They have all rights to demand anything from him as compensation, I wonder what cheap weed people are smoking this days... If they were bla bla bla what is he doing selling newspaper... So because he is a vendor and his family doesn't have what it takes to make him live a fulfilled life we should now start frying water and stone abi...

You sef think am, if na your brother nko... No amount is too big... That security guy should also work is butt off to pay the family...

Gbaja is responsible for employing a lunatic and a killer who has no control over his anger.

In a sane country... This occurrence lasan would be the only stone that would destroy his political career and life... As press etc.. Blackmailers... and liars would come out and start testifying watin dem no see... He is lucky we are living in a jungle.

Lack of free money now has beclouded that lawyer's sense. How can he sue the speak? The DSS man is not an employee of the speaker. The speaker doesn't even have direct control of the man. These guys can be withdrawn and replace as so deem fut my the DSS.

They should sue his employers, the DSS

You and I know the speaker won't just say sorry and leave but will definitely compensate them financially but why putting an outrageous amount to it?

Try to understand too, the speaker requested for securities and it was granted so he will take charge of them while under him.

Have you asked yourself while police withdrew security men attached to some Nigerians recently after the SARS protest.

The family can sue whoever they want including the speaker, they can even join the security outfit.

So legally, that is how it works.

ThierryJay:

Try to understand. Vicarious liability pertains to a situation where a principal or an employer is held liable for wrongdoing committed by his employee/agent in the course of their agreed duties.

Gbaja is neither the principal nor the employer of the security aide that was merely assigned to him by virtue of his office. That's the role of the DSS, who pays the security aide from their budget funded by the FG.

So vicarious liability in this instance can only apply to DSS and not Gbaja.

If a car hire services driver kills someone while driving you somewhere, you would not be held responsible, the car hire company may be however on the principle of vicarious liability.

They can't afford him but based on this kind of case you need someone like Mike to drag them and am sure it's not on pro bono they will settle him from the settlement or Gbajabiamila will pay for his services.

So those families in the US that normally sue the state for unjust police killings are not benefiting from the death of their son? Will you be the one to cater for those he left behind? What is your grouse if the family decides to ask for some form of compensation? So what do u think they should do?

The speaker had stated it that he would take care of the kids the man left behind and the wife. What does that mean to you. Why not wait for the speaker to make his compensation before making your demands if you don't have any motive of profiting from his death?

Well, that's the least he could do and even though it is not enough to bring back the dead, he should be generous enough to acceed to their demands. I mean, look at that baby that was denied knowing his father.

If justice should be served well, that trigger happy DSS monthly salary and his gratuity and pensions when he retires should be slashed in half and released to the victim's family on monthly basis. That's the way it's done in saner climes. This should form a percentage of the 500 million naira.

I know a medical doctor here in Nigeria who pays monthly stipend to a family and also pays the school fees of the child who lost the mother during childbirth in the his hospital. This was not even deliberate o, just an unfortunate malpractice incident that led to maternal death.

So a murder by a DSS official should carry weightier responsibility.

Please stop this. They lost a life, a breadwinner, a source of hope for the family and a father to that little child. There is nothing that is enough address that tragic loss in the immediate term.

Truly life isn't always fair to everyone equally. But as a privileged person, you need to be extra careful that your actions or inactions do not add to the already compounded problems of the less privileged. And if by happenstance, it does by mistake, then please make sure you take responsibilities for such especially when you know that you can afford such responsibility.

In saner climes, contrary to what happens in Nigeria, the less privileged are always protected. That is the oil that lubricates national unity, human development and justice. What your post up there suggests is simply encouraging the oppression of the poor by the rich which unfortunately is what holds sway in Nigeria. It has even formed part of your personal value and that is why you see nothing wrong with condemning that family for the lawsuit against gbaja.

If Gbajabiamila as a speaker does not earn much, I'm sure the suit wouldn't have demanded that much. But since the politicians in this country feed fat on the citizens, it is only fair that he also pays a chunk as damages, although I know they may eventually settle to something like 150 mil.
Supposedly the vendor died due to natural causes, who would they have sued? Just asking ooooo.

Some of these people here thinks they are intelligent but very ignorant. He should go to the US and see how much the state has paid to families of police brutality and unjust killings. Families some times get as much as 250k usd for settlement. So he prefers the family of the man sit back and do nothing and maybe swallow empty promises that may not even be fulfilled in the long run. Oga speaker should pay up abeg

The family of the deceased made a mistake by employing a PDP lawyer to counsel them. Thus story will now take a political dimension and they will loose the good will of ordinary citizens.

Secondly, the threat to sue Mr Speaker is also a mistake. The security guy that shot and killed the vendor is not an employee of the speaker. He is employed, trained, controlled and paid by the DSS. He doesn't take orders from the speaker and so Mr speaker isn't responsible for actions. So they can not be suing the speaker.

A court in the US I read somewhere recently awarded over 10 million dollars for such accidental killing. Calculate 10 millions n dollars and you get over 3 billillon naira. But we understand you guys that have been screaming that #500 million is too big, is Nigeria not a country where people get killed because of #20 and nothing happens. Life is the cheapest commodity in Nigeria that is why the citizens feel nothing about the killings going on daily

There are those that have been killed during the endsars protest, nothing was done.

Lawyers are one of the problems of this country....ozhkome want to use the speaker's case to revive his dead career....idiot

Allow the court to determine who is liable and who is not. If someone while doing your job causes injury or harm to another, you are as much liable as the person vicariously. As for Mike being a PDP lawyer, the family should have hired Lai Mohammed, he is a lawyer and a member of APC. Arrant nonsense

I wonder o, all these lawyers are just reckless about their unreasonable demands, if the matter finally gets to the court, am sure the judge won't fine them that huge amount. I'm not saying his life is not important but lawyers have to be reasonable in their demand for compensations.

It's becoming really sickening to read comments on nairaland. You'll open some threads and see some monickers defending the government even when the said government murdered people in cold blood.

What I find really curious about this is that most of these monickers live abroad when they enjoy security of life and basic human rights.
Kekeerun, ednut1, coldie and other psychopaths like themselves are among the nuisance I described above. You will not go unpunished. Even if it skips you, it will never skip your generation.

I had to consult my dictionary to see if there is a new meaning to magnanimity. For you eh, when your security operative kills a man, while on duty, howbeit unjustly, and you reach out to the family, then you are being generous abi??
that's slave mentality bro!! its a responsibility/an obligation, not a favour.

Even when plane crash happens, the airline pays victims families huge sums of money. It's not out of order to ask for money from him, because the security man is his responsibility and there is no other way he can compensate them. abi he give them another son and father??

I will ignore your second paragraph, because if I want to address it, I go chop ban. Nonsense and gbajabiamila!

I'm just getting to know today also that compensation and magnanimity is the same to some people o. Maybe it's the onion scarcity that's affecting some people.
