Thanks, I have read the link and it seems to say that they can choose to update anytime before their current visa expires

giselle237:
no.
The dependents can continue on a pre-existing visa while the main applicant changes jobs/employers and changes their visa.

Hello guys. If one switch from a 5 year sponsorship to a 3 year sponsorship. When do the dependants switch their visa? Is it before the 3 year sponsorship of the main applicant expires or they can continue using their visa for the 5 years duration they were given when the MA had 5 years sponsorship?
Any info on this guys

Hello guys. Please what is the average gas cost for a 2bedroom flat. EPC rating E. I topped up £30 2days ago and now it's remaining just £9. Is this normal or is something wrong with the meter. I own the heater for about 7hrs 2days ago, 5hrs yesterday and barely 3hrs today.

Tier4Dependant:
Thanks for your response. I just read your previous posts.

I have found a company that is ready to sponsor me, can I get the sponsorship and apply for visa without my current employer having a knowledge of it. Or would the home office notify my current employer when I’m being assigned a new CoS.

Notice of termination for my present job is 4 weeks which I intend to give when I apply for a new visa or when my visa is out.

Can I send you a PM?
My former employer does not even have a clue whether I have a new job or whether I am still in the UK or not. Na only you and your new employer know your current status.

Update!

Hello guys, thanks for your responses and concerns. I replied my employer and stated some of the incidents of ill treatment, bullying and threats I received while working for them. I also told them to go ahead and report me to home office. After a couple of days, they mailed me to return my uniform and other company items in my possession. They also called to ask if I was still in the town or I had left the country. Lol. I laughed in my mind. My successful visa application mail was sent to me already. I took the items to them today. The MD came out in person to receive the items and went back in immediately. As I turned to leave, I said in my mind "good riddance".

I will be resuming work at my new place of work (a care home, no longer domiciliary care) in a couple of days.

Thanks to everyone once again for your suggestions and advice.

If the advert mentioned driving was an essential requirement for the job, the company may well be within their right. However the use of intimidation and bullying is never the right approach. This is when being a member of a Union becomes very useful as you can get representation and advice in situations like this but I appreciate you are new in the country so not an option for you.

TheGuyFromHR raised a question about recruitment costs which has been glossed over - did the company pay your relocation expenses from Nigeria?
No. They didn't even tick Maintenance so I bore all expenses

TheGuyFromHR:
Try not to do the bolded. It may fetch you an unwanted escalation, which you'd rather avoid. And before you start waving the emotional distress banner, assess your own position and your actions carefully, as well as those of your employer. Documented and/or demonstrable ones preferably.

In my experience, probationary notice periods generally range between 1 and 2 weeks, so I assume you probably have the right of it in this case.

Regarding other matters which you may or may not have presented here, have you any documented evidence of the allegations of mistreatment and bullying you adduced? You mentioned the company refusing to stand guarantor for you as part of your securing accommodation, was this contractually promised in writing? You mentioned something about not being able to drive a manual car, remind us again - was your ability to drive a car part of the skills reasonably expected of you for this job? Does the company provide vehicles, and are those vehicles all manual (fleet vehicles in this country quite commonly are). What other grounds are there for your employer becoming dissatisfied with you and subsequently resorting to maltreat you as you say? Might the employer have grounds for a wasted recruitment claim against you?

In all probability, this will likely end with more threats and huffing and puffing, but don't apply silence to this matter. See it through.
I was told driving was a requirement and yes the company provides vehicles but wasn't explicit about manual transmission. Since the driving incidence, I have received a cold treatment including threatening of job sack and return to my country at any slight instance. My ID card expired since November and wasn't renewed so I move about with an expired company ID. I wasn't given the required training my colleagues were given. I get queried for things other colleagues do. E.g I was told I will be sacked for wearing the company's coat in a client's house but other senior colleagues do wear same coat and no one bat's an eyelid. I am accused of doing things and never given a chance to defend myself.

I can't agree more with Koonbey. OP is in a termination period. He holds 'em no explanation. None. Zilch.
They irony is the company, using their financial advantage and possibly access to pool of lawyers, embark on an unending civil matter against OP, using OP words against him.
Can OP win, yes he can and claim damages. However, the drain on his finances, wellbeing, health, impact on new job will be so severe.

The way I see OP (Progressivegee) going about this matter, he's not being firm enough and circumspectly articulated.
He might also been acting impulsely on too many advices. Well, I know the Bible alluded to ... Safety in the multitude of counsel ... But then, that is to reflectively reflect and act accordingly.

PS: I don't mean to be rude. Kindly don't construed my response as one. All the best
I would not want to be engaged in any legal battle. I am new in the UK and just want to leave the company and start a new life at a new place. I may not be replying the mail from the company anymore.

Respond with what's on your contract while letting them know that you neither signed any other contract nor did you receive any communications to this effect and cite clear cases of the bullying, harrassment and threats referencing verifiable incidences or reports about them.
Going by your contract, you're not obliged to stay beyond the 1 week stated. Just keep your communications clean and professional, no need to resort to unprofessional language.
I will do that thanks

Hello guys, after officially sending my resignation and sighting issues of bullying, harassment and threat by the company, I got this mail from the MD who is the husband of the madam. I have gone through the contract over again and the only clause that talks about 4 weeks notice prior to resignation is if the employee has passed the 3 months probation and I am only 2 months old with the company.

How should I respond?

In addition to what Ralph said, tell them

If they don't pay for your services rendered for so so days' work, you would have no choice but to contact small claims court.

I doubt Home office can do anything regarding pay. All the best and do not let this slide ọ smiley
Thanks

I'm so glad you "one upped" them! Good on you! If your contract says 1 week, you have nothing to fear and if they refuse to pay your already worked days, you should not hesitate to report them.
Thanks. I won't hesitate

Progressivegee this is the best advice for you.

Especially the bolded.

Write the specific things this person has said in your email.

There's nothing they can do to you. Even if you violate your employment agreement with them it's a private contractual matter not Home Office's problem insofar as you have COS from another employer and have applied to switch as required.
Thanks boss. I will notify them

Ralphlauren:
If you've not handed your notice of resignation, I'll suggest you do it ASAP.

Send it via email, quoting the notice period as stipulated on your contract and clearly state your last working day.

If they do not pay you your wages after you leave, please report them to the home office.

That company must be moving mad.

Let them know two can play the home office game and they are the ones that will be at the losing end big time.

You have absolutely nothing to lose - you are off to a new employer/sponsor cheesy
Thank you. I will do it ASAP
TravelRe: Living In The Uk-life Of An Immigrant (part 2) by Progressivegee: 1:47am On Dec 11, 2022
Ralphlauren:
Respond to his email with a scanned copy of your contract with emphasis on the 1 week notice period.

Tell them you will report them to the office for acts of modern day slavery, non adherence to labour laws, bullying (constantly threatening you with job loss is workplace bullying) and harassment and ask home office to revoke their license.

Feel free to go ahead with your threat and watch home office enforcement officials show up at their office unannounced and launch a full blown investigation.

Home Office can decide to suspend their licence pending the outcome of their investigation.

If seems all these mushrooms agencies issuing COS do not know they can lose their license just with one email from an employee they've maltreated.
Thanks

Hi guys, I posted sometime ago (other miniker) about issues with my company because I wasn't able to drive and how they threaten to sack me at any slight instance including feedind a dog thrice instead of twice. It hasn't been easy for me. I have been trekking in the winter to see clients and never complained yet my company never cease to threaten me of sack for the most trivial of issues. They constantly remind me that they are doing me a favor by keeping me cos I wld have been long gone to my country the moment they noticed I cldnt drive. They refused to renew my ID card and didn't give me the training they give to other staff.

I was told by my South African colleague that the company wants to chase me and I should find a new sponsor before I am chased out. Luckily for me, I got a new sponsor and I have a new COS. I have also applied to update my Visa using priority option.

My company sent me a mail that they have booked me ahead for work till the new year. I plan to start at my new place before the Christmas. I responded that they should only book me for a week cos I will be stopping after a week. My contract states that both parties should give at least a 1 week notice before contract termination.

I was told to report to the office and on getting there I laid all my concerns. I have been living in an hotel with my wife and two kids for close to 2 months and the company refused to stand as a guarantor for me to get a house. I also made other concerns. They said its non of their business if my kids are registered with a GP or not or if I have a place as long as I work with them. I maintained my stance that I want to quit but was told I must work for a month before quiting or forfeit the pay for the days I have worked. I said I wasn't going to work and the madam opened the door and asked me to get out. I got up and left.

Later in the day, the husband mailed me that I am breaching my contract that I must work 1 month or they will report me to home office and I will have a limit to stay in the UK. I didn't reply his mail but I have a copy of the contract that states other wise.

Any advice for me guys?
