This is my calculation. Sit with your landlord and reason with him along this line. However, should he remain adamant or unyielding, I'll advice you secure another location or pay up. In the one year interim before another rent, work on securing your personal building. Let that be your goal come next year. Some fights are just not worth your passion and fights like this mostly always have boomerang effect in the long run

FuckAllTheMODs: Okay.. so in his case, the rent should expire on the 16 of April the following year. I feel the OP should have known when his next rent will be due from a signed agreementl. He would have easily referred the landlord to it and make his case. |

Alvin007: You said you're a lawyer... Now I see why Nigeria's legal system is in shambles. I live in Lagos and I pay my own rent. Tenancy in Nigeria is for 12 full months unless otherwise (in situations where the parties involved have different agreements). That is the reason why most landlords prefer January to December rate/calculation. 4 Likes |

I had tenants that refused to pay owed money despite signing with a lawyer to pay gradually and they are still wretched many years on. They keep moving all over town. These things should be clearly written in the agreement and receipt. Some count it from month to month. Others put and expiry date on it. |

How can you be this bold even with all these corrections above? Like how? Which Calendar are you talking about. Lets assume it's not for rent purposes but basic counting. 18/04/2019 to 17/04/2020 is 365(6) days 18/04/2019 to 17/03/2020 is 355(6) days 1 year is 365(6) days. Then for rent purposes depending on the initial agreement: if the agreement is to count by months that make up a year then if he entered the house on 18/04/2019 and paid rent on that same day then his rent expired on 31/03/2020 and NOT 17/03/2020. If the agreement is to count by days that make up a year then the rent will expire on 17/04/2020. There is NO BASIS for his rent to have expired on 17/03/2020. Alvin007:That is between him and the landlord if such agreement was entered into. Most tenant do not know their right ! Please, people should get proper agreement before making any payment, if your landlord is collecting the first year for 11months duration, ask for 1 month rent deduction . |

FIDELITY24: You be confirmed ogobo for counting April 18th 2019 to April 30th 2019 as 1 month,is that how u were taught in primary school.. He only used 13 days in April 2019 and will use the remaining 17 days in April 2020.. 13 days 2019 + 17 days 2020 = 30 days which comprises of 1 full April month.. |

I know you are collecting rent somewhere, how is 1st of January and 30th of January related. It should be 1st of January against 31st December. So 18th of April against 17th of April. How can you be this bold even clearly when you are making mistakes. Like how? Lets do basic counting not for rent purposes 01/01/2019 to 31/12/2019 is 365(4) days 18/04/2019 to 17/04/2020 is 365(4) days 01/01/2019 to 31/11/2019 is 355(4) days 18/04/2019 to 17/03/2020 is 355(4) days 1 year is 365(4) days. He made his input you've refused to see any logic in it, do any extra research about it, placed a call or two to any other lawyer. You just started attacking the man and the Nigerian Legal System. No one is a encyclopedia of knowledge but that you pay your rent or live in a Lagos or where ever for that matter does not give you the temerity to attack a person who is licenced to practice law anywhere in Nigeria. Besides that jargon you put in bracket above cannot be interpreted in the eyes of the law. It is nonsense. |
