the item back but would only refund you when I sell the item.Unfortunately I'm none of the above, so what would I advice you? Plead with seller and hopefully he'll listen.

PS: Buyers always read and understand an ad very well before paying, if you don't understand something, ask questions. If the seller is not replying the way you want, biko leave him/her alone and find another seller.

View is mutual .

Item stated as claimed ,(buyer agreed)
No hardware or performance faults

No case for refund (funds should be released to seller )

Negligence on buyer’s part as a result of ignorance doesn’t absolve buyer off his responsibilities .

That said , mcmayor is right , that’s actually the best line to toe for dispute resolution .

Have buyer send your item back to you in condition it was shipped to him , escrow releases funds back to buyer . The issue of logistics shouldn’t be discussed on as buyer has to bear the cost .

This needs epistle. It's as clear as day.

Seller made it known to buyer the unlock status of his item.

Buyer even agreed to an escrow.

This is a simple case of buyer trying to play on the intelligence of the seller or permit me to say buyer trying to play a fast one on the sellér.

In my opinion, buyer shouldn't be getting a full refund if one is to be made. This would serve as a deterrent to those who don't look before they leap.

Buyer should always read and comprehend. Buyer is at fault. If seller is willing to let go (willing because he is not at fault in anyway), then fine. Ensure buyer handles the logistics and check if it’s the item sent to him with no default. Escrow can then return the funds.
Else, if seller disagrees, buyer will learn from his mistakes and move on. Either way, seller should try to consider if he can. Learn from your mistakes and always read, read and ensure you understand every advert before leaping to purchase.

from my own point of view. Sell those phones before you refund him. And he shouldn't pressure you. So you are helping him sell it. It's just a suggestion. I repeat its just a suggestion

The part he said "na chip unlocked" that's where the buyer had a misunderstanding, the buyer thought it was a question because of his low price, to me its not that the buyer is trying to play smart or anything, this is just a very small misunderstanding and misinterpretation of the chats from the seller, if buyer had known very well that it was a chip unlocked, I'm not sure he'll go ahead to buy. #myopinion
