You probably have being cheating your tenant, collecting 12months rent as opposed to 11monthd as describe by act you quoted.
Ok sir

This is my calculation.
Sit with your landlord and reason with him along this line.
However, should he remain adamant or unyielding, I'll advice you secure another location or pay up. In the one year interim before another rent, work on securing your personal building. Let that be your goal come next year.
Some fights are just not worth your passion and fights like this mostly always have boomerang effect in the long run

If it's on 1st of April, his rent will expire a day before 1st of April i.e 31st of March, because he used the full April but in Op's case he only used about 14/15 days out of April i.e April 17, so his rent will expire on the 16th of April to complete April a full month for him/his rent.

Okay.. so in his case, the rent should expire on the 16 of April the following year.

I feel the OP should have known when his next rent will be due from a signed agreementl. He would have easily referred the landlord to it and make his case.

I don't know how best to explain this to you. I'm a Lawyer..and I've tried to let you know why the Tenancy agreements are made 11months for first rent payments...after which subsequent rents will be calculated as 12 full months...
How should I explain again biko? I give up.

You said you're a lawyer...

Now I see why Nigeria's legal system is in shambles.
I live in Lagos and I pay my own rent.
Tenancy in Nigeria is for 12 full months unless otherwise (in situations where the parties involved have different agreements).
That is the reason why most landlords prefer January to December rate/calculation.

Your foolishness is not what shocks me, what confound me is the fact that 75 people in concurrence, liked your comment. It isn't hard to see what is wrong with our country.

You can imagine the secondary and tertiary graduates we have in Nigeria.

No wonder many of them claim there are no jobs out there?

Can these ones pass an Aptitude Test, not to even talk of selling themselves at a job interview.

Idiocy is the new cool in Nigeria.

Even after you rent expires, you are entitled to six months without pay
Anybody who wants to prosper in life will never think like this. I had tenants that refused to pay owed money despite signing with a lawyer to pay gradually and they are still wretched many years on. They keep moving all over town.

These things should be clearly written in the agreement and receipt.

Some count it from month to month. Others put and expiry date on it.

you don't know maths
Your landlord is correct, April to March = 12 months April to April =13months
How? Check it this way........ 13/4/2019 to 13/4/2020= 1 year if you are calculating it April to April without specific date is totally wrong

@brownsugardr sue him! So long you have your a receipt. Do not mind all those misleading you here.

January 1, 2019 to December 31, 2019 is 1year

January 2, 2019 to January 1, 2020 is 1year

.
so apply this to your case

Are you saying he moves in in April but will not pay the rent for April?

This is too simple a maths to stress oneself over but I guest I have to do this right now.

His rent covered the following months below;

April 1
May 19
June 19
July 19

Aug 19
Sept 19
Oct 19
Nov 19

Dec 19
Jan 20
Feb 20
March 20

There you have it. 12 months ends in March.

He moved into the house in April and has to pay the rent for April so you start counting from April.

I hope you fully understand now.

Good luck.

In law, contract agreement has to have a specific date, month and year. Not month and year. Pls factor in the date. We don't calculate a year by months but by dates

Babalegba, you mean you have been cheating your tenant with a month rent!!!

So if he pay March 17, the next rent will be due Feb 16, the following year will be due jan 15, another dec 14, another Nov 13 and so on

How can you be this bold even with all these corrections above? Like how? Which Calendar are you talking about.

Lets assume it's not for rent purposes but basic counting.
18/04/2019 to 17/04/2020 is 365(6) days
18/04/2019 to 17/03/2020 is 355(6) days
1 year is 365(6) days.

Then for rent purposes depending on the initial agreement: if the agreement is to count by months that make up a year then if he entered the house on 18/04/2019 and paid rent on that same day then his rent expired on 31/03/2020 and NOT 17/03/2020.

If the agreement is to count by days that make up a year then the rent will expire on 17/04/2020.

There is NO BASIS for his rent to have expired on 17/03/2020. LIKE NO FU*KING BASIS

Ok sir. But, was there any for 12 months?
I'm telling you why it's calculated that way..but, since you wanna be rigid in thinking, kindly, read about 'Express and implied' terms. Cheers.
That is between him and the landlord if such agreement was entered into. Most tenant do not know their right !
Please, people should get proper agreement before making any payment, if your landlord is collecting the first year for 11months duration, ask for 1 month rent deduction .

My Landlord Is Intimidating Me And Wants To Evict Me Before My Rent Expires

I paid my house rent for one full year on 18/04/2019. My rent is due to expire on 17/04/2020.

But my Landlord is insisting it expired on 17/03/2020. Which is Eleven months. I have tried explaining to him but he wants to lock me out unless I pay immediately.

Please how do I get redress.

Igboman, go and pay your rent peacefully!

What are you people even saying... How can u say the landlord is wrong. You paid your rent in April so there it starts counting in the month of April.
See April 2019 as 1 month.
May 2019- 2 month.
June 2019- 3 month.
July 2019- 4 month.
Aug 2019- 5 month.
Sep 2019- 6 month.
OCT 2019- 7 month.
Nov 2019- 8 month.
Dec 2019- 9 month.
Jan 2020- 10 month.
Feb 2020- 11 month.
Mar 2020- 12 month.
Mr Man stop looking for trouble go n pay your rents... Don't allow some nairalanders put you in trouble, na you go suffer am o.

You be confirmed ogobo for counting April 18th 2019 to April 30th 2019 as 1 month,is that how u were taught in primary school..

He only used 13 days in April 2019 and will use the remaining 17 days in April 2020..

13 days 2019 + 17 days 2020 = 30 days which comprises of 1 full April month..

I know you are collecting rent somewhere, how is 1st of January and 30th of January related. It should be 1st of January against 31st December. So 18th of April against 17th of April.

How can you be this bold even clearly when you are making mistakes. Like how?

Lets do basic counting not for rent purposes

01/01/2019 to 31/12/2019 is 365(4) days
18/04/2019 to 17/04/2020 is 365(4) days

01/01/2019 to 31/11/2019 is 355(4) days
18/04/2019 to 17/03/2020 is 355(4) days

1 year is 365(4) days.

Sometime those who you called illiterates have best weapon to fight and defend themselves when its comes to a situation like this, do you know that your landlord was correct on the date of expiration, if its were to be I, I will make sure your rent start on the 1st of may and expired on the 31st of April to avoid conflict of interest .
Come to think of this, you start new year on the 1st of January why not say you will end the year on the 30th of January but a good accounting student will understand better. Always settled issue with your landlord because if he sent you parking then you are on your own cos the man you called illiterate will just issued one notice of eviction and filled it to fight you at the court of law. Unfortunately folks like you are those that shout "lawyers are liars" around town. He made his input you've refused to see any logic in it, do any extra research about it, placed a call or two to any other lawyer. You just started attacking the man and the Nigerian Legal System.
No one is a encyclopedia of knowledge but that you pay your rent or live in a Lagos or where ever for that matter does not give you the temerity to attack a person who is licenced to practice law anywhere in Nigeria.
Besides that jargon you put in bracket above cannot be interpreted in the eyes of the law. It is nonsense.
