Not every lawyer that deals in real estate knows this.

So people be careful when consulting with a lawyer.

One thing to add tho, do you forsee trouble with some tenants or you just want to hit the reset button and be on the safe side?

You could void the current tenancy agreement. Be careful tho, and read your own agreement grin so you don't shoot your self in the foot.. see what terms you could void the agreement. Then draft up a memo something that sort of reconcile that , states the tenancy was voided with mutual consent bla bla bla.... This will be sort of like a letter from the tenant to you. Even though you drafted it, the tenant will write their names on top like they wrote it and sign, you sign plus a witness.

Then, have them sign a lease agreement... but please don't be greedy..make the new lease agreement free, don't go and charge them another 50k grin. Otherwise they will be hesitant, start asking questions etc... might derail your plan or make it tough for you to actualize.

Or easy enough, just change Management company and instruct the new company to use lease agreement that is favorable to both parties, you ( the landlord) especially grin

It sheds light on a new area of our discussion: MOTIVE!

I am naturally a peaceful person. Infact, l desire Peace so much so that l will go to war to achieve Peace.
My Parenst were Hosue owners since l was a little boy and l have witnessed this often "love-hate" relationship between tenants and House owners.
It is just natural that we dislike our Creditors, because we have to pay them as at when due and in the Nigerian environment where poverty is rife, through no-fault of the citizens in most but not all cases, "Paying or Repayment is not usually a pleasant endeavour" so l can understand if and when Tenants try to undercut and abuse the Landlord.

I have also witnessed where Landlords get very greedy and try to exploit their Tenant!
Landlords, though see their Buildings as their own investments, expecting a ROI on it and that is perfectly right, just like some invest in Stocks, Shares, start a Company that charges for Service rendered, Open a Supermaket/Stall and sell wares, etc.... all for the purpose of getting a Return on Your Investment, for now and in the future.
So, the Landlord expects to be paid but some Landlords want to heap all their financial woes on their Tenant, forgettingthat we are all in this same boat of "I go survive, e nor easy"!

But no matter how nice and friendly the relationship between a Landlord and his Tenant are, MONEY and USAGE of the Property are two areas that always cause rancour, eventually.
So, what ldo is try as much as possible, to smoothen that relationship by making documented provisions for all areas that may cause misunderstanding (usage issues) and also make provisions for how we will divorce ourselves AMICABLY, incase MONEY issues make our living together unworkable!

Where there are No-Laws, there is No Sin!
Where there is No-Sin, Everything and Anything is Permissible!
Where Everything and Anything is Permissible, ANARCHY Reigns!


I love Peace, l dont want Anarchy, so l put Rules in place, to guide my behaviour towards those that pay me money to live in m houses (I owe them a duty to enjoy their tenancy, in peace and quiet and to make their stay as memorable as much as is hunaly possible) and to guide their behaviour towards me (they owe me Payment as at when due and to use my house like it is their own).
For example, when "Nepa Payment" was causing trouble in one of my very first house, l stepped in and provided everyone in the Twelve Flats Building with separate Pre-Paid Electricity meters, at no cost to anyone except myself!
I bought Thirteen Pre-Paid Meters at almost a Million Naira, including one for Borehole Pump and General Compund/Security Lights, which l am responsible for topping-up till today, they dont fight each other anymore and my House is Peaceful.

So, l draw-up these Lease to ensure that everyone, myself inclusive, is "guided" by the Law and behaves as expected
It has not failed me to-date.
And l dont repeatedly charge them for "Agreement" every Year, as they Sign New Leases, that would be petty, even borderline greedy, of me
because all l do is "Update it Yearly" by making changes to things like "Dates for the current Year", "Covid-19 protocols (Reduce Human traffic, Spray the Main Entrance gate with Soapy Water, Use the provided Bowl of Soap water to wash your hands as you go-in and go-out of your Flat into the common Areas, use a face mask when you are in common areas but that is being relaxed now. Their safety is also my Happines, a truly Sick Tenant cant pay for his tenancy undecided grin )

Finally, a Houseowner cant trick tenants into signing a Lease Agreement, that will be unlawful and even criminal deciet!
I discuss what will be in the Lease with them verbally and we agree.
Then l draw it up i[b]n writing[/b] and give them to read and "iff" happy, to sign it or if not, revert back to me with their "concerns" which l will then have to explain to them again so we agree. If we cant agree, l dont sign a New Lease with such person.
All these process are DOCUMENTED so a Lessee cannot claim he was tricked or coerced into signing the Lease.

For example, the Lease, being a Lease, says you MUST Leave and Surrender the keys at the End of your ONE YEAR Lease. undecided
Now, No Lessee wants to Rent for just one year and then have to pack out and start all over again!
But that is what is in the Lease!
l also have a Clause that says "You can make an OFFER to the Lessor (Landlord), Two Months before the end of your Lease, of your INTENTION to sign another One Year Lease, when the current one Expires. grin
All negotiations (Offer, Variations if any, Acceptance and Payment) must be concluded by the End of the 11Month of your current Lease.
This gives me the "30-days window' to serve the "30days Quit Notice", as stipulated in our agreement (If l really need to get the tenant out of my Building)).
I then deliver the signed and perfected Lease, Three days to the End of the Current one and the Lessor keeps enjoying himself.
Lessor and Lessee are both happy

But in all cases (except one till date), we always conclude the negotiations and l just Print another FRESH One Year Lease Agreement, allow Tenant to study and be comfortable with it, we both sign, l stamp-duty it and each person keeps their copy. kiss kiss

I think barring the really crazy one, which l would likely have filtered-out in the early approach (hence my suggestion that House Owners should not just take any prospective tenant that your Agent throws at you but you should personally be involved and interview them to sieve them to your taste), most Tenants will be nice to their House Owner, if you treat them with dignity, fairness and honesty.
The odd-situation is when, for myraid of reasons, Tenant cant or wont pay his rent when it falls due, that is when @Lastpage becomes kind of unfriendly. grin
I dont have time to be chasing One tenant over money that wont carry me far!

BTW: Why would you want to Void Agrements, using Letters and Counter-Letters? That does not sound appropriate in my ears.
Everything has to be above-board, legal and must standup to scrutiny otherwise, you the Landlord, with get yourself into "legal trouble" down the line. A House owner MUST keep it legal and fair to all parties involved You are like a Daddy to your Tenants, so you must maintain respect at all times grin

The ONLY PLAN l have as a House Owner, is to ensure my Occupants pay me as at when due and Enjoy Value for their Money-paid and are safe in my building, at all times. No more, No less.

Serviced Apartments (short-term or long-term letting)

There are lot of these apartments in Abraham Adesanya estate. I was in one with one of my client during the Covid19 lockdown.

At 25 - 40k per night, I’ll still make more money than someone who let out a 3 bedroom flat (N1.2m/year) with less worry.

The agreement looks good but the part I can’t live with is going to court because I rent or lease out my property to a man paying less than N3,000 per night.

Before you get hearing and all those stuffs, it takes weeks, months, if not years and it’s not automatic the judgement will go in the owners favor all the time.

I don’t understand lease though but I understand Nigeria’s judiciary system to some extent.

I have a tenant though in one of my chalet but he’s not paying a dime. He’s my kids lesson teacher and he has been with us for over 5 years.

My end goal is to make money off my properties and not to learn how to deal with bad tenants. If one business model ain’t working, I’d rather invest my money in some other line of business.

What a honest and responsible Online Trader will do, in this circumstance, is to REPLACE the broken item or a FULL REFUND because even under Contract law, if the item contracted for, is not FIT FOR PURPOSE, that Contract is Void!
A broken Tiolet seat is not fit for purpose, imagine if it breaks when someone is stting on it and having a nice Poopoo! shocked It will tear the intestine of the person out, very, very dangerous! You dont want to be the person who supplied that dangerous item, because you will be liable Sir.

- Since you promised to "find a Solution to it", that is a very good statement from you and l applaud you for that!
All you need do is to fulfill that promise
and after that, you can then seek the understanding of the Customer for any percieved "use of language" on you or your threads.

Let me ask you: Do you think anyone reading these Posts, will feel confident in asking you to supply xyz number of Toilet seats to them or they would be worried about how many of them will arrive broken and you wont replace them?
What if it was a Govt project that requires 150 Toilet seats, wont that be a good deal to clinch?

My humble suggestion Sir: Dont worry about all the name calling for now, One WC Seat is not more than #20,000, Replace it and then let us appeal to the Customer to remove all negative posts he has posted and say "DFAMEGUY has resolved the matter to my satisfaction".

A lot of people that want to patronise Product Sellers, especially in this age of Covid-19, First do an online review of the Seller to know what others think of them and once they read a SINGLE Negative review, they run for dear money because they are thinking: That could be me! undecided

Thank God I found a better way to make money off my properties without stress.

- If you are certain that this was a Mistake and the Customer was getting angry, the easiet and safest thing to do or say is: I WILL REPLACE IT. Next time, you just ensure you package breakable items properly for transit.

I believe the emergency lane is on the right and it is not meant to be used as a traffic lane this making it safe for vehicles to stop there.

The guy was parked on that lane and the grass verge trying to figure out what to do before the other car ran into him.

Well like I said the sin of your engineer was not abiding to your instruction.
Nevertheless if I were him I would have added 1 more course(block) to that before running the oversite concrete.
Due to my terrain and certain other factors I try to do a minimum of 4 course off the natural ground level to mitigate capillary action.

If you have 3/8 (coarse sand) at your area and depending on it's price difference to granite, you can lay your DPM and do a rich concrete mix adding water seal cement to the mixture.
You can determine the thickness to do since you'll still do screeding on the floor at the time you intend to lay tiles.


Also remember the advice n3xt or lastpage gave regarding the exterior of the build.

I think you did not handle this well.
- First, even if your Customer buys something of #5 from you today, he may buy something of #50Million tomorrow, so never talk in a degenrating manner to your Customer, using the value of what he bought as a yardstick.

- If you are certain that this was a Mistake and the Customer was getting angry, the easiet and safest thing to do or say is: I WILL REPLACE IT. Next time, you just ensure you package breakable items properly for transit.
Ofcourse, l am not talking about if the Customer is just trying to play you.

- From your own post and your screenshots, l can deduce that you are aware that the Customer actually GOT a broken item. The Customer did not break the item himself. Maybe it broke in transit or you knew it was broken before sending it, that is a different question.
Even if it broke in transit, you the seller are still responsible for replacement. undecided

What a honest and responsible Online Trader will do, in this circumstance, is to REPLACE the broken item or a FULL REFUND because even under Contract law, if the item contracted for, is not FIT FOR PURPOSE, that Contract is Void!
A broken Tiolet seat is not fit for purpose, imagine if it breaks when someone is stting on it and having a nice Poopoo! shocked It will tear the intestine of the person out, very, very dangerous! You dont want to be the person who supplied that dangerous item, because you will be liable Sir.

- Since you promised to "find a Solution to it", that is a very good statement from you and l applaud you for that!
All you need do is to fulfill that promise
and after that, you can then seek the understanding of the Customer for any percieved "use of language" on you or your threads.

Let me ask you: Do you think anyone reading these Posts, will feel confident in asking you to supply xyz number of Toilet seats to them or they would be worried about how many of them will arrive broken and you wont replace them?
What if it was a Govt project that requires 150 Toilet seats, wont that be a good deal to clinch?
IMAGE is EVERYTHING for an online Trader!.

My humble suggestion Sir: Dont worry about all the name calling for now, One WC Seat is not more than #20,000, Replace it and then let us appeal to the Customer to remove all negative posts he has posted and say "DFAMEGUY has resolved the matter to my satisfaction".

A lot of people that want to patronise Product Sellers, especially in this age of Covid-19, First do an online review of the Seller to know what others think of them and once they read a SINGLE Negative review, they run for dear money because they are thinking: That could be me! undecided

THIS IS ONE OF THE REASON I DON'T ADVERTISE ON HERE, IN-FACT FOR ALMOST 10 YEARS OF BEING ON PROPERTY SECTION, I REFUSED COMING TO THIS THREAD (until Teewhy2, drew my attention to someone who stole a plan from my thread and tried to sell it here) - lol

WELL - ITS NOT BY FORCE TO WORK FOR PEOPLE, I TURN DOWN OFFERS IF I FEEL IT'S GOING TO BE A PROBLEM AT THE END OR IF I GET THE FEELING OF AN ATOM OF DIS-TRUST.

WE HAVE TO TRUST EACH OTHER 100% TO HAVE A DEALING PLUS I DON'T ASK FOR MONEY ANYWAYS, UNTIL I DELIVER......

My advice to whoever has a good name to protect, deal with people who trust you - I've had people here who trusted me 100% even b4 contacting me, just by reading my threads.....

NO BE BY FORCE TO GET CUSTOMER - SOME ARE OUT TO TARNISH YOUR NAME.

BTW: I've had plenty people end up not paying for services - but I will NEVER disrespect them or call them out - Infact, I still send them New year messages and call them Sir.....

Well like I said the sin of your engineer was not abiding to your instruction.
Nevertheless if I were him I would have added 1 more course(block) to that before running the oversite concrete.
Due to my terrain and certain other factors I try to do a minimum of 4 course off the natural ground level to mitigate capillary action.

If you have 3/8 (coarse sand) at your area and depending on it's price difference to granite, you can lay your DPM and do a rich concrete mix adding water seal cement to the mixture.
You can determine the thickness to do since you'll still do screeding on the floor at the time you intend to lay tiles.


Also remember the advice n3xt or lastpage gave regarding the exterior of the build.

Good luck on your build.

While you may have the best intentions, you have now written two/three or more posts to the "aggrieved buyer" but no single post yet admonishing the vendor to do right by his client.

Little wonder why you are quickly earning yourself some sort of ** reputation.

I like your hustle...but you really need to retrospect otherwise you'll continue to do your brand irredeemable damage by some of your takes in here.

MOST LIKELY NO...

1 tonne of rebar is about 250k and you should need at least 1and half = 380k
the wood you would need can't be less than 150k
Granite would be about 150k
Sand, lets settle for 100k
Labour for all workers (maybe) 200k
PERHAPS - filling b4 work can be done, but surely filling after raft is done.

AFTER ALL THE ABOVE, you still have rebar to floor and columns, concrete oversite (german floor)

THE ESTIMATE ABOVE ISNT ACCURATE - just me thinking out loud (could be more but surely not less)

Oh! My advice on perimeter drain?

For me, I see no better way to make your foundation maintenance free than to keep the waters away.

Soil quality and moisture content are the major causes of shifts in building foundations.
Although the surface of the ground can appear stable and dry, continuous percolation of water around your foundation may cause more damage than what a DPM or DPC can solve.

Even a stable bearing soil can become insufficient if nothing is done to prevent water from getting into your foundation.

We even need to do more in this age and time that sandfilling aren’t allowed to compact naturally.

Thanks for the input, i hv neva supported the process of transaction, i hv also said he still have privilege to return it.

He is in best place to call for refund or change of items damage, if he the vendor now fail to do so to satisfy his customer then we would take the case as scam.

It baffled me i see the way he acted, i try settle things he hold me as topic..

On the issue of retrospect you said, different people to different way of seeing things, but one thing is sure do good, good will always follow whoever. Sometimes you can not change things, what will happen will happen, i hv a failed delivery refund was not done immediately, "Tough situation don't last but tough people do.

70k he paid me 65k but base how far and closeness we have been through our discussion and for him to pay me 10k over many months I don't want him to feel bad which I told when he said he got it at ibadan 65k and he insisted that is that 65k that he will pay we get extend I told him to get the seat there which he refused and I told him already that the product you send is not mine and this is how they selling it here that he should get the seat there then that is when get angry with me and begging said that he dished me the 10k which he paid since , then i said no problem if that be case paid the 65k but know that am putting 5k to it then when I want to send him the total bill I ask to put 2k let be that he paid 67k which he refused I did not ask for it again I supplied him
