A former governor of Jigawa State, Alhaji Sule Lamido, and his two sons – Aminu Sule Lamido and Mustapha Sule Lamido, were on Tuesday arraigned before Justice Ademola Adeniyi of a Federal High Court in Abuja, on a 27-count amended charge bordering on corruption and money laundering.

Also arraigned with them by the Economic and Financial Crimes Commission were Aminu Wada Abubakar, Batholomew Darlington Agoha and companies through which they perpetrated the alleged fraud.

The companies are Bamaina Holdings Limited, Bamaina Company Nigeria Limited, Bamaina Aluminium Limited and Speeds International Limited.

Lamido and others accused had on July 9, 2015, been arraigned before Justice Evelyn Anyadike of a Federal High Court in Kano, over misappropriation of funds belonging to Jigawa State.

Their case was later transferred to the FHC, Abuja, where a vacation judge, Justice Gabriel Kolawole, granted them bail and adjourned the matter till September 22, 2015.

At the resumed hearing on Tuesday at the Abuja FHC, counsel for the EFCC, Chile Okoroma, presented the court with the amended charge, dated September 15, 2015, which added Agoha, Manager, Speeds International Limited, as one of the accused persons.

The case was, however, adjourned briefly to allow the registry assign a new charge number to the amended charge sheet, since the case was originally heard in Kano.

But when the charges were read to them, all the accused pleaded not guilty and the case was thereafter adjourned till October 21 and 22.

One of the charges read, “That you, Alhaji Sule Lamido (while being Governor of Jigawa State, Nigeria); Aminu Sule Lamido, Mustapha Sule Lamido, Bamaina Holdings Limited, Bamaina Company Nigeria Limited, and Speeds International Limited, between October 15 and December 18 2008 within the jurisdiction of this Honourable Court, did convert an aggregate sum of N124,649,915 paid by Dantata and Sawoe Construction Company Nigeria Limited into the account of Speeds International Limited.

Another charge read, “That you, Alhaji Sule Lamido (while being the governor of Jigawa State, Nigeria); Aminu Sule Lamido, Mustapha Sule Lamido, Bamaina Holdings Limited, Bamaina Company Nigeria Limited and Speeds International Limited between January 8 and December 10, 2013 within the jurisdiction of this Honourable Court took possession of an aggregate sum of N101,580,300 paid by Dantata and Sawoe Construction Company Nigeria Limited into the account of Bamaina Holdings Limited.”

OWERRI—Angry reactions have started trailing the planned borrowing of a staggering N20 billion by Governor Rochas Okorocha, to allegedly complete on-going projects in the state.

Some of the respondents were particularly irked that the state is currently owing over N60 billion ,including the Federal Government’s N26 billion bailout fund, which is expected to be paid back in 20 years.

“It is sad that most people have sadly geared their minds only towards the bailout funds released by the Federal Government. Nobody recollects that apart from the bailout fund, the monthly federal allocations still flow into the state without getting a mention”, a senior civil servant, who pleaded anonymity, said.

A pensioner, Chief Samuel Ohiri, lamented that pensioners and members of their families have continued to languish in poverty, hunger and disease, despite the bailout fund.

“Our pensions and gratuities have remained largely ignored by the present administration despite the bailout fund. The state government sadly does not take the plight of pensioners with the seriousness that it deserves”, Chief Ohiri lamented.

While wondering why the governor should start sourcing for another N20 billion, the aggrieved pensioner reasoned that it would been more sensible to first, account for the bailout fund.

The trial tribunal, headed by Justice Danladi Umar, called up Saraki’s case at exactly 10:32am.
However Saraki’s has been docked and pleaded not guilty to the first, second and third charges as at the time Vanguard filed this reports.refusal to stand up as his case was mentioned, the tribunal Chairman, Justice Umar, demanded that he should leave his seat and enter inside the dock.

A former Minister of Aviation, Chief Femi Fani-Kayode, has asked the Federal Government to do everything possible to effect the release of Chief Olu Falae from his abductors.

He said the government would be held responsible if anything happens to the former secretary to the government of the federation.

Fani-Kayode stated this in a statement he issued in Abuja on Monday evening.

He described the abduction as unacceptable and dangerous.

The former presidential aide said, “The abduction of Chief Olu Falae is not only unacceptable but it also an exceptionally dangerous development.

“I say this because he is not only an elder-statesman of our country, but he is also one of the most revered leaders of Afenifere and the South-West.

“We cannot sit by idly and watch our leaders and elders being endangered, shamed and humiliated in this way. It is the governments job to keep us all safe and secure and they are failing in that duty.

“I call on the President and our security agencies to effect the expeditious and immediate release of Chief Olu Falae. They must rescue him from these vagabonds and vandals as soon as possible before things get out of hand. Let it be clearly understood that if anything happens to him and if he doesn’t come home hale and hearty we will hold the Federal Government responsible and there will be consequences.

“Those that are in power would do well to take what I have said very seriously.”

Since Tuesday last week the media space has been filled with it issues that borders on the 13 count charge which include alleged false declaration of assets and corruption against Senate President Bukola Saraki by the Code of Conduct Bureau. As most of us are aware, the event took a new shape when the Code of Conduct Tribunal (CCT), headed by Justice Danladi Umar, had, in his ruling on Friday, ordered the IGP and other security agencies to arrest Saraki and produce him before it tomorrow (Monday) upon request by the federal government. This order and subsequent bench warrant followed Saraki’s failure to appear before the tribunal for arraignment. The time has come for Bukola Saraki to choose between the path of honor and that of dishonor.

The Path of Honor:
For a senate president or any top official of the State to be enmeshed in such controversy, the honourable path is simply to voluntarily resign from his high office and respond to the charge against him. Should Bukola Saraki do this, it will send a message that he is not absolutely morally bankrupt. He will not be the first parliamentary leader to tow this path. In July 1999, the Speaker of House of Representative Hon Salisu Buhari resigned after allegation of academic falsification. On 8th August 2000, Deputy Senate President Haruna Abubakar and Majority leader Samaila Mamman resigned their positions on allegation of fraud and corruption levelled against them. In April 2005, Senate President Adolphus Wabara stood down from his position to face allegation of receiving N50m bribe(along with 7 other legislators) from the disgraced Education Minister Fabian Osuji. On October 30, 2007, House of Representative Speaker Hon Patricia Etteh and her Deputy Babangida Nguroje resigned from their positions over allegation of inflating contract. Saraki has the option of emulating his parliamentary predecessors and save some part of his integrity.

The Path of Dishonour:
If the Senate President insists on ignoring the noble path (above), then he's only threading on a path of dishonor. If he chooses this path, he will not be the first top parliamentarian to do so. In August 2000, former Senate President Chuba Okadigbo was impeached over allegations of fraud after ignoring calls for resignation. He tried using every available means to escape and hold his position to no avail. His predecessor in office Chief Evans Ewerem was equally impeached in November 1999 for age and academic falsification. This is a disgraceful path. It will be more disgraceful should Saraki be facing trial as incumbent Senate President.

The Immaterial Excuses:
The excuse that the allegations against Senator Bukola Saraki was an offence that he allegedly committed in May 2003 is not only immaterial but also intellectually insane. As the Executive Governor of Kwara state between May 29, 2003 and May 29, 2011, Bukola Saraki enjoyed immunity as enshrined in the 1999 Constitution of Nigeria. Saraki lost that immunity on May 29, 2011 after vacating the seat as the Kwara number one man. That the CCB decided to institute his prosecution four years after losing immunity is highly commendable. Moreso, crime have no expiry date as long as it hasn't been cleared by a court. The argument that it was a 2003 case hold no water.

Some other of his supporters alleged witch-hunt by some power blocs within his party. This allegation whether true or false is also immaterial and is an insult to the sensibilities of Nigerians. This has always been the excuse of politicians and prominent people whenever their sins found them out.

Let us recall that in 2005, then Governor of Bayelsa state Alamesiegha was asked to resign and was subsequently impeached after he was indicted for money laundering in the UK. He blamed his political differences with President Obasanjo as the cause of his travails. When James Onanefe Ibori was declared wanted by the EFCC in April 17, 2010 over allegation of corruption, he accused EFCC of flouting due process and blamed his travails on Acting President Goodluck Jonathan whom he accused of witch-hunting him. He eventually fled the country to UAE, was arrested there and extradited to the UK, where he's serving jail term. Disgraced exGovornor of Adamawa state Murtala Nyako blamed political motivation behind his travails instead of responding to the corruption allegations levelled against him. When ex-Governor Sule Lamido's sons were convicted in 2013, he blamed it on his differences with exPresident Jonathan. He has also blamed his ongoing corruption trials on political witch-hunt by the APC. Ex-Governor of Rivers state Rotimi Amaechi is blaming political witch-hunt instead of submitting himself to Rivers state government probe and responding to corruption allegations against him. The case is not different from Raji Fashola who is blaming political differences instead of responding to the issues of OVER inflated contract during his administration. Olabode George that was convicted on allegation of contract splitting also blamed his political differences with Bola Tinubu. If you ask the disgraced exIGP Tafa Balogun, he will tell you that his travails was 'politically motivated'. Stella Odua and Buruji Kashamu are also alleging the same thing, "politically motivated".

Lai and Metuh Should Respect Themselves
It is embarrassing that Chief Olisa Metuh and Alhaji Lai Muhammed are trying to play to the gallery. Just yesterday, Metuh re-echoed the 'political motivated' song, while Lai Muhammed attempted to score point through hypocrisy. While Metuh should be reminded that his sermon that Saraki is being witch-hunted is lame, Lai Muhammed and the ENTIRE APC should be reminded that they were active backers of corruption during PDP administration. For instance, in July 2014, the APC Chairman John Oyegun held a press conference to lament the impeachment of Murtala Nyako. In his words...


Earlier before Oyegun made that statement, APC Governors through Rabiu Kwankwaso also tried to shield corruption by accusing PDP/GEJ of 'witch-hunting' Nyako and pledged support to him www.leadership.ng/news/377523/apc-govs-solidly-behind-nyako-kwankwaso.

Earlier in the administration, the government withdrew the corruption charges against Timpre Sylva of APC. The APC governorship candidate in Kogi state, Pa Abubakar Audu is also standing trial for corruption. It is advisable that both parties stop playing politics with everything. The law MUST take its course.

Finally, Nigerians of good conscience are enjoined to support constitutional process against corruption for a better country. As for Bukola Saraki, he has the choice to decide between the path to take; will it be that of Honour or that of Dishonor?

A coalition of civil society organisations under the aegis of Heritage Centre and the National Association of Nigerian Students have threatened to lead mass protests to foreign embassies in Abuja to protest alleged political vendetta against Senate President, Dr. Bukola Saraki, but gave no date for it.

They were reacting to the order of Saraki’s arrest by Code of Conduct Tribunal over alleged falsification in his assets declaration.

The Director-General of HC, Dr. Katch Ononuju and NANS President, Tijani Usman, who issued the threat during a press briefing on Saturday evening in Abuja, said it was a witch-hunt against the Senate President by what he described as political ‘cabals,’ who should be put under checks by the Federal Government.

Ononuju said, “The President makes appointments and does not refer them to the Senate for confirmation because he does not like the leadership there. Our democracy is under threat and that is why we are talking to Nigerians. ‎Since President Muhammadu Buhari took over, everything is going down. We are calling on the Chief Justice of Nigeria to protect the integrity of the courts by ensuring that injunctions are respected. We are to march to every embassy to tell them that our democracy is under threat.

“The President lacks the political will to fight corruption. We are very worried with the ‎turn out of things. The action by the Senate to appoint its own leadership is the reason behind this witch-hunt. Accidents have been arranged for senators who supported Saraki.

“The DSS has been used to trail senators. The current CCB should not exist. The current leadership came into office in 2010 and their tenure ought to have elapsed in April 2015. The power that seeks to undermine our democracy and the Senate is gaining the upper hand. I sincerely want corruption to be fought headlong, but we do not want a return to the days of Olusegun Obasanjo, where arrests where targeted.”

The Senate President, Senator Bukola Saraki, has filed an appeal challenging the ruling of the Code of Conduct Tribunal which ordered the Inspector-General of Police, Mr Solomon Arase, to arrest and produce him before the tribunal on Monday, September 21.
In his ground of appeal, Senator Saraki through his counsel, Joseph Daudu, submitted that the tribunal erred in law and also acted without jurisdiction‎ by assuming jurisdiction over the criminal trial of the appellant at the Code of Conduct Tribunal for a charge which is being challenged at the Federal High Court.

Senator Saraki, in his appeal, stated that as at the time the tribunal overruled the appellant’s application to discharge the order for bench warrant for his arrest by the respondent, there was an order of the Federal High Court which was served on the tribunal.

He further submitted that the appellant filed an application‎ dated September 17, challenging the jurisdiction of the tribunal to adjudicate on the charge brought before it.

The Senate President also submitted that it was trite that when an accused files an application challenging the jurisdiction of a court/tribunal to adjudicate on a charge brought before it, the accused need not be in court.

The appellant therefore asked the Court of Appeal to set aside the order of the Code of Conduct Tribunal.

The Code of Conduct Tribunal had earlier ordered the arrest of the Senate President for failing to appear before the Tribunal to answer charges of alleged false declaration while he served as Governor of Kwara State between 2003 and 2007.

Delivering a ruling on the suit filed by the Code of Conduct Bureau, Chairman of the Tribunal, Justice Danladi Umar ordered the Inspector-General of Police to produce the Senate President on Monday, September 21, which is the next adjourned date.

The Tribunal held that no court of coordinate jurisdiction can restrain the Tribunal from performing its constitutional duties.

On what ground should amechi and fashola be prosecuted, Tinubu faced this same tribunal, some of these accusations about fashola and amechi lack merits, regardless of Apc against him being the Senate President, don't you think if Saraki is clean he would have faced the Tribunal. If I was him I will face them, the case might be adjourned and that will give me the room to do some underground work. Think about that.

ABUJA – The Federal Ministry of Justice has asked the Code of Conduct Tribunal, CCT, sitting in Abuja to issue bench warrant for the arrest of the Senate President, Dr. Bukola Saraki.
A deputy director in the office of the Attorney General of the Federation, Mr. M.S. Hassan, applied for the arrest order following Saraki’s refusal to appear before the tribunal to enter his plea to the13- count corruption charge against him.
‎Saraki who was billed for arraignment this morning, sent his team of lawyers to serve the tribunal with a copy of the ruling of Justice Ahmed Mohammed of the Abuja Division of the Federal High Court, yesterday, which summoned the Ministry of Justice to appear on Monday to show cause why the trial should be allowed to proceed.
Equally summoned by the court were the Chairman of the tribunal, Justice Danladi Umar and that of the Code of Conduct Bureau, CCB, Mr. Sam Saba, as well as Mr. Hassan who signed the charge against Saraki.
Meanwhile, irked by Saraki’s absence at the tribunal for the commencement of his prosecution over alleged false declaration of assets, the Ministry of Justice prayed the Justice Umar-led panel to order for his arrest, saying “he cannot sit in the comfort of his chamber and object to his trial in absentia”.
The prosecution further maintained that Justice Mohammed lacked the powers to summon ‎the CCT and CCB chairmen, even as it accused Saraki of engaging in “forum shopping” in a desperate bid to scuttle his trial.

Senate President Bukola Saraki failed yesterday to stop his arraignment today before the Code of Conduct Tribunal (CCT) in Abuja

A Federal High Court in Abuja refused his prayer for an ex-parte order restraining the CCT, the Code of Conduct Bureau (CCB) and the Office of the Attorney General of the Federation (AGF) from proceeding with his planned arraignment on a 13-count charge brought against him by the Office of the AGF.

Justice Ahmed Mohammed, who heard Saraki’s lawyer, Mahmud Magaji (SAN), in relation to the ex-parte motion in chambers, directed that the respondents be put on notice.

The judge directed the respondents to appear before the court on Monday to show cause why Saraki’s prayers, as contained in his ex-parte motion, should not be granted.

The Judge ordered that the respondents be served with all the court processes, including the motion of notice for interim order or injunction, motion ex-parte and a hearing notice.

The office of the AGF had filed the charge dated September 11 against Saraki before the CCT, accusing him of committing, among others,  offences ranging from anticipatory declaration of assets to making false declaration of assets in forms he filed before the Code of Conduct Bureau while he was governor of Kwara State.

Saraki is accused of failing to declare some assets he acquired while in office as governor; acquiring assets beyond his legitimate earnings and operating foreign accounts while being a public officer – governor and senator.

The Senate President is, in the charge endorsed by a Deputy Director at the FMJ, Muslim Hassan, said to have, by the offences, breached Section 2 of the Code of Conduct Bureau and Tribunal Act.

The CCT, on Wednesday, fixed today for Saraki’s arraignment. But, in an effort to prevent the CCT from proceeding with its business, Saraki raced to the Federal High Court, Abuja with the ex-parte application.



Saraki urged the court to restrain  the Federal Ministry of Justice, CCB, CCT and Mr. Hassan, who signed the charge, from taking any further step to arraign or prefer any charge against him, pending the hearing and determination of the suit he filed along with the ex-parte motion.
He is, in the substantive suit,  praying the court to declare that the ministry has not complied with the provision of the 3rd Schedule of Section 24(1) of the Code of Conduct Bureau and Tribunal Act to act before proffering a charge against him.

He contends  that based on the provision of Section 24 of the CCB and Tribunal Act, it is the AGF or any officer directed by him (AGF) that must initiate charges against him (Saraki).

Saraki contends that “in the absence of any substantive AGF in the time being, this court has the jurisdiction to direct parties to maintain status quo, pending the hearing of the motion on notice”.

He argued  that since there is no subsisting AGF, the charge against him by the official of the AGF before the CCT is void as the provisions of Section 24 (1) of the CCB and tribunal.
