The book "The Law is an Ass" has a story that clearly depicted this scenario,
Even though the banana is overhanging your property thus trespassing, it's not yours so you can't take it. A more civil way of solving this is to call the attention of the owner to say his property is trespassing. but going legal, you can get evidence of trespass, cut down the bunch & stem that overhangs your property, get evidence that your compound/property is littered with garbages (in this case) the bunch/stem will be considered garbage but it's not your garbage still so you can't take it. Sweep your compound and go dispose all garbages at a designated waste collection point and keep records/evidence Because you may need it when the real owner accuses you of illegally taking his banana.

Go to the man and tell him to come and see something very important ...and please tell him it's urgent, if he's tying a wrapper don't let him change or wear a boxer...if he's bare feet, don't let him change into shoes, sandals or even have a change of cloths... grin

"Lure" him into your compound and with a straight face ask him to see the damage his irresponsibility has caused you.... grin
Then with another straight face...ask him what he intends to do..... cool
If He doesn't come u with any sensible solution and he's angry because you've wound him up...calm him down and tell him you have a fifty-fifty proposal.... grin
Don't tell him until he angrily ask "what might that be" then you respond.."Is that not obvious?" grin

Call the owner to come carry their thing na. I had similar experience before. I called them to come carry their plantain and after they cut it down they gave me some.

The thing is, if you want to eat the banana, you can't even finish eating everything before the remaining goes bad. So the best thing to do is to call the owner to come carry his/her load. If he/she likes he/she can cut for for you, if he/she no like they can carry their load and go, sikena.

Ethically, it is better to call the owner to come and harvest it.

Secondly, tell the owner to uproot the banana suckers close to the fence such that the leaves does not extend to your compound.

Where he refuses to comply, then report the matter to the Landlord body of the area. If the Landlords body couldn't resolve it, then proceed to the Police or state Ministry of Environment for their intervention.
