The Economic and Financial Crimes Commission
on Tuesday continued its case against a former
Governor of Plateau State, Joshua Dariye, with
one of its detectives, Musa Sunday, telling a
Federal Capital Territory High Court in Gudu how
the former governor allegedly shared N1.162bn
belonging to the state.
Dariye, who is now the senator representing
Plateau Central Senatorial District in the Senate,
allegedly obtained N1.162bn ecological funds as
Governor of Plateau State in 2004.
Dariye, who served between 1999 and 2007, is
being prosecuted for allegedly diverting Plateau
State’s ecological funds while in office as
governor.
Sunday, an investigator with the EFCC was cross-
examined by Dariye’s lawyer, Garba Pwul (SAN)
on Tuesday.
The detective who had earlier been led in
evidence by the lead prosecuting counsel, Mr.
Rotimi Jacobs (SAN), under cross-examination
gave a breakdown of how Dariye allegedly
disbursed the N1.16bn to his political associates
and officials of his party, the Peoples Democratic
Party, in Plateau State.
He said investigations by his team of detectives
revealed that the ex-governor gave N100m traced
to a company – Marine Float Nigeria Limited
owned by former Vice-President, Atiku Abubakar.
“The Ecological Fund Office is under the
Presidency but the Office of the Vice-President
oversees it and the vice-president chairs the
agency’s activities. The vice-president at that
time was Alhaji Abubakar Atiku,” the witness said.
He also said N100m was traced to the South-
West PDP, which was received by then Minister of
Special Duties, Yomi Edu, N80m to then
Permanent Secretary of the Ecological Fund Office
in the Presidency, Kingsley Nkoma; N10m to a
former Deputy Senate President, Ibrahim Mantu,
N6.8m to the PDP Plateau State and N66m to
274 PDP wards in the state.
Sunday, who is the first prosecution witness, read
out the portion of the statement made by Dariye
to the EFCC where he confirmed the distribution
of the money among his political associates in a
statement he wrote to the EFCC in July 2007.
When given Dariye’s statement to read, the
witness read from page 10 of the statement
marked Exhibit P13(A) which highlighted how
Dariye gave a breakdown of how he disbursed the
N1.162bn received from the Ecological Fund
Office.
“In the course of investigation, Marine Float was
found to be a company owned by the former
Vice-President, Alhaji Abubakar Atiku. As at when
the money was paid, the Vice- President was the
Chairman of Ecological Fund Office,” the witness
said.
He denied knowledge whether the N100m was
recovered from Atiku.
When Pwul suggested to the witness that the
then President, Olusegun Obasanjo, returned to
Plateau State in 2004 the N100m paid to the
South-West PDP by Dariye, the witness denied
knowledge of such development.
He added that investigation into the issue
revealed that Dariye paid N80m to the then
Permanent Secretary of the Ecological Fund
Office, Kingsley Nkoma, “for facilitating the
prompt release of N1.62bn ecological funds to
the state.
“The N80m paid in favour of Union Savings and
Loan, was traced to Kingsley Nkoma, Permanent
Secretary of Ecological Fund Office. We recovered
the N80m from Nkoma, who said that was his
share for facilitating the release of the money.
That was the bribe he collected.
“Investigation proved, while he was invited, that
the N80m paid to him through Union Savings and
Loan was a bribe money paid to him by the
defendant. The money was recovered from him.
The N80m registered from Nkoma is registered as
exhibit and it is with the EFCC. When we invited
him, Nkoma said that that was his share of the
money and he was made to return it.”
The witness restated his earlier claim that Dariye
made his banker, All States Trust Bank (now
defunct) to conceal his identity.
He said their investigation revealed that the
mandate card for the account allegedly operated
by a firm linked to Dariye – Ebenezer Ritnan
Venture – did not carry anybody’s photograph as
required.
He said they were able to uncover the company’s
true ownership by Dariye’s signature on the
mandate form.
He said Dariye allegedly diverted his share of the
N1.162bn into the company’s account.
The witness said the bank and its officials, who
claimed to have granted Dariye waiver by not
including his photograph in the account opening
documents, had since been convicted by a
Federal High Court in Kaduna for aiding fraud.
The trial judge, Justice Adebukola Banjoko,
adjourned further hearing till noon on Wednesday

The President Muhammadu Buhari-led federal government may have found a new way of funding the 2016 budget, Vanguard reports. This new resort, a Sukuk Bond, was secured as the budget deficit widens due to pressure on the federal revenue following steady the decline in oil revenue. The Bond is said to be a financial certificate which is similar to the traditional government bond, but aligns with Sharia, Islamic religious law. To achieve this, the Debt Management Office, DMO, and Securities and Exchange Commission (SEC) are working hand-in-hand to issue the Nigerian sovereign Islamic bonds this year. Although the details of the revenue to be generated from the bond has not been disclosed, officials confirmed that they expect significant bridging of the 2016 budget deficit which has exceeded the initial N2.2 trillion estimate. “Issuing a sovereign Sukuk will attract significant amounts of affordable capital from the Gulf countries and other established Islamic markets around the world into Nigeria,” the DMO informed. SENATE President, Bukola Saraki, has said that speedy passage of the 2016 budget was not a problem but the ability of the executive to implement it. Speaking to State House correspondents on Friday after joining President Muhammadu Buhari to receive Christian residents of the Federal Capital Territory (FCT) who paid him a Christmas homage at the Presidential Villa, Abuja, he said even though the document was good, the ability of the bureaucracy to implement it was another thing. He said: "You know as we said, we are going to work on the budget as quickly as possible. We are conscious of its importance to Nigeria and we are not going to waste time. As soon as we come back (from break), we will get down to work and do what we have to do. "It is a good document, it has addressed the major issues, 70 per cent capital and infrastructure. The key issues now are really implementation. We as the National Assembly will ensure that we get our oversight right. "By and large, as a document, it is a good document and I am sure it will not have too much difficulty passing through the National Assembly. The key issue is implementation to ensure that the bureaucracy does not kill the joy of the implementation of the budget. We will do our part." As US begins export of crude oil, Nigeria’s crude oil may suffer further setback in the global market. The US Congress had on Friday approved the lifting of the ban as part of a $1.1tn spending bill. The bill was later signed by President Barack Obama. Following the lifting of the ban on the United States oil exports, US can now export crude for the first time in more than 40 years. An indication that Nigeria may soon lose its biggest customer. The US now buys a small amount of Nigerian crude oil due to the dramatic rise in domestic shale production. The growth in US light sweet crude oil production has resulted in a sizable decline in the country’s imports of crude grades of similar quality, such as Nigeria’s. Since June 2014, crude oil prices have been on the decline and this has consequently exacerbated the dwindling fortunes of the Nigerian crude, with the nation’s crude differentials trading at a 10-year low. There are reports of Nigerian crude currently floating on ships with a significant amount finding home in storage tanks rather than in refineries as a result of the supply glut in the global market, which is dominated by largely by light sweet crudes. Meanwhile, Kaduna refinery was said to have commenced production on Saturday. Esther Nnamdi-Ogbue, the managing director of Pipelines and Products Marketing Company (PPMC) said the refinery was reopened to meet up with the December deadline for the four refineries to return to full production. Senator Buruji Kashamu, representing Ogun East
senatorial district on the platform of the Peoples
Democratic Party (PDP) yesterday won back his
seat at the Court of Appeal in Ibadan.
He floored his challenger, Mr. Dapo Abiodun, of
the All Progressives Congress (APC), as the
appellate court set aside the judgment of the
tribunal and ruled that Kashamu was validly
elected.
The Ogun State Elections Petitions Tribunal in
Abeokuta, the Ogun State capital, which had on
October 9, 2015, set aside Kashamu’s declaration
as winner of the March 28, poll into the Senate,
and ordered rerun in 110 polling units to
determine the actual winner of the seat.
Reading the lead judgment, Justice M.L Shuaib,
held that the tribunal erred and was partisan,
adding that it descended into the arena and
scouted for evidence to nullify Kashamu’s
election and truncate his victory.
He held that it was curious, illogical and perverse
of the tribunal to place so much reliance on the
evidence of a prosecution witness labelled as
PW44 and further admit as evidence documents
that were clearly inadmissible under the law and
also act on such evidence to truncate Kashamu’s
victory.

The panel also noted that the PW 44, who posed
as a forensic expert had discredited himself
during cross examination when he stated that
anyone with prerequisite knowledge could do what
he did and added that he had no degree in
statistics.
The three man panel further held that the case of
Prince Dapo Abiodun and the All Progressive
Congress is a non issue as the material used to
nullify the results of elections in some polling
units and order re-election is inadmissible in law.
The three man panel comprising of Justices A.G
Msheila, M.L Shuaib and Ignatius Agube also
adopted the same judgment for the cross petition
filed by Prince Adedapo Abiodun.
Meanwhile, Kashamu has hailed the judgment of
the appellate court, describing it as a victory for
democracy and the good people of Ogun East
Senatorial District.
“I dedicate this victory to the Almighty Allah ‘Sub
ana wata’alla.’ I am happy at today’s (yesterday)
verdict of the Court of Appeal. I am happy that
justice has been served. I am particularly elated
that the judiciary has once again risen to the
occasion as the last hope of the common man.
“I am happy that despite the ills of our society,
the judiciary still boasts of men and women of
integrity and great courage who can resist filthy
lucre and stand up for the truth and justice.
“I salute the good people of Ogun East Senatorial
District who overwhelmingly gave me their
mandate. I thank my party leaders, elders,
associates and supporters, for standing by me all
through the litigation. I thank my legal team, the
media, clerics, the youths, students, artisans,
okada riders, market men and women, for their
best wishes, prayers and support.”

The Supreme Court on Thursday, December 3, 2015, adjourned the ruling on Senate president, Dr Bukola Saraki’s application to February 5, 2016. After hearing on the submission by both counsels, the chief judge, Mahmud Mohammed, leading a panel of seven other judges, said ruling on the matter will be heard next year. At the hearing following submissions by counsel to the Senate president, it was observed that the Code of Conduct Tribunal (CCT) in its trial headed by the chairman, Danladi Umar, was not properly constituted. Daudu said the CCT is also not a court of competent jurisdiction to hear a criminal case. However, in his objection, the defending counsel representing the federal government, Rotimi Jacobs argued that the submissions made by Daudu lacks merit. He argued that the tribunal was properly constituted as only two members were required to form a quorum which empowers the tribunal to sit. But one of the judges intersecting said report before the court has it that that tribunal was constituted with two members of the tribunal including the chairman which is contrary to Schedule 15 of the constitution. The constitution states that the Code of Conduct Tribunal must be constituted with the chairman and two other members of the tribunal. But the dedends counsel, Rotimi Jacobs urged the court that by the words used in the constitution, the court is limited in criminal jurisdiction. “What we are saying is that the power to prosecute must rely on section 174 and 211 of the constitution and all other powers must bow to this sections,” Jacobs added. He finally urged the court to dismiss the appeal by Saraki. Following this, the counsel to the senate president, Joseph Daudu said he had no further reply to his colleague’s arguments. The senate president is alleged to have falsely declared his assets to the Code of Conduct Tribunal. The supreme court in its previous ruling ordered that the proceedings of the CCT be suspended. What is wrong with some men? This incident
happened on Monday November 16th at their
home. The man allegedly used pliers to cut off
the woman’s ears during a fight in their home
after she reported his abuse to the police.
According to the friend, they married in December
2014 and the woman has been suffering abuse
since the marriage. They have a 3-month old son.

His name is Nonso Paul Nzedebebe. They got
married in December 2014 and have a 3 months
old baby. The girl carried the pregnancy for 9
months in agony and threats but we thought after
delivery he will amend his ways.
The day the lady was discharged from hospital,
after a Cs operation, he beat her, locked her up
and used a knife to stab her. But she escaped
and ran to Rubghe Police station to report. He
was invited but refused to honor their invitation.
He later assured them he will show up and was
cautioned to maintain maximum peace till he
shows up.. Eventually, on the 16th of November,
he cut her ear with pliers for reporting the abuse

The Minister of State for Petroleum Resources, Dr. Ibe Kachikwu, has ordered the Department of Petroleum Resources (DPR) to sanction all errant petrol stations in the country who are hoarding petroleum products and sell-off for free the storage of all such filling stations. The measure is part of a spirited federal effort to end the fuel queues in major cities across the country, and the Minister asked DPR to ensure strict compliance by visiting various fuel stations. The minister said: “I have instructed DPR that if they discover any fuel station involved in hoarding, they should sell the products for free to customers around there. It is not just sealing the station that is the answer. It is penalizing them when they do these things and I hope the message goes out loud and clear.” The Minister, billed to host a strategy session with the Major Marketers Association of Nigeria (MOMAN); the Depot and Petroleum Products Marketers Association (DAPPMA); the Jetty and Tank Farm Owners Associations and other relevant stakeholders in Abuja on Wednesday, charged oil marketers nationwide to cooperate with the government to ensure speedy clearance of the fuel queues. “I am getting all the majors to get involved and they must take charge of the situation and they must take responsibility for all their filling stations,” he said. “Currently, there is enough supply and we are moving trucks massively to address the situation. I have instructed the DPR and the Petroleum Equalization Fund and all the other agencies to work towards the fast track movement of petrol bearing trucks and vessels.” On the N413 billion subsidy claims to marketers, he said President Muhammadu Buhari has transmitted a letter to the National Assembly for the legislative approval of the subsidy claims, noting that CBN will make the funds available to the marketers once appropriated by the National Assembly.

In 25 Task Force Brigade’s area of responsibility, the troops were able to clear Boko Haram terrorists camps at Nwalemer, Mallemiri and Bale. Similarly in Gwoza axis, troops of 26 Task Force Brigade have also destroyed terrorists camps in Tripkwopta and Gidan Gachi yesterday. The troops however encountered an Improvised Explosive Device (IED) buried along their route of advance near Balazalla Dure that partially affected one of the leading vehicles. The troops also encountered an abandoned truck loaded with IEDs at Uvole village, which was blown up by them. Also, with close air support by the Nigerian Air Force, troops of 28 Task Force Brigade advancing along Bitta and Damboa axis cleared Boko Haram terrorists’ camps at Modupe 1, 2 and 3 and in the process rescued 61 persons abducted earlier and held captives by the Boko Haram terrorists. The rescued persons were mainly women and children and have since been evacuated. The troops also recovered 2 Dane guns in the area after an encounter with the terrorists at Langaran Fulani and also killed 4 terrorists, arrested one. The public are hereby reassured that the Nigerian Army remains committed to its obligation to Nigerians. This is being demonstrated daily by the personal presence of the army leadership with the forward troops. It is reinforced by the manifest desire and zeal of the rank and file down to the last rifle man to discharge their responsibility for the restoration and maintenance of peace as well as the safeguarding of the safety and security of the citizenry in the North East. Speaking to Daily Sun, Executive Secretary, Major Oil Marketers Association of Nigeria (MOMAN), Mr. Obafemi Olawore, expressed gratitude to the Federal Government for approving the N314 billion subsidy claims, stating that what was approved was 90 per cent of the amount owed. Olawore had, in an earlier interaction with journalists in June, explained that it takes an average of two weeks for the ordered consignment to arrive the country. On the approved N314 billion, he said the association was expecting to receive the money any moment soon. ‘‘What they approved for us is about 90 per cent of the amount owed. We are grateful to government for that. And for other outstanding bills such as interest rate and foreign exchange differentials, we are working together to arrive at a reasonable conclusion,’’ he said. Meanwhile, the Department of Petroleum of Resources (DPR) yesterday closed down the depots of Total Nigeria Plc, Dee Jones Limited and Eterna Oil Plc in Ibafon area of Lagos for hoarding over 46 million litres of petrol. The agency has also debunked the claims by marketers that there is scarcity of petrol and blamed the tight supply situation on depot owners, who hoard products, thus causing panic buying. While Total and Eterna Oil were hoarding 13.6 million litres each, when DPR’s surveillance monitoring team visited the depot, Dee Jones was hoarding about 19.5 million. However, the General Manager of Dee Jones, Mr. Willy Ikeora, denied that the company was hoarding the product in its depot, stressing that they were loading but not as fast as expected by DPR. The regulatory authority also queried Ascon Oil and ordered the management of the company to appear at the agency’s head office by 3pm yesterday to explain why the company should not be sanctioned for its slow pace of loading tankers despite the availability of eight million litres in the depot. Integrated Oil and Gas Limited was also directed to speed up the loading process as the company had up to 10.2 million litres of petrol when the agency’s surveillance monitoring team paid unscheduled visit to the facility. Addressing journalists during the inspection, the Director of DPR, Mr. Mordecai Ladan, stated that the sealed depots would pay a fine of N2 million each, while the others should explain why they were loading at very slow pace. “This exercise was embarked upon because of the impression that the general public has about product supply and distribution. We have been inundated with a lot of enquiries on the right situation and we have been telling the public that the people should not engage in panic buying because records at our disposal indicate that we have enough of this product. As at yesterday nationwide, we had in stock almost over 300 million litres. In the Lagos storage area, we have over 220 million litres,” Ladan said. “So, today, we have decided to come and see things for ourselves and as you can see, we have visited about four different depots now and these products are really in stock. Where we are now, you can see that they have 13 million litres in storage but they are not loading. Why? The Accountant-General of the Federation, Mr Ahmed Idris, says government is taking proactive steps to make sure that salaries are not delayed again. Idris said this in an interview with newsmen after the commissioning of a creche donated to the office of the AGF by ECOBANK on Thursday in Abuja. He expressed regret that most Federal Government workers as of Thursday were yet to receive their salaries for October. He said the delay was caused by technical fault in the Integrated Payroll and Personnel Information Solution (IPPIS) system. Idris said, “We are being proactive and we will do whatever it takes to maintain the technology and make sure that this kind of thing does not happen again. “It is not in our interest that this kind of thing is happening and we bear the responsibility. We are doing all it takes to make sure that it doesn’t happen again. “We have established a backup for GIFMIS (Government Integrated Financial Management Information System) and this will ensure that we are prepared the next time we experience system failure.” Idris said that whatever technical fault experienced, it had already been resolved and salaries were now being paid. “It is not anything that has to do with lack of money. We have resources; we have money but the technology to deploy. “We now do e-payment so any slight glitch in the technology will impact on payment. And that is what has happened. “But this has been resolved and alerts have been coming. People have started receiving their salaries,” he said. President Muhammadu Buhari on Thursday said the achievements of his administration would be counted based on the number of Nigerians that were moved out of poverty. He said the economic focus of his administration would ensure inclusive growth. Buhari disclosed this in his opening remarks at a presidential retreat organised by the Office of the Secretary to the Government of the Federation for ministers-designate. The retreat held inside the old Banquet Hall of the Presidential Villa, Abuja had “Delivering Change: From precepts to practice” as its theme. The President said all government officials should count themselves privileged to have been chosen among millions of their compatriots at this time to be the instruments that will deliver the change the ruling party promised. While describing the work of restoration and renewal as urgent and immense, Buhari described Nigerians’ expectations as high. He added that government officials’ determination to succeed and change the fortunes of the country must be equal to the challenge. He said he was convinced that in accepting his invitation to work for the nation, the ministers- designate were also equally determined to take part in what he described as a patriotic undertaking. The President said with the retreat as their first official contact with the machinery of government, of which they will soon be part of, it is important that the ministers-designate are fully acquainted with the direction and priorities of the government so that all officials can move together as a team. Buhari said, “My election as President of this country was hinged on my promise to tackle corruption, insecurity and revive the economy. “We have already taken deliberate measures to plug leakages of government revenue and resources. You all know the steps we have taken to tackle Boko Haram. We have degraded them and in desperation, they are resorting to attacks on soft targets, killing innocent people. “Diversification of the economy away from oil will be a major focus of this government. We will intervene in mining and agriculture and upgrade the country’s physical and social infrastructure, which will broaden our revenue base and significantly improve the level of employment, especially among the youth. “Our economic focus will be policies that will ensure inclusive growth and we will count our achievements based on the number of Nigerians we move out of poverty. “The objective of this retreat is clearly reflected in the choice of topics which you will be dealing with during the sessions. The need for observing the rule of law is being emphasised to ensure that impunity is removed from government conduct. “You are coming on board the ship of governance at an interesting time. So much has been said about the state of our economy. It is expected that we make the running of government at all levels as lean as possible, avoid waste and conserve resources. Details have emerged regarding the diversion of N5.2 billion in public funds by Delta State Governor Ifeanyi Okowa and the CEO of ULO Consultants Limited, Uche Okpunor. The money was originally loaned out for the renovation of the Asaba International Airport because the Nigerian Civil Aviation Authority (NCAA) recently downgraded the airport due to poor maintenance of runways and taxiways. After the NCAA’s downgrade of the airport, Governor Okowa immediately submitted a request for a loan of N5 billion to the Delta State House Assembly. The funds were intended to be allocated to ULO Consultants Limited, the contracting firm handling the renovations of the airport. SaharaReporters was informed that during the negotiation stages of the loan, Mr. Okpunor, a close ally of former Senate President David Mark, sold the contract to the Chinese firm China Civil Engineering Construction Corporation (CCECC). Speaking on the condition of anonymity a member of CCECC’s senior management staff explained to SaharaRerporters that the rehabilitation of the Asaba airport has been delayed due to the pilfering of billions of Naira by both the Governor and ULO Consultants. According to the source the new contract was originally negotiated for N2.5 billion, less than half of the original amount issued out. The CCECC executive explained that they had learned that the other half “went into the Governor's tribunal case, possibly to buy judges, although we [CCECC] did not care.” However, CCECC did not even receive the N2.5 billion immediately after the release of the funds Governor Okowa collected N500 million. Another N1.5 billion was pilfered by USO Consultants, leaving only N500 million for CCECC. Because of this diversion of funds, the CCECC has refused to begin work on rehabilitating the Asaba International Airport. Speaking to SaharaReporters the CCECC senior manager said, “we will not go to site unless the full money is released to CCECC.” ULO Consultants is known for abandoning contacts, it has yet to complete construction of Mariam Babandiga Way or section A of the Asaba-Ughelli dualisation. The company has also been accused of completing projects with substandard materials. Mr. Okpunor has not returned the several calls and messages SaharaReporters has made to his mobile number. Troops of 28 Task Force Brigade Nigerian
Army deployed at Bitta and Pridang
yesterday October 27th, carried out a
successful raid on suspected Boko Haram
terrorists camps at Bulajilin and Manawashe
villages along Bita and Damboa road at the
fringes of Sambisa forest. The troops were
able to kill 30 Boko Haram terrorists. See the

The unit also rescued 338 persons that were
held captive by the terrorists in the enclaves.
A statement by the Nigeria Army
spokesperson, said the rescued persons
which comprised of 8 male, 138 female and
192 children have since been evacuated to
Mubi.
During the raid, the troops were able to
recover arms and ammunitions which include
1 General Purpose Machine Gun and 2 Dane
Guns, 150 rounds of 7.62mm (NATO), 6
boxes of 7.62mm (NATO) and 3 cutla$$es. In
a related development, troops based on a tip
off, ambushed and killed 4 suspected Boko
Haram terrorists on a suicide bombing
mission to Gubula, Madagali Local
Government Area, Adamawa State. Apart
from 2 AK-47 rifles recovered, the troops also
recovered some Unexploded Ordinances
(UXOs), mortar bombs and cash sum of
N153,385k was retrieved.
The statement added that “having appealed
and given the terrorists final warning, we
would like to state that from now on troops
within bounds of respect for human rights
and rules of engagement, we shall continue
to decisively deal with Boko Haram terrorists
until they are defeated”.
