KADUNA State Governor Mallam Nasir El-Rufai has stirred the hornet’s nest, with his warning that foreigners should not interfere in the conduct of the general elections. The Peoples Democratic Party (PDP) yesterday threatened to pull out of the peace accord it signed with other parties before the National Peace Committee (NPC) chaired by former Head of State Gen. Abdulsalami Abubakar. The opposition party hinged its decision on the “death threats” issued by the governor, according to it, to officials of the United States (U.S.), United Kingdom (U.K.) and the European Union (E.U.). But the Presidency dismissed it all as a storm in a tea cup. “There is nothing more to sneeze at”, it said. Besides, the governor denied calling for violence. Also yesterday, the EU Election Observer Mission (EOM) said its men were in Nigeria on the invitation of the Independent National Electoral Commission (INEC) and that they will remain in the country to monitor the elections billed for February 16 (presidential/National) and March 2 (governorship/state Assembly). Speaking on an NTA live programme El-Rufai was reported to have threatened the foreign nationals who might interfere with Nigeria’s upcoming elections with violent attacks. “Those that are calling for anyone to come and intervene in Nigeria, we are waiting for the person that would come and intervene, they would go back in body bags,” he was quoted as saying. The governor, however, explained himself yesterday, insisting that his comments were not in any way calls for violence, but a defence of Nigeria’s sovereignty. El-Rufai said he merely stood up for Nigeria’s dignity as against those who would traduce their country and reduce it to a colony in their vain quest for power. In a statement last night, the Presidency said: “The Federal Government under President Muhammadu Buhari would cooperate with election observers and would not let the international community down in the conduct of the coming elections. “The Presidency assures Nigerians and the international community that the President would do everything within his power to ensure free, fair and credible elections in the country. “We have taken note of the clarification to a reported earlier statement by the Governor of Kaduna State, Nasir El-Rufa’i concerning opposition call for foreign interference in our domestic affairs and to say that latest statement by him should rest the issue for good. There is nothing more to sneeze at. The Governor spoke strongly in defense of of national interest. It is clear that El-Rufa’i, our party the APC and all its candidates have reposed their faith in democracy through general elections. They are all of the view that there is no place for violence against local people or foreign citizens in our midst. “Opposition PDP ought to own up to the mistakes of their own policies for 16 years which have led the country to a sorry pass that has cost lives, jobs and growth instead of dwelling on diversionary issues.” The PDP’s threat was issued at a news conference in Abuja. Its spokesman Kola Ologbondiyan described El-Rufai’s comments as inimical to peaceful, free and fair elections. He said: “The PDP is left with no option than to consider a review of its signatory in the National Peace Accord, if no action is immediately taken to curb this trend.” But a pro-Buhari group, the Buhari Media Organisation (BMO), said neither the PDP nor its presidential candidate, was genuinely committed to any peace deal. According to the BMO, PDP’s presidential candidate signed the peace accord reluctantly. The main opposition party called on the international community to immediately impose a travel ban on El-Rufai for what it described as the inciting comments against peaceful elections. Ologbodiyan also called on the Gen. Abdulsalami to summon El-Rufai on the threat. He said: “The PDP holds that any situation that seeks to allow the APC to abuse the tenets of the accord will definitely force our party to review our signatory to the peace process. Read also: Lagos, Kwara, Kogi, others get new police chiefs “We therefore call on the NPC to immediately summon El-Rufai on his inflammatory remarks against peaceful election in our country. “In that regard, we might have no option left than to allow our members to defend their votes with whatever that is available to them. “This country belongs to all of us and no individual or group, no matter how highly placed, can subjugate other citizens, or seek to appropriate any sort of absolutism to himself.” The PDP also kicked against what it described as an alleged plot by the police authority to redeploy Kayode Egbetokun as Commissioner of Police to the Kwara State Command. The opposition party alleged closeness of Egbetokun to a section of the leadership of the governing All Progressives Congress (APC). This, according to the PDP, might lead to Egbetokun taking sides in the ongoing supremacy tussle between the PDP and the APC chapters in Kwara State. Ologbondiyan said: “This is in line with plans by the Buhari Presidency and the APC to effect a mass deployment of top security officers, particularly the police, to intimidate, harass and manhandle Nigerians that will not support the self-succession bid of President Muhammadu Buhari as well as aiding APC thugs to snatch ballot boxes and orchestrate violence in the elections. “Nigerians are aware of how CP Kayode Egbetokun was posted to Lagos State by the former Inspector-General of Police, Idris Ibrahim, to serve the same partisan interest and how that posting was stopped by the new IGP Adamu Mohammed. Now, he is being redeployed to Kwara State for the same ignoble plot. “It is necessary to state that the PDP is a party of peace and we are committed to the peace accord. However, the deployment of Kayode Egbetokun as Kwara CP directly negates the principle of the Peace Accord and can only hurt the fragile peace that currently exists in Kwara state. “We wish to remind the acting Inspector General, Adamu Mohammed, that his acceptability among Nigerians across party line was based on the pedigree, which was presented to Nigerians before his appointment. “These pedigree and exposure place on his shoulders, the responsibility to be just, firm, equitable and professional in the discharge of his duties. 1 9' FEATURED Onnoghen in fresh application says CCT chairman’s ‘integrity in doubt’ Published February 6, 2019 Olalekan Adetayo, Eniola Akinkuotu and Kamarudeen Ogundele, Abuja The suspended Chief Justice of Nigeria, Justice Walter Onnoghen, has filed an application before the Code of Conduct Tribunal demanding the disqualification of the CCT Chairman, Danladi Umar. Sunday PUNCH had exclusively reported that Onnoghen’s defence team would file an application seeking the disqualification of the CCT boss who has been indicted by the Economic and Financial Crimes Commission for alleged N10m bribery. The motion notice dated Monday, February 4, 2019 was brought pursuant to Rule 12(1) and (1A) of the Revised Code of Conduct for Judicial Officers of the Federal Republic of Nigeria, 2016 and under the inherent jurisdiction of the tribunal. The motion was signed by Chris Uche (SAN), Chief Sebastine Hon (SAN), Okon Efut (SAN), Chief Ogwu Onoja (SAN), Noah Abdul and George Ibrahim. Onnoghen is “seeking an order of this honourable tribunal for the honourable chairman of the tribunal, Honourable Danladi Umar, to disqualify/recuse himself from further participating in the adjudication of this case on the grounds of real likelihood of bias.” The defence said Umar had “constructively convicted the CJN sought to be arraigned before him without either hearing from him or his being formally arraigned.” The applicant noted that the CCT chairman directed President Muhammadu Buhari to suspend the CJN and appoint Justice Tanko Muhammad without recourse to the constitution or the National Judicial Council. Onnoghen noted that on January 23, 2019 the CCT boss entertained a motion ex parte which was not moved by any known prosecutor. The CJN said Umar had a pending case before the EFCC and was therefore subject to blackmail and threats from the executive arm of government which could impair his ability to be a fair arbiter. She noted that despite several orders issued by high courts and the National Industrial Court restraining the removal of Onnoghen, the CCT chairman decided to ignore everything and went ahead to grant an ex parte order. “The chairman authored and signed an ex parte order directing a man that had not been convicted to step aside on account of a charge not yet before him as the CJN which is itself a conviction prior to arraignment and plea or trial,” Ezedimma said. S’Court dismisses Senate suit challenging Onnoghen’s suspension Meanwhile, the Supreme Court has struck out the suit filed by the Senate, challenging President Muhammadu Buhari’s suspension of Onnoghen. When the case was mentioned on Tuesday, the counsel for the Senate, Paul Erokoro (SAN), referred the court to the notice of discontinuance he had filed on Monday marked: SC76/2019. Lawyer to President Buhari, Mrs Maimuna Lami-Shiro, who led Tijani Gazali, did not object to the plaintiff’s counsel. Lami-Shiro, however, said she was served a few minutes before the court began sitting. The letter read in part, “We have been reliably informed by our client that some men who appear to be herdsmen were at the farm on Friday afternoon and also later at night inquiring about the owner of the farm and issued frightening threats to the farmhands working there. “The workers are now living in fear and consequently have stopped all farming activities. The farm belonging to the family of the CJN is a large commercial venture wherein veritable investments in time, labour and financial resources have been committed. “We consider such a threat as an indication of imminent attack on the lives and property on the farm and we implore you, in the discharge of your constitutional duty as the number one police officer of the nation, to deploy your men to secure the farm.” Magu writes Buhari on Onnoghen, says investigation still ongoing Meanwhile, the acting Chairman of the Economic and Financial Crimes Commission, Ibrahim Magu, has written to President Muhammadu Buhari on the state of investigation being conducted by the commission on Onnoghen. Copies of the letter with reference number EFCC/EC/P/01 and dated January 30, 2019 were leaked to journalists on Tuesday evening by the first national spokesperson for the Coalition of United Political Parties, Imo Ugochinyere. The memo was titled, “Interim investigation report: Alleged case of bribery, corruption and money laundering.” Magu based the investigation on an intelligence report which he said alleged that Onnoghen was in possession of huge naira and foreign currencies that were far above his known legitimate source of income. He listed the various monies discovered in bank accounts linked to the suspended CJN. The EFCC boss noted that the investigation commenced before Onnoghen’s appointment as the CJN but could not continue after his appointment because of the commission’s inability to get his Assets Declaration Form from the Code of Conduct Bureau to enable it to conduct further investigation into his assets. Magu also said the inability of the EFCC to invite Onnoghen for interview to confront him on the findings also posed a challenge. As a public figure, he added that the commission did not want the investigation to be made public, so it did not invite other suspects who featured in his statement of account for questioning. Magu wants a special investigation team be set up to carry out further investigation into the matter. He wrote, “For speedy investigation, a special investigation team which will include lawyers and investigators will be constituted to specifically investigate allegations levelled against the suspect. The investigation is expected to be concluded within a short time frame. “There is need to get the Asset Declaration Form of the suspect from the Code of Conduct Bureau for further investigation and to determine his net worth. “Invitation of all individuals seen to have featured in his statements of account as having sent money to his account or received. “Invitation of other individuals who paid money into the suspect’s Standard Chartered Bank account for interview. “Determination of the source and mode of payments of the deposits into the SCB investment account held by the suspect with the aim of unraveling the individuals/entities that have given funds to the suspect over the years and expose his other sources of income.” Magu also wants to confirm Onnoghen’s investments in some firms among others. He however said preliminary findings showed that Onnoghen was in possession of money that was above his known legitimate means of livelihood.
