The President of the Nigeria Bar Association, NBA, and the Chief Justice of Nigeria, CJN, have both taken a swipe at the Presidency, the All Progressives Congress, APC, and the Economic and Financial Crimes Commission, EFCC, over their recent attacks on the judiciary.

The CJN, Justice Mahmud Mohammed, and the NBA President, Augustine Alegeh, SAN, on Wednesday, February 10, during the valedictory court session held in honour of a retiring Justice of the Apex Court, Muhammad Muntaka-Coomassie, in Abuja refuted claims of “corruption” and “bias” against the Judiciary.

Recently, judgments of the Supreme Court on the dispute over the 2015 governorship elections in States such as: Rivers, Akwa Ibom, Abia, Delta, and Ebonyi, have drawn criticism against the judiciary, with many labeling the apex court’s decisions as a product of corruption.

Following the decision of the Apex Court to uphold the election of the Rivers state Governor, Nyesom Wike, the APC candidate in the state, Dakuku Peterside, has alleged that the court’s decision was procured.

He maintained that the Apex Court’s judgment that affirmed the election of Wike, the candidate of the Peoples Democratic Party, PDP, was contrived to legalize electoral violence and rigging.

Recently, Buhari had taken a swipe at the integrity of the judiciary and its ability to dispense justice in cases of corruption, without compromise. Adding that the temple of justice was his major “headache.’’

The EFCC Chairman, Ibrahim Magu, was not left out, as he has also passed a damning verdict on members of the judiciary.

Magu made this allegation during a forum on Wednesday, February 10, as he accused prominent lawyers of frustrating the ongoing war against corruption in the country.

The Nigerian Senate has accused President Muhammmadu Buhari’s aide of wasting N48 billion of tax payers money since he resumed office in July, 2015. The Senate committee on Niger Delta exposed that he has already spent N157.2m on armoured cars. This is an exclusive report by ThisDay newspapers.

Ahead of the Senate Committee on Niger Delta’s consideration of the 2015 Status Report of the Presidential Amnesty Programme at the Senate today, Nigerian senators have indicated their disapproval of the over N48 billion purportedly spent by the President Muhammadu Buhari’s coordinator of the programme, Brig-Gen. Paul Boro (rtd), since he assumed office last July.
The senators, who preferred not to be named, were particularly concerned over Boro’s purchase of official vehicles for his office for over N157 million as well as the huge sums of money purported to have been expended on the training of ex-militants between November and December last year.
The expenditure, which according to the senators, was listed in the annual status report of the Amnesty Office sent to the Senate Committees on Niger Delta and Public Procurement, have made nonsense of the federal government’s efforts at belt tightening measures, arising from the nation’s dwindling earnings from crude oil.
The annual report, which the two Senate committees would review along with the office’s 2016 budget today, said the senators, indicated that Boro who took over from Hon. Kingsley Kuku as Presidential Adviser on the Amnesty Programme under the current administration, in just five months awarded contracts worth about N48 billion.
Describing most of the contracts awarded by Boro as “mostly nebulous or frivolous”, the senators were particularly irked that at a time Buhari had castigated the National Assembly for its proposal to buy official cars for senators and members of the House of Representatives, the Amnesty Office coordinator, who is just an appointee of the president, had since acquired as his official car, an armoured Lexus LX 570 Sport Utility Vehicle (SUV) with communications equipment for VIP movement.
The exotic official car was acquired from Wada Autos Limited at the princely sum of N55 million and full payment has since been made by the Amnesty Office.
“The president claims to be fighting corruption while his aides are already swimming in corruption. Can you imagine a Special Adviser using a bullet proof Lexus car worth N55 million as an official car at a time the president is trying to stop us from buying our own official cars worth about N5 million each? So what happened to the monetisation policy of the federal government?” queried an irate senator, who is a member of the Senate Committee on Niger Delta.
The report before the two Senate committees and sighted by ThisDay also indicated that Boro had further acquired for his office from Globe Motors Limited, the following cars: one Toyota Land Cruiser VX V8 at the cost of N25.85 million; four Toyota Camry 3.5L V6 cars and four Toyota Hilux 4WD buses at the total sum of N75.35 million. Globe Motors has since been paid fully the sum.
Some of the senators complained that a thorough analysis of contract documents attached to the report showed that at a time Nigeria is experiencing perhaps its worst economic downturn in recent times, Buhari’s adviser on the Niger Delta Amnesty Programme appears only concerned about awarding “frivolous” contracts.

“We expected him to restructure the budget he inherited from his predecessor at the Amnesty Office to fit into current economic realities and in line with the anti-corruption crusade of President Buhari. Unfortunately Boro is just spending recklessly,” lamented another senator who did not want to be named.
Credible sources at the Amnesty Office, however, confided in ThisDay that Boro began the contract awards in November 2015 apparently to beat the December 31 deadline for the return of unspent monies to the treasury, as stipulated by the extant financial regulations in Nigeria.
The nation’s financial regulations stipulate that unspent appropriated funds be returned to the treasury after December 31 every year. However, the federal government made exemptions for the funding of capital projects to continue till March 2016.
Latching on to the need to “empower” already trained Niger Delta ex-agitators, ThisDay sources claimed that some of the contracts did not follow established guidelines for awards.
A source said: “In several instances, the same contractors used by the former administration of Kingsley Kuku, who already had due clearance from the Bureau of Public Procurement (BPP) were rushed in to handle the so-called empowerment contracts.”
According to an angry senator, the contract awards occurred in spite of the fact that several of the Amnesty Programme’s trainees in universities abroad were either stranded or had been repatriated due to their inability to meet with their financial obligations to their schools.
The senator said his investigations had revealed that under the guise that there was no money to pay the ex-militants’ tuition and in-training allowances, Boro had ordered the students in universities in the UK, United States of America, Canada, United Arab Emirates, Russia, the Philippines, Belarus and elsewhere abroad, to return to Nigeria.
“Several of them have since returned and are on the verge of being placed in Nigerian universities to continue their education. The Amnesty Office cannot afford to deploy or maintain delegates offshore anymore,” he quoted a senior official of the Education Department of the Amnesty Office as saying.
The senator said officials of the Amnesty Office told him that N510 million was paid to an institution, Westerfield Colleges, to prepare 150 students for the Unified Tertiary Matriculation Examination (UTME).
This transaction, according to him, stipulated that over a period spanning just two months, Westerfield Colleges would prepare the students for the UTME organised by JAMB at a cost of N3.4 million per delegate.
“The same Boro who has been telling Nigerians that the Amnesty Office does not have money to fund the education of students abroad is the one awarding a contract worth N510 million to an institution to organise JAMB classes for fresh students. This is really very silly and embarrassing,” he said.
Even more curious, he claimed, was the fact that the payment of the N510 million by the Amnesty Office was not treated as a contract, hence no award letter was issued to Westerfield.
Rather, the senator further claimed, Boro in glaring breach of the Procurement Act and other extant financial regulations of the federal government, ordered that the payment to Westerfield be passed off as a direct payment to a school and students.
Efforts to reach Boro and his media consultant, Mr. Owei Lakemfa, failed, as neither of them responded to calls to their mobile phones. A text sent to Lakemfa’s phone was also not replied.

The EFCC has blamed the media as being responsible for deliberately distorting proceedings in the court in the case of PDP PDP National Publicity Secretary, Olisa Metuh.

Counsel to Chief Olisa Metuh, at the resumed hearing of the case instituted against the EFCC on the enforcement of his fundamental human rights, informed the court that the spokesman of the EFCC, Wilson Uwajaren was misrepresenting the proceedings of the court to the public,


“Uwajaten was not here during the proceedings. Half truth is lie and we should not justify what is unjustifiable.

“It is your Lordship that is trying us, not the EFCC, not the EFCC, not the press and not the public.

“I wish to appeal to through this court to the EFCC, that it essence as an institution created through the instrument is not to fight political war.

“May I therefore plead through my Lord to the defence (EFCC) to first of all recognize that as a statutory body created by an Act of the National Assembly, it is meant to serve the interest of the public at large,” said Adedipe, SAN.

Responding, C.O. Ugwu, the counsel to the EFCC said the journalists were in court on their own volition to report the proceedings, while trying to absolve the spokesperson of the commission.

He however remind the court that the media has the penchant for misrepresentation.

“I know the press, they have the penchant for sensationalism. This is the problem we have in this country, they will hear what happen, go home and misinterpret it”

The EFCC however defended the purported statement issued by Uwajaren saying that it was The true statement of the the PW 8 (an EFCC witness) .

In a short decision of the court, the trial judge declined to assume jurisdiction on the issue stating that this is a civil matter.

The court however said that the counsel to Olisa could raise the matter when the criminal aspect of the case comes up for hearing,.

This case is the continuation of hearing of the matter instituted by Olisa Metuh on the enforcement of his fundamental human rights against arbitrary detention by the EFCC.

The immediate past Chief of Defence Staff (CDS), Air Chief Marshal Alex Badeh has been detained by the Economic and Financial Crimes Commission (EFCC) after about eight-hour interrogation over his role in the $2.1 billion arms purchase scandal.

Air Chief Marshal Badeh’s interrogation began at about 9am when he was ushered into a session with a panel at the Abuja office of the anti-graft agency. Till the time of filing this report, 11.0opm, there was no sign that Badeh had been freed.

It was gathered that other top military officials were also being quizzed.


Those detained already include ex-National Security Adviser (NSA) Col. Sambo Dasuki (retd); Col. N. Ashinze , who was the Special Military Assistant to the ex-NSA; and a former Chief of Air Staff, A.N. Amosu.

It was gathered that the EFCC had confronted Badeh with some documents, including letters to the ex-NSA, Col. Sambo Dasuki (retd), demanding the procurement of some military equipment.

Emir of Kano, and the immediate past governor of the Central Bank (CBN), Muhammad Sanusi II has said that President Muhammadu Buhari’s anti-corruption stance was “totally inconsistent” following his approval on the CBN’s foreign exchange policy.

Sanusi stated that the policy would encourage corruption. He commended Buhari’s removal of “wasteful and corrupt fuel subsidies” adding that the current forex policy endorsed by the president encourages similar rent seeking and corruption which trailed the subsidy regime.

“He (Buhari) has put an end to the [crude] swap regime which is also one side of rent-seeking and corruption . . . he has made the NNPC start producing accounts, so there is greater transparency.

“These measures are good for the economy and display strong political will to change the system. But getting monetary and fiscal policies right will be crucial for broader progress in structural reform”, Sanusi told Financial Times.

He further stated that: “Unfortunately, because the exchange rate is right out there in front now, monetary policy is being seen as the barometer for broader economic thinking. It is sad that on this one policy you get it so wrong that you risk taking away attention from everything else you are doing.”

The CBN policy excludes some imported goods and services from the list of items valid for forex in the Nigerian Foreign Exchange Market. The policy restricts importation of items.

Rivers State Governor, Nyesom Wike on Sunday said that many people would have died if the Supreme Court had nullified his victory at the State’s governorship election.

According to Wike while speaking during a thanksgiving service to celebrate his victory, the Supreme Court prevented bloodshed in the State.

“Blood would have flown if the election was going to hold again. So, I called some people, including the chairman of the PDP, Uche Secondus, that I was not going to run again. They said why and I explained that if I did, many people would die.

“I pray that my enemy should continue to have permanent high blood pressure. I wouldn’t pray that God will heal them. My own has come down now, and for several months it was high. It is time for their own to rise”, he said.

Wike further affirmed that he was not in support of President Muhammadu Buhari anti-corruption crusade. He explained that he would rather fight corruption his own way than support Buhari’s anti-corruption war.

He stressed that Buhari’s anti-corruption war was selective and targeted at members of the Peoples Democratic Party (PDP).

He said: “We would not support the fight against corruption. People took our money from the state, and we wrote to the police asking them to go and make a statement; nothing has come out of it.

“We won’t take anybody to the EFCC because I know what would happen. We know how to fight our own way. We won’t support that war against corruption that they are doing”.

In a bid to forestall his arrest and detention, Dr Kennedy Izuagbe, the managing director of Carlisle Properties Investment Limited, owned by Senate President Bukola Saraki, has dragged the Economic and Financial Crimes Commission (EFCC) before a Federal high court in Lagos, south west NigeriaJoined as co-defendants in the ensuing legal battle are Director of Operations of EFCC, Olaolu Adegbite and the Attorney General of the Federation, Abubakar Malami.

Izuagbe, in a statement in support of the application to enforce his fundamental right filed before the court by Mahmud Magaji SAN, stated that he was first invited by EFCC on the 13th of November 2014 and after series of interrogations he did not hear from EFCC until 29th of April 2015 when he was again invited.

EFCC requested for some documents including the one relating to how the Senate President, Dr Olusola Saraki purchased his landed properties that Carlisle Property and Investment Limited, manages but he told them that the landed properties and information relating thereto can only be properly addressed by Dr Saraki himself.

Izuagbe stated that he was surprised to read on pages of newspapers how EFCC has been manipulating media perception to the effect that the portfolio of his company could have been derived from the public service proceed of its beneficial owners.

On 26th of August 2015, while he was in the United States on holiday, he was informed that EFCC came to the headquarters of his company with a lorry load of policemen and ransacked their offices and carted away several documents.

Consequently ,based on the foregoing,he is approaching the court for an order directing the EFCC from further intimidating and harassing him and the company’s law abiding staff.

A counter affidavit sworn to by EFCC legal officer, Israel Akande and filed before the court by Barrister K M A Olusesi,denied almost all the averments in Dr Izuagbe’s suit.

Akande declared in the counter-statement that the commission is investigating a case of money laundering involving Dr Olusola Saraki where it discovered several lodgements of cash and monetary instruments by companies linked to Dr Bukola Saraki and regular cash inflows into his personal account by his aides and other yet to be identified persons totaling N15billion and another S13 million.

Mr Akande averred further that the situation peaked on 26th October,2009 when 88 different persons paid sums into Dr Bukola Saraki’s account on the same day totaling N80million and investigation commenced to unravel the sources of the fund.

In the course of investigation, it was discovered that Dr Kennedy Izuagbe was the managing Director of Carlisle Properties and Investment,company that received funds from several individuals and over 150 companies which funds were moved to Dr Bukola Saraki’s accounts and that,DrKennedy Izuagbe acting on behalf of his principal ,Dr Bukola Saraki directed that the inflows into the company account be wired offshore to the beneficial owners.

Based on the investigation being conducted and considering the weighty allegations levelled against Dr Izuagbe ,he was invited by the anti-graft agency with a view to obtaining his reaction to the allegations. He made voluntary statement and was asked him to report back.

However during the course of investigation he broke the news of his mother’s death and was allowed to go on compasssionate grounds.

Thereafter he went incommunicado and all efforts to get him proved abortive as his phone was no longer through hence hampering the course of investigation.

When all effort to reach him proved abortive ,warrant of arrest was secured for his arrest.

Consequently ,Mr Akande averred that EFCC is statutorily empowered to cause investigation to be conducted as to whether any person, corporate body or organisation has committed any economic or financial crimes. Therefore ,restraining EFCC from further investigations into economic or financial crimes reported to it will send a wrong signals to criminally minded persons who may want to violate the law of the land with impunity and hide under the protection of the court. Consequently urged court to refuse to accede to the request of the applicants.

When the matter was mentioned, the two parties were not in court. In view of this development the court was unable to fix any date for hearing
