The appellate court dismissed the appeal filed by the Governor of Rivers State Siminalayi Fubara on grounds that it lacked merit.

The Court of Appeal in Abuja has affirmed the judgment of the Federal High Court which set aside the N800 billion budget passed by five members of the Rivers State House of Assembly led by the Edison Ehie-led group.

The court held that Governor Fubara withdrew his counter-affidavit at the lower court in the matter and as such cannot commence an appeal in a matter he didn’t challenge at the trial stage.

PoliticsRivers: How Wike Fell For A Political Trap. Gives Tinubu Reason To Sack Him by SenatorCharles1(op):
It has become increasingly evident that Chief Barr. E.N. Wike, the FCT Minister, may have fallen into a political trap that has now provided @PBATinubu with sufficient grounds to consider his immediate sack or redeployment as the current FCT Minister during Mr. President's much-expected FEC reshuffle.

The age-old quote attributed to Lord Acton, a British historian and moralist which states that "power corrupts, and absolute power corrupts absolutely" serves as a fitting description of Wike's character and actions.

Wike’s attempts to manipulate both the judiciary and security agencies, including the NPF, have only served to validate his critics and political rivals. Such actions undermine the principles of democracy and the rule of law, casting a shadow over his legacy. This blatant disregard for democratic processes reveals a desire to consolidate power at the expense of the people he is meant to serve.

In light of these developments, we urge @PBATinubu to take the necessary steps to address this situation by immediately relieving the FCT Minister of his position as FCT Minister or redeploy him from his current role.

It is crucial that we hold our leaders accountable to ensure that those in positions of authority act in the best interest of the public and uphold the tenets of democracy.

I don't know the full details of the case but I'm very sure the caliber of lawyers employed to institute this case by the APC will not embark on frivolous cases, for example, Joseph Daudu has been a SAN since the early 90s, just sit back and relax, and mind you INEC is not a ministry under Rivers state government that can be influenced to do a governors bidding.
So INEC is now a ministry under the FG abi? SANs do loss cases in Court, no be today...!!

How you people think that Fubara will defeat Tinubu and Wike amazes me. INEC conducted general elections in Rivers and in almost all states in the country in 2023. One year after, you are claiming INEC does not have updated register of voters in Rivers. Are you Ok?

Delta State and some few other state that just conducted their State's LG elections, please tell me, which register did they use?

Some few other states are planning theirs, who will provide the voters register for these state?

The FHC will only require INEC to answer one simple question and the case will be thrown out into the trash CAN that it belongs.

LGA Elections will hold in Rivers like every other state...!!!

PoliticsRe: Fate Of Rivers Caretaker Chairmen Dampened by SenatorCharles1: 6:09pm On Jul 11, 2024
Following today's Supreme Court ruling on Local Government financial autonomy, it simply do not translate in any way to mean nullification of already existing ad hoc LGA arrangement (CTC) rather it now behoves on those affected states to expedite the process of conducting local government elections.

The directive from the Supreme Court to the FG to withhold funds from states operating Caretaker Committee (CTC) chairmen underscores the recognition by the Supreme Court of the presence of CTC arrangements in certain states.

Moreover, as the leadership of various Local government currently using the CTC arrangement cannot afford to exist in vacuum, it becomes imperative for stakeholders of those affected states to ensure the smooth conduct of the Council elections moving forward

To all residents and political stakeholders in Rivers State

The Rivers State Government, under the leadership of his Excellency; Sir Similanaye Fubara, GSSRS is deeply committed to upholding peace, order, and the rule of law in our beloved state. It has come to our attention that there have been threats and potential actions aimed at causing unrest in various Local Government Areas (LGAs) due to the conclusion of the tenure of the outgone LGA chairmen.

As of June 17, 2024, the tenure of the outgone LGA chairmen officially ended. In light of this, the Executive Governor of Rivers State, Sir Siminalaya Fubara GSSRS, has issued a directive for the Head of LGAs to take over the affairs of their respective councils. This transition aims to ensure the smooth continuation of governance at the local level.

We hereby urge all residents and concerned parties to remain calm and refrain from taking the law into their own hands. Any form of unrest or destabilizing actions will not be tolerated. We specifically warn the outgone LGA chairmen and their supporters against engaging in any acts that may disrupt the peace and stability of Rivers State.

Let it be known that the Rivers State Government will not hesitate to enforce the full weight of the law against any individual or group found inciting violence or causing unrest.

PoliticsRe: Rivers Assembly: Pro-wike Lawmakers Know Fate Today by SenatorCharles1: 1:39pm On Jun 14, 2024
phantom:
The Court of Appeal, Port-Harcourt at a virtual hearing today via Zoom gave its Ruling on two Motions filed by Martins Amaewhule and the other defected lawmakers challenging the order of injunction granted by the Rivers State High Court restraining them from acting as lawmakers.

The Court in Ruling on the first Motion, granted the Appellants’ prayers for leave to compile and transmit the Records of Appeal, deeming the Appellants’ Brief of Argument as filed, accelerated hearing and a stay of further proceedings at the High Court.

The Court of Appeal however refused to grant the prayer for stay of execution and setting aside the interim order of the Lower Court as there is a presumption of correctness of an order of a Court. It held that granting same would be tantamount to determining the appeal at this stage. The Court went on to order that the present status quo should be maintained pending the hearing of the Appeal.

Ruling on the 2nd Motion which was brought to set aside the interlocutory injunction of the Lower Court, the Court of Appeal also refuse the prayer, and reiterated that the ‘present’ status quo should be maintained.

The Respondents are to filed their Briefs within 72 hours of being served. The case has been adjourned to 20/6/24 for Hearing of the Appeal.
This is the update
By this ruling of the COA, Rt. Hon. Oko Jumbo remains the Speaker. He can go ahead to screen CTC Chairmen for the LGAs in Rivers State
