The problem is the sister too needs to go to court to get declared as her brother's legal next of kin, from my limited understanding of the legal process.

Where the problem arises, is 'Was her brother mentally incapacitated when he made his girlfriend the next of kin in his documents? ' That's a problem really

The sister too does not cover herself in much glory, she was trying to get a mentally ill man to sign cheques? Without the consent of his designated next of kin? Okay...(I recall when the hospital where I worked had to write a medical report for a very ill man so that his next of kin..in this case his eldest son.. could get money from the man's account to pay for his bills.)

I too don't trust the girlfriend. Why is she befriending a mentally ill man?? What's her game?

Well, the man designated her as his next of kin, probably when he was opening the hospital card at a time when he was presumably lucid. (And he has apparently known the woman for some time).

If the sister wants to become the next of kin, she has to go to court with proof that the man was not in his right mind when he made his girlfriend his next of kin.

All in alll, it is a messy case.
