Fashola signs law against abandonment of pregnant women.

LAGOS — Governor Babatunde Fashola of Lagos State, yesterday, signed a bill into law, which allows for the prosecution and jailing of any man who impregnates and deserts any woman.

The bill presented to the governor by the state’s Commissioner of Justice and Attorney General, Mr. Ade Ipaye, at Government House, Ikeja, was among  three other bills presented for the governor’s assent.

Other bills include amendments to provisions of the Emergency Management Agency, EMA, Law and the Administration of Criminal Justice.

Fashola, while assenting to the bills, said the various amendments to the laws were needed  to  tackle the problem of crime and delay in administration of justice in the state.

He said the enactment of the laws represented the commitment of the state government to building strong institutions, that could tackle crime and corruption, which had crippled the country.

He added that the country needed strong legislation to fight corruption and moral laxity.

Fashola explained that the Criminal Code Law, used in the state before now was enacted in 1914 by the colonial masters, saying that such laws and their provisions had since become obsolete and could not  address challenges posed by present realities.

First of all, I would love to see the link to this story.
secondly, you will have to prove that the person is responsible for the pregnancy which bring up all sort of other issues but it is a good move though

Good intentions but difficult to see how irresponsible men can be made to change via legislation. Responsibility is for both men and women equally. Abstain from unwanted Pregnancy or sex. Legislation can not remedy the risk.

This is another ill thought out law from Lagos.
1. How and who will determine the father of a baby?
2. How will this law interact with the federal law as regards family/divorce etc.
3. What is abandonment? Is it the same as in the other laws of the Federal Republic?
4. This not a crime in my state, whoose law takes precedence?

Altogether the poor (I mean broke citizens of Lagos) will have another load to bear in addition to all the others.

The 'Working' Governor should sign into law that the Government will be responsible for the goods damaged when trucks fall into pot holes or ditches all over Lagos roads. The money for the goods will be paid to the owner of the goods after evidence is shown that he pays his TAX. That to me makes more sense! GBAM

Addendum: The law will be tested in Lagos and if found effective will be adopted by the National Assembly and States' Assemblies all over the country.

I need to see a link to the story

The law is BS and cow poo, to put it mildly.

You cannot force anyone to stay with anyone who you do not want to be with.

Also is abandonment defined in the legislation? What if the putative father does not want to be physically with the pregnant mother but will provide moral support?

What if the lady abandons the man? Aha! Would it be OK for her to do it but not the man?

How can you prove paternity? What if the man denies ever sleeping with the gal much less impregnating her?

Will there be recourse for men who were falsely accused of abandonment if a DNA test subsequently disproves the claim that they were the father?

Will the lying woman be jailed if she knowingly claimed another man fathered her child and abandoned her?

This law is celebrating reactionary and stupidity politics, as mere good intentions should not predominate over reason and the law of unintended consequences.

u mean impreganating a woman and not giving a crap about her and her situation is not a crime?? and then lets say d woman out of shame decides to do somtin detrimental, that might even cause her life,  hmmm, i kind of think it is a crime!! i'm sure the government is not insisting that the man and d woman marry, or keep the baby, but it helps that wateva decision taken concerning d pregnancy is a collective decision from both the man and the woman. if the man is a looser, d woman may also decide to become a single mother. but it helps wen d society doesn't laugh at her and see her as a low life w/hore  because d yeye man that put her in that situation abandoned her and even denied his part in the whole deal.


Plus in general, i tink men would learn to stop unzipping their pants more often, learn to blame women less for having s.ex and do sometin worthwhile with their time instead of living reckless lives because they don't feel liable for having indiscriminate s.ex . . . . . i tink the moral lesson here alone is enough.
and if they really apply this with no bias watsoeva, i tink its a wonderful move!  undecided undecided


but then again, this is Nigeria!! no law passed is eva taken seriously or without being bias to those above the law, so i might have to agree that this is all bull and a very unnecessary digression from what people in our government sits should be doing. i'm sure there are more important matters to handle!! this kind of issue will be dealth with over time while in the cause of development. but for now; GIVE US GOOD ROAD, LIGHT AND THE TINIEST BIT OF SECURITY!

So the governor can order the test to be carried out when katakata enter bele story. Secondly I think the law is for deadbeat dads who completely abbandon the women with no form of support be it moral, physical or finnancial. Not men that accept responsibility and are contributing to the upkeep of the child eventhough they are not in relationship with the mother anymore.

The poster said Fash signed law against abandoning pregnant women. Nowhere does it say the law is for deadbeat dads, but you think the law is for deadbeat dads. You don't know and are assuming. I hope you don't assume facts not presented on your exams, because you will get a F9

why not make a law that makes the father responsible for providing support for the child he fathered

the law--at least from the topic--is geared at protecting pregnant women, not aimed at requiring fathers to provide support for a child they fathered.

and DNA test does not determine paternity until the child is born, so you don't know what the bleep you are talking about. Maybe you are the one who is too old to comprehend how DNA tests work.

Simple question here; I am an abandoned pregnant lady  where do i go to report the case? The INEFFICIENT POLICE or where? My point is there should be some special task force or agancies for this purpose.

This law does not make sense in a way until the baby is born and DNA proves the father.

The man can deny the baby is not his.

A typical scenario, An unknown woman comes out in public, saying Fashola impregnated her and abandoned her. Headline news!

If Fashola comes out to deny it, what will happen? How will they prove it is Fashola or not? Will he go to jail.

Another half baked law from half baked lawyers i would think.

after the law is born, the law presumably no longer applies, for the woman is no longer pregnant.

even if the law applied, you can't force a man to be with a woman he does not want to be with.

you may only require him to care for his baby after DNA test has established paternity, unless the man voluntarily obligates himself to take care of a child he did not father

bottom line, the person who drafted the law is a moorron. And for Fash to sign such a bill into law, has lost some points in my book. I hope it is not true.

another set of unsatisfiable Nigerian are posting here. the article says he was PRESENTED WITH a bill to sign and he did. what do some of you think, that he goes to his office one morning, thinks up a law, types it up and prints it out, then calls the press in just to watch him sign it. It was from the state house of assembly and he's just signing it into law. sheesh, people sef.

and, by the way, abandonment here, i'm sure, doesn't mean recusal to get married to. I think it's more along the lines of failure to assist in the welfare of the pregnant lady. there's no way the law can make the man marry her, except there has been a previous legal agreement between the man and woman that he would marry her if he gets her pregnant. the law is good. you guys are here on Nairaland, shooting down laws left right center. Yet you don't come up with better or more viable alternatives. its annoying.

as for those saying the law shouldn't be passed because it won't be implemented, how about this?. Let's remove every section in our constitution making armed robbery a crime punishable by the law. The police don't catch armed robbers, so what's the point in having those laws? Let's even remove sections making murder a crime punishable under the law. They don't catch thos ones either. Drunk driving? Legalize it. Everything our security agencies habe failed to control, make them legal. What's the point in having laws that make them crimes when we don't implement them, eh?od. you guys are here on Nairaland, shooting down laws left right center.
