Nnamdi Kanu’s case is being pursued under a law that no longer exists and Courts are required to operate within the bounds of valid laws. Charges cannot stand on a repealed statute. Given Nigeria’s history of disregarding court orders and the rule of law, it wouldn’t be surprising if the judge still proceeds with a conviction despite the glaring illegality. After all, even Awolowo was once convicted as a terrorist by the Nigerian government. So this isn’t unprecedented.. |
casualobserver: You are a funny guyThe "amended" seven-count charge filed by the Federal Government against Nnamdi Kanu on 11 November 2022 is incurably defective in law. By that date, the Terrorism (Prevention) (Amendment) Act, 2013, under which the charge was framed had already been repealed by Section 98 of the Terrorism (Prevention and Prohibition) Act, 2022, assented to on 13 May 2022 and gazetted on 16 May 2022. Once a statute is repealed, it ceases to have any legal force and no fresh proceedings may validly be initiated under it. The November 2022 charge cannot be regarded as a mere amendment. The previous charge had 15 counts, while the new filing has only 7.....this is clearly showing that it replaces the original charge .In substance and in form, it introduces new offences, making it a fresh charge rather than a continuation of any pending case. The saving or transitional provisions of the 2022 Act apply only to pending proceedings, not to new ones commenced after repeal like the federal government has done. Accordingly, prosecuting Nnamdi Kanu under a repealed statute offends Section 36(12) of the 1999 Constitution (as amended), which forbids conviction or trial for an offence not defined or punishable under a law in force at the material time. The entire proceeding is therefore a nullity, having been predicated on a law that no longer exists. In law, a charge cannot stand upon nothing; it must collapse. |

Why the prosecution of Nnamdi Kanu remains illegal is that count One and other charges against him are premised on the Terrorism (Prevention) (Amendment) Act, 2013, that law has since been repealed and replaced by the Terrorism (Prevention and Prohibition) Act, 2022. All the charges listed here are from the 2013 Act that no longer exists Under Nigerian constitutional and criminal law, no person can be tried for an offence under a law that no longer exists. Once a statute is repealed, it ceases to have effect and any fresh proceedings based upon it are null and void. |

BREAKING: Katsina United Fans Slit Player’s Throat For Equalising Goal In NPFL Match. The violence broke out moments after Barau’s Orji Kalu scored a 69th-minute equaliser to make the game 1-1, a development that appeared to infuriate some Katsina United supporters at the stadium. Tension erupted on Saturday during a Nigeria Premier Football League (NPFL) encounter between Katsina United and Barau Football Club, after a Barau’s player, Nana Abraham, was attacked and left with a deep cut on his neck by enraged fans of the home team. The violence broke out moments after Barau’s Orji Kalu scored a 69th-minute equaliser to make the game 1-1, a development that appeared to infuriate some Katsina United supporters at the stadium. Barau FC, confirming the attack in a post on its official X handle, wrote: “70’ The match is temporarily halted following an attack on Barau FC player, Nana Abraham.
