The ongoing war of attrition between the Presidency and the Senate got messier yesterday. Attorney General of the Federation (AGF) and Minister of Justice Mr. Abubakar Malami said the Senate lacked the power to summon him for questioning. The AGF, who was invited by the Senate to appear before its Committee on Judiciary, Human Rights and Legal Matters, said he was not answerable to the Senate. He said the Senate did not appoint him and, therefore, lacked the jurisdiction to summon him. The Senate fired back that it may be forced to issue a warrant of arrest against the AGF for his refusal to honour its invitation. The Special Assistant to the President on Prosecution attached to the Federal Ministry of Justice, Mr. Okoi Obono-Obla, who represented the AGF, was walked out of the meeting room. The altercation took place yesterday at the Senate Meeting Room 3 31.3, 3rd Floor, New Senate Building, National Assembly Complex, Abuja. The Senate had on Tuesday invited Malami to appear before it to explain why he charged to court Senate President Bukola Saraki and Deputy Senate President Ike Ekweremadu for alleged forgery. Saraki, Ekweremadu and two others were arraigned at a Federal High Court, Abuja on Monday to answer charges of alleged forgery of the 2015 Standing Rule of the Senate. The upper chamber resolved to invite Malami to explain why he allegedly reopened the alleged forgery case against Saraki and others when a court of competent jurisdiction had struck it out. The Senate that Justice Gabriel Kolawole of the Abuja High Court ruled on the matter affirming that the issue was an internal affair of the Senate. Before Obono-Obla was asked to leave the room, he told the committee members that they lacked the jurisdiction to summon the AGF because the Senate cannot be a judge in its case. He also insisted that the AGF, who was not appointed by the Senate, cannot be answerable to the Senate. Obono-Obla said the Senate was over reaching itself by creating the impression that the AGF committed a crime by charging Saraki and Ekweremadu to court. He noted that the Senate constituted itself into a court of law by summoning the AGF on an issue that was in court. He told reporters outside the meeting venue: “The AG has not done anything wrong. The AG has not undermined democracy. He acted pursuant to his powers vested on him by the Constitution, Section 174 (1) says he can prosecute anybody. And he has done that. The Senate is not on trial. He has not taken the Senate to court. He has taken four persons to court. They are not the Senate. Being President of the Senate does not make you the Senate of the Federal Republic of Nigeria. The matter was investigated by the police and a prima facie case was established and the AG invoked his powers under Section 174 (1) to initiate criminal proceedings against those persons. And this matter is now before a court of law. There is separation of powers in Nigeria. It is not the position of senators to constitute themselves into a court of law. “He’s (AGF) not answerable to them. By virtue of the principle of Separation of Powers, he is answerable to the President who appointed him. And he has not done anything wrong. “You cannot be a judge in your own case. We don’t have confidence in the committee.” Obono-Obla said he was qualified to represent the AGF because he is working in his office as an SA to the President. The chairman of the committee, Senator David Umaru, said the purpose of the meeting was to interact with the AGF based on Senate’s resolution. Senator Umaru, who was disappointed by the failure of the AGF to honour the committee’s invitation, said: “We take it that the AGF did not honour our invitation. This is despite the fact that he requested for time to articulate his own position. We take it that he has not respected the Senate. We will report back to the Senate to take appropriate decision on the issue. We take it that the AGF has refused to honour our invitation. The best we can do is to report back to the Senate.” Senator Joshua Lidani, a member of the committee, also said the AGF refused to honour the invitation. Lidani noted that the person who purported to represent the AGF is not the AGF the Senate invited. He added that the person was also not responsible to the AGF but to the President. Senator Chukwuka Utazi, another member of the committee, said: “The AGF asked that we should give him time to come. We put him on notice that he is to appear today (yesterday). The new militant group, Niger Delta Avengers, that has intensified attacks on the nation’s oil facilities in the Niger Delta region, said on Saturday that it would not kill or kidnap anybody. It also warned other militant groups in the region to desist from killing soldiers and oil workers as not to offend God in their mission to ‘liberate the people of the region.’ The group advised the public to be wary of suspected fraudsters who now parade themselves as representatives or spokespersons for the group. NDA, in a statement signed by its spokesman, Brig. Gen. Mudoch Agbinibo and emailed to our correspondent, urged the people “to be strong and resolute as it is obvious that God is on our side.” While condemning the recent killing of some soldiers and oil workers in Niger Delta, the group added that the heavy military presence in the region would not tempt it to kill in order not to derail from its agenda. It stated, “The avengers are calling on all groups in the region to be strong and resolute as it is obvious that God is on our side. “The high command of the avengers is calling on all not to attack any soldier and those claiming to have anti-aircraft missiles should desist from targeting any aircraft. Let us be careful not to offend God in the process of trying to liberate our people from the shackles of the Nigerian government because we need God more than anything now.’’ The statement also indicated that since the military warplanes hovering over towns and villages in the region had not destroyed any property or killed anybody, militants groups with ‘anti-aircraft missiles should dry their gunpowder.’ “When it is time to engage the military in a combat, the whole world will know they started the war and not the avengers,’’ the statement added. Meanwhile, at least one person was killed and many injured in renewed hostilities between Aladja and Ogbe-Ijoh communities in Delta State over a lingering boundary dispute. The dead person was said to be indigene of Aladja. While Aladja is a community in Udu Local Council Area, Ogbe-Ijoh is the headquarters of Warri South-West. Many residents, especially women and children, fled to neigbouring communities for safety. The Secretary, Ogbe-Ijoh Warri Governing Council, Aaron Oweizi-Ebiye, told journalists on Saturday that the incident was caused by youths from Aladja community who he accused of invading Ogbe-Ijoh community. Reacting, Chairman, Aladja Governing Council, Dogene Elias, faulted Oweizi-Ebiye’s claim, saying Ogbe-Ijoh youths started attacking the community on Wednesday. Last week, the state governor, Ifeanyi Okowa, inaugurated an eight-man panel of inquiry to find a solution to the lingering land dispute between the two communities. |

Herdsmen from different parts of Nigeria have stated that nobody can stop them from grazing their cattle in any part of the country, especially in the south. They described such restriction as unconstitutional. The nomads, who spoke to SUNDAY PUNCH under the auspices of the Miyetti Allah Cattle Breeders Association, dismissed the ultimatums given by different groups for the herdsmen to vacate the southern part of the country. This is despite the fact that groups, including foremost Yoruba farmers’ pressure group and ethnic militia, Agbekoya Farmers Association of Nigeria in the South-West; the Movement for the Actualisation of the Sovereign State of Biafra (South-East); the Independent Peoples of Biafra (South-East); and some ex-Niger Delta militants in the South-South, stated their readiness to defend their territories should herdsmen attack their communities again. Suspected Fulani herdsmen, who grazed their cattle from the northern part of the country to the southern part, had been accused of killing, raping and robbing members of their host communities. The Enugu incident, where several lives were lost, was the most recent. But the herdsmen, in separate interviews with our correspondents on Saturday, noted that it was wrong for people to restrict their movement as the constitution guaranteed their movement into any part of the country. The Chairman, Miyetti Allah Cattle Breeders Association, Plateau State, Mr. Nuru Abdullahi, said nobody could deprive Fulani herdsmen of their constitutional right of free movement. Abdullahi said, “Why would they ask them not to go to the southern part of the country? It is their constitutional right to move freely as guaranteed by the laws of the land. What the various governments and security agencies should do is to prevent attacks and counter-attacks and such things that breed violence like cattle rustling and trespassing into farmlands. “The Constitution of the Federal Republic of Nigeria guarantees freedom of movement for every citizen of the country; this includes the right to live, work and carry out any legitimate activity in any part of the country. If and when you breach this freedom, then, the law should deal with you. So, asking anybody not to go to any part of the country is unconstitutional.” Also, the Chairman, MCBAN, North-West Zone, Mr. Ardo Ahmadu Suleiman, warned against criminalising all Fulani herdsmen over the attacks. He said, “We are law abiding citizens of Nigeria. The constitution forbids anybody or group from banning anybody’s movement from one part of the country to another. We have been staying peacefully with tribes across the country for ages. Therefore, for anyone to say he wants to ban Fulani from entering their land is uncalled for.” However, several socio-cultural and militia groups in the southern part of the country on Saturday stated their readiness to reject the invasion of their communities by Fulani herdsmen. Agbekoya gave the Federal Government a 14-day ultimatum to stop the incessant attacks by suspected Fulani herdsmen on farmers in Yorubaland even as it vowed to retaliate any attack on its members. The position of the group was made known by its National Publicity Secretary, Mr. Olatunji Bandele, in a telephone interview with one of our correspondents on Saturday. According to Bandele, if the Federal Government fails to act decisively within the stipulated time, the Agbekoya will have to defend its people with whatever means at its disposal. Bandele said the association held an emergency meeting last Thursday where it discussed the incessant onslaught by Fulani herdsmen against Yoruba farmers, especially in the Oke Ogun area of Oyo State. He stated that if the situation was not brought under control, the group would “close down all markets in the South West; make sure that Fulani herdsmen do not enter any village in Yoruba land with their cows. And if they dare enter, they are doing it at their own risk. “We have alerted Agbekoya South West warriors across Yorubaland to be battle ready in case the Fulani herdsmen do not heed our warning because this thing has continued for the past four to five years now.” Bandele added, “We have other security measures that we are taking but keeping to ourselves. If the Fulani herdsmen failed to heed our warning and they dare enter Yorubaland, they will be doing so at their own risk. We are waiting for the Federal Government to take decisive action.” The deadline, he added, started to read from last Thursday. Asked if the group was now arming its members against the reported sophisticated fire arms of the suspected herdsmen, Bandele said, “We are not bothered with whether they carry arms or not, we will deal with the Fulani herdsmen hands down. We have done it before. The Agbekoya fought a 14-month war with the military. That was in 1968/69. We have instructed our warriors. Anywhere they kill farmers again, we will move in.” Asked what the association would do per chance any part of Yoruba land was attacked, he said, “We will retaliate.” The leader of MASSOB, Mr. Uchenna Madu, lamented that Igbo people had been “talking and talking” while they watched their people being killed. He stated that it was time for “action” to end killings by herdsmen. Madu said, “The Fulani herdsmen are cowards. After the recent attacks, they ran away. If they mean business, let them wait for Ndi’gbo and we will engage them man-to-man. “It will be demeaning to ask us if we have the capability to confront them.” IPOB, another Igbo secessionist group which dismissed security agencies as failing to secure the people, alleged that Boko Haram had been disguising as herdsmen to attack parts of the country. The Publicity Secretary of IPOB, Mr. Emma Powerful, stated that the group would not be at the forefront of reprisals against criminal herdsmen in the region but would encourage those under attack to defend and retaliate in self defence. He said, “The world is watching IPOB; the plan was for us to retaliate the attacks by Fulani herdsmen but we will not do so. Rather, we will ask those who are under attack to defend themselves or get killed. “The international rule is that you have the right to self defence if your life is under threat; security agencies know that. Face whatever or whoever is going to kill you or you die.” Another Yoruba group, Oodua Peoples Congress, said although the Yoruba were perceived as accommodating, the group would not sit by and pretend as if all was well. The National Coordinator of the OPC, Mr. Gani Adams, told one of our correspondents in a telephone interview that the attacks by Fulani herdsmen in the region had gone out of hand. Adams said, “Nowadays, it is becoming too rampant in the South-West. Now, nobody is provoking the Fulani herdsmen; they are the ones taking laws into their hands, killing and maiming innocent people in their (victims’) communities. “These Fulani herdsmen may even be Boko Haram in disguise. If government is looking at this as if they are an influential tribe or race in Nigeria and that they can’t tackle it, it may become a very serious security treat. “We the Yoruba think that we are highly accommodating and that if a stranger who is living in our community has committed an offence, the law should take its own course. But I know for sure that the South-East will not allow their people to be maimed.” The Chairman of MCBAN in Bauchi State, Abdullahi Abubakar, told SUNDAY PUNCH that the association was planning to hold an emergency executive meeting on Monday or Tuesday to discuss the issues affecting herdsmen. Meanwhile, the Christian Association of Nigeria and the National Association of Nigerian Students have called on President Muhammadu Buhari to come out boldly and tackle the problem. iam writing this to you for two reasons. One, as a
very passionate Nigerian who wants you to
succeed, because in your success is ours. Two, as
a professional who believes you definitely need
help at this point. And I am not playing any blame
game; you are probably already under immense
pressure, and blaming you can only aggravate the
situation.
I am writing about the situation in the land. I don’t
know how much time you have for news; whether
you read the papers or your aides simply extract
details from you. I don’t know if you watch TV, or
you are like President Olusegun Obasanjo who
curiously boasted that he didn’t read local
newspapers and wasn’t watching local television
stations. Sir, whatever may have been your stance,
the news out there is not very good.
Today, Nigerians are suffering in more ways than
you would believe. And I am not talking about the
endless queues for fuel that never arrives. There is
no electricity either. As I write this, we have
several homes and business facilities have all
manner of generators on using fuel that is hard to
get. Worse, the power companies have increased
tariffs even when we are not getting value, with the
promise that the additional income would help
them operate better. So we are funding their
investments when we are not stake or
shareholders.
Things are very expensive in the markets.
Companies are labouring to keep their plants open
because they cannot get enough forex for
packaging and raw materials. People are
complaining about too many things. I don’t even
want to talk about parents who are finding it hard
to get forex to fund their wards’ education outside
Nigeria; we have been repeatedly told it’s indulgent
to send children out for quality education. No one
is talking about the reason why this is happening,
that the overall quality of public education is down
and private schools cost as much as sending
children out.
Sir, I believe it’s time to speak to Nigerians as a
father and the President in a State of the Nation
Address. Usually we are told that silence is golden;
this is one time when it is not. You missed the
opportunity to say some critical things during your
inauguration. Many had hoped that instead of the
eleven minutes speech, it would be an opportunity
to form the basis for bonding with your people. At
that time, it would have been appropriate to let
Nigerians into the mess you inherited, far worse
than what you feared. It would have helped if you
told us that as a result of this, some election
promises might be slow in coming or might not
even come. General Ibrahim Babangida was a
master in this communication style. You were so
hugely popular then that Nigerians would have
understood and would have empathised, and would
have accepted your words.
Now the things you did not say are happening and
everyone understandably is upset with you because
let’s be honest, you and the All Progressives
Congress (APC) on which platform you came to
power over promised during the campaign. It was
understandable that after three unsuccessful
attempts, you were throwing in all to clinch the
ultimate prize. Still, some of the promises were
way above reality. The chicken has come home to
roost. People are asking for the Change you
promised us. And Sir, don’t be upset, for as long
as you promised, Nigerians have a right to demand
a performance. Unfortunately, the government
communication machinery has not rallied to cover
these areas and your flanks.
Mr. President, the effect is that we have this gap
between you and your people. They are wondering
if you are aware of their suffering. They are asking
for the Change they voted for. They are not getting
answers; instead they are getting plenty of excuses
and spin and propaganda, but not the genuine truth
they crave. And mind you Sir, they know things are
tough. They are literate enough to know our oil is
not selling. But they are not hearing it from you in
a way that suggests you care. And don’t let the
spin doctors deceive you, this is not about PDP
and APC; I have lately heard die-hard APC
stalwarts totally condemn your administration and
the party.
What to do?
It’s time to speak to Nigerians. I am not talking
about one of those interviews where the questions
might have been agreed before the interview
session. I am talking of direct one-to-all
communication, where you will address every
Nigerian. It’s time to let us know how we got to
this pass, the efforts you are making, the huge
challenges you inherited and have to manage, the
plans and work in progress, the good times that
are ahead, the hard and painful fact that Nigerians
once more must be prepared to sacrifice again at
this point.
Fortunately for you, Nigerians are not like our North
African brethren who will riot over a few cents
increase in the price of bread; Nigerians are patient
and stoic and don’t really demand too much.
Some of your ministers have not helped. Ibe
Kachikwu has forgotten he is no longer in Mobil;
he spoke with impatience to a people suffering
from the incompetence of his ministry. Lai
Muhammed? I do not want to say anything that
may upset His Imperial Majesty!
So Sir, choose a date you want, let the best of
your wordsmiths prepare a speech after discussing
with you. Open up to Nigerians. Give the necessary
assurances. Many smart leaders, especially the
Americans do this during periods of crisis; and
trust me we are in a period of crisis at this point. I
assure you Sir that your speech will calm many
frayed nerves and give hope to many who are so
despondent now.
We are praying for this government and your good
self. But we also owe it a responsibility as part of
our civic commitment to tell you things like this; it
is not unlikely that within the hallowed chambers of
the Villa, words like these are a taboo. Nigerians
want to hear you. Nigerians want to hear from you.

Day in day out Nigerians are crying because of hardship instead of our president to sit down and find out a solution he is busy touring the world. Am not saying that the travel is not important but what am saying is the travel is not the the priority now. how can a son whose mother is sick be cruising around town is that not insensitivity? the price of fuel is high, food items high,electricity supply low, naira useless etc yet the one we elected to solve this problems is busy trying to cover the countries of the world.
