The governors very smart here. They were not specific to Rivers state. The governors asked the supreme court to only interpret section 305 of the constitution and they never mentioned Rivers state. If the governors mentioned Rivers state, the SC will say they are meddlesome interlopers.

Sim and the Rivers state house Assembly members can still challenge thier removal by the president, but it has to start at a federal high court and not the supreme court It was Joshua Dariye and the Assembly members that filed the case at the supreme which ought not to be so. It is only the Rivers state government that can take case direct to the supreme court.

Declaration of state of emergency is the taking of extra-ordinary measure to restore peace in an area. The question then is: what is this extra-ordinary measure? Simply, it is the deployment of full military to take over civil duties or other means to restore order and peace. It does not entails removing or suspending elected officials at the state or local government levels. NBA should as matter of fact go to court inorder to contest this declaration. The supreme passed a judge sometimes ago that when a governor is elected, he or she must serve 4 years in office irrespective of the time or period he was elected.

Declaration of state of emergency does not necessarily means suspending electwd officials. It entails the deployment of military to take over civil duties. Understand that under normal circumstances, the soldiers are not supposed to participate in internal security. The governor and the House of Assembly members supposed to work with the military in restoring order in the am state. If you look atit technically, the whole country is under state of emergency as a result of the deployment of military to handle civil duties.

Was the defection of the 27 Rivers state house of Assembly members before the supreme court? If not why should the supreme delved on the issue of defection of the law makers? The courts have on several occasions made it abundantly clear that they are not 'Father Christmas', hence they can only give you what you ask them.
