Godoverevery:It's not about being rich...he had sex with her without her consent, according to our consistution that's rape. It doesn't matter if it happened in his room or not as long as he admits to it on that chat, even a charge and bail lawyer can easily win such case. Never rape any girl who knows the law or is close to people who know the law, or else you'll suffer. Cos they'll involve NGOs with the evidence, and believe me once it's a female a lot of people will willingly sponsor the case. So how far can your money go? If you're a salary earner the moment the case gets to your office, you'll immediately loose your job. You're talking like this because you've never handled any rape case before. |

Nazgul:Maybe you didn't read what she said........her account of the event can't win her the case. Obviously they were both drunk....even if she get a chat confession where is the medical report to back her claim, the bruises etc. Court of law is different from police station my brother......She made a very big mistake taking alcohol......her testimony of the event will be in doubt due to the fact she can't remember everything that happened. |

| Re: ... by Nazgul: 3:46pm On Dec 30, 2020 |
Godoverevery:Lol...what's the job of a lawyer then? Do you think any lawyer will allow his client give a testimony in court under such condition...of course not. He'll sit her down and make her tell him exactly what happened that faithful day. Her testimony would be properly edited before going to court. The Alcohol issue isn't even relevant once they get to court. The issue on ground is that she was raped and must prove to the jury that indeed a rape took place. I mean that's the reason why the guy was arrested in the first place. Every other event isn't necessary, as long as the guy admitted to it via the chat, believe me he will be nailed. |

| Re: ... by Nazgul: 3:52pm On Dec 30, 2020 |
Godoverevery:And for the medical report, as long as he admitted to it, his testimony is ok. Besides medical report can easily be forged. NYSC corpers do it a lot when they want to redeploy. So his lawyer can easily argue that the report is false but wouldn't be able to explain or defend him after evidence of him admitting to the rape is presented before the court. |
| Re: ... by Godoverevery: 3:56pm On Dec 30, 2020 |
Nazgul:lol....so the guy won't also have a lawyer!?? she will be cross examined and the alcohol will be used against her......infact she will even break down during cross examination from the lawyer. |

Nazgul:I wish it was that easy..lol |
| Re: ... by Nazgul: 4:00pm On Dec 30, 2020 |
Godoverevery:Oga... drinking alcohol isn't a crime in Nigeria as long as you're above 18, besides the crime here is rape. How can you use drinking against someone who was raped, when your client has already admitted to the horrible act. And rape in Nigeria consistution is 25 years. And your best defence to get your client off the hook is that she was drunk? Not even that they're lovers... Honestly I hope you didn't study law cos you'll make a very terrible lawyer. |
| Re: ... by Godoverevery: 4:05pm On Dec 30, 2020 |
Nazgul:Am not a lawyer but one thing i no for sure is the alcohol will be the opposition defence.....I will keep on telling you this her testimony would be doubted. All they need to establish is they both drank and were drunk.....case close. Am not vindicating the guy actions but rather been factual with no emotion.....law is base on fact not emotion. |
| Re: ... by Nazgul: 4:13pm On Dec 30, 2020 |
Godoverevery:Ok...seems you don't get the magnitude of the crime here so I'll explain it to you in lay man's terms. You and your friends go to a bar to drink, in the course of the drinking you get drunk and a flight begins, you stab your friend with a broken bottle on the neck and he dies instantly. You get arrested and charged with murder! Now according to your theory, your lawyer would say that you were both drunk so the charge of murder should be dropped against you? That you can't remember what exactly happened because you were under the influence of alcohol. My brother if that's the defence your lawyer has for you with all the glaring evidence of you stabbing your friend's neck you'll rot in jail. Stop watching too much Hollywood movies. The law is the law. If you break it you'll be punished regardless of whether you were influenced by drugs, alcohol or any other thing. |

Op please look for a human rights lawyer...after making the guy admit it on chat. He'll guide you on the next step to take. Please don't let this issue slide. You'll get Justice I strongly believe that. |
| Re: ... by Godoverevery: 4:21pm On Dec 30, 2020 |
Nazgul:Can you please read what you wrote again....they both fought right and one died.....first of all have never seen or heard of two drunk people fighting....let me clearify this been tipsy is different from been drunk so the instant you are giving is totally no brainer. Do some research yourself on Ronaldo rape case maybe you understand my point better. |
| Re: ... by Nazgul: 4:40pm On Dec 30, 2020 |
Godoverevery:Once a crime is committed, and you're charged, the job of the court is to prove whether you're indeed guilty as charged or not. In this case, the guy obviously raped her, and admitted to it so the issue of alcohol can't even come into play since he has already admitted to the crime. If there wasn't any evidence of him admitting to it on chats, then his lawyer can easily claim that they were both drunk, the guy in question will even deny seeing her sef. But when you have him begging her or bragging on chats, how do you explain that to the jury? Even admitted to injuring her, cos she'll tell him that her neck, hands and body is still hurting badly. And he's reply shows that he knows exactly what she's talking about. How do you explain that? Drunk or not he committed the act of rape and would be punished. Leave the Ronaldo case...I don't know much about it, but what I know is that the girl doesn't have chat evidence of him admitting to whatever it is she claims transpired between them. If she did he would be arrested and jailed. Why do you think police use this line "you have the right to remain silent cos anything you say or do can be used against you in court" They know exactly what it means cos in court exhibit would be properly scrutinized and if found guilty the culprit would be jailed |

Godoverevery:I wasn't drunk tho. I was tipsy. I remember everything else that happened, its only the words he spoke to lure me to the room that I can't recall. I accept part of the blame. Next time, will drink in solitude. And I have chat evidence. He has been apologizing since last night |
| Re: ... by Nazgul: 4:45pm On Dec 30, 2020 |
krissy111:My dear that's all you need...stop replying that guy. He knows nothing about the law. Please talk more with him on the chat, tell him your neck where he chocked you still hurts, make him admit to all the charges you'll level against him. Send me a pm if you want to follow this case and I'll link you to a human rights lawyer. With this alone, I can guarantee you that he'll spend nothing less than 10years in jail. |
