I am interested in seeing the revenue
details from the budget to know
exactly how government intends to
fund the budget. My first instinct,
though, is that leakages in revenue
generating agencies (like NCS, NPA,
NNPC, etc) have been blocked TO A
VERY HIGH LEVEL and all funds
channeled into the TSA. That the
government has been able to come
up with that size of budget - even in
the face of declining oil prices & lower
oil production levels - without
depreciating the official exchange
rate of the Naira - is truly
remarkable.
How GEJ (with benchmark oil price of
over $75 throughout his term) was
not able to come up with a budget of
up to N5T beggars belief. One can
now say without equivocation that,
had PMB met an oil price of $75, we
would be talking about a N10T
budget. Kindly note that during GEJ
term, oil price was actually higher ($
105) than the budget benchmark and
yet our Foreign Reserves and ECA
was declining.
Above is a passionate view I share
with a friend,
I hope some "Conscious Nigerians"
won't wish he (@MBuhari) doesn't
succeed just because their Hero could
not..as for me, my HERO now and in
years ahead will simply be the
STREET PEOPLE and not the CLASS
maneuvering for evil gains!

PRYCE:Am sure d governors mentioned above became governor at d age of 38 and 40 respectively. But dats not dia present age ryt now. Bello might just be around 35 or less as at dose times. D fact dat I gained admission 8 years ago wen I was 20 years doesn't mean am older Dan u dat got admitted last year at d age of 18. Cus I will be 20 yrs + 8yrs which is 28 years by now and u will be 18yrs + 1yrs which is 19 years. Simple logic. |
AN OPEN LETTER TO APC
LEADERSHIP ON REPLACEMENT OF
LATE ABUBAKAR AUDU AS APC
GUBERNATORIAL CANDIDATE IN
KOGI STATE- NEED TO DO JUSTICE,
FOLLOW THE LAW AND JETTISON
ETHNIC NEPOTISM AND RELIGION
BIGOTRY AND JINGOISM.
The death and burial of Former Gov.
Abubakar Audu who was until his
death the APC Gubernatorial
candidate for Kogi State is no longer
in issue. That INEC has taken decision
based on the advise of its legal team
and the Attorney General of the
Federation is also not in issue. What
remains is how to replace him with
another name to complete the
process of Kogi Election on 5th
December, 2015 next hence my letter
of advice to avoid crisis and legal
pitfalls in Kogi State.
A Community reading of the
provisions of Sections 30, 31, 33,
36(1) 85(1) and 87, of the Electoral
Act 2010 as amended and Sections
178(3), 181(1), 187(1) and (2) of the
1999 Constitution as amended will
assist in appraising and appreciating
the situation and will provide a near
guide to all parties concern in taking
decision even though the issue at
stake is novel and strange
considering the lacuna in our laws.
In my humble opinion, it accords
more to reason that the Deputy to the
Late Audu be put forward and
another person nominated by the
party as a Deputy to run with him to
complete the almost "done" job.
In order to achieve this, the Party in
its reaction to INEC's decision on the
issue at hand in its wisdom came out
to say that it will conduct primary
election to replace Audu. In my
humble opinion, this is not feasible
and it will amount to a serious
injustice against Hon. Faleke for the
following reasons:
1. Audu and Faleke were validly
nominated to stand for election. The
nomination of Audu would not have
been valid if Faleke had not been
nominated to run with him as his
ASSOCIATE for the office in the first
place. See S.187(1) of 1999
Constitution.
2. The good people of Kogi State did
not cast their votes in the
inconclusive election for Audu alone.
The votes cast were for both Audu
and Faleke. Who knows whether APC
would not have been leading now
were it not because Faleke was
nominated as Deputy? INEC would
not have allowed Audu to run alone
as both Audu and Faleke traversed
the length and breath of Kogi State to
canvass for votes in a joint ticket.
3. The votes cast was for Audu,
Faleke and APC and the death of one
of the 3 should not deny the
remaining 2 from benefitting.
4. I am of the opinion that primary
election is no longer feasible between
now and 5th December, 2015. This is
because for there to be a valid
primary election, a notice of at least
21 days must be given to INEC so that
they can be available to observe the
primary election.
S.85(1) of Electoral Act provides as
follows:
"A registered political party SHALL
give the commission at LEAST 21
DAYS notice of any convention,
congress, conference or meeting to
convene for the purpose of electing
members of its executive committee,
other governing bodies or
nominating candidate for any of the
elective offices specified under this
Act"
The big question is where will APC get
at least 21 days between now and the
appointed date of 5th December,
2015? If APC acts based on sentiment
and jettison the law, PDP may
challenge the party and turn around
to benefit from the wrong step. We
should remember what happened in
Taraba State.
5. I am of a strong view that the
nomination of Faleke by Audu to run
with him has clothed Faleke with
valid nomination. He has also
participated in the earlier primary
election by proxy and as such does
not need any fresh primary election.
The ticket should be handed over to
him. See S.187(1) which state that a
Governorship Candidate is associate
of his Running mate.
According to BLACKS LAW
DICTIONARY, THE WORD
"ASSOCIATE" signifies
"CONFEDERACY OR UNION FOR A
PARTICULAR PUPOSE, GOOD or ILL"
New Oxford Thesaurus of English
also define the word "ASSOCIATE" as
BAND TOGETHER, CONJOIN, MERGE,
ATTACH, TEAM UP, RUB SHOULDERS,
JOIN FORCE etc. Wikileak Dictionary
(Wiktionary) define "ASSOCIATE" as
JOIN WITH ANOTHER OR OTHERS
AND HAVING EQUAL OR NEARLY
EQUAL STATUS!
It follows therefore that from the
meaning of the word "ASSOCIATE"
deliberately used by the Constitution
to describe a nominated deputy
running with a Governorship
Candidate in a joint ticket, it can be
said that the intention of the
constitution is very clear and as such
HON. FALEKE SHOULD BE
RETURNED AND CANNOT BE
WISHED AWAY AS THE SURVIVING
CANDIDATE OF APC in Kogi State.
6. I am aware that some interest are
working to prevent Faleke. This
group within the party are not
against Faleke Perse but they are
fighting ASÍWÁJÚ AHMED BOLA
TINUBU the perceived godfather of
Hon. Faleke. I am also aware that
others in this group are playing
ethnic card that Audu MUST be
replaced by another Igala man. Some
are even pushing for Audu's son
(Muhammed Audu) without
considering his experience to govern
a multi-ethnic State like Kogi. Do this
also think that Kogi State is a
kingdom? Or Fiefdom?. Others in this
same group are positing that Kogi
cannot be ruled by a Christian and as
such Hon. Faleke should be stopped.
To my mind, all these sentiments hold
no water in the eyes of the Law. If
Faleke is denied of benefiting from
this situation, it will be the greatest
level of injustice and it may lead to
PDP taking over the state already
won by APC through the Law Court
and out of carelessness and
avoidable legal pitfalls which can be
anticipated from the beginning.
Hon. Faleke is good to go and should
be allowed to lead the party to
anticipated victory on 5th December,
2015. Doing otherwise will have
debilitating consequences on the
party in Kogi State.

There is too much conscious or unconscious coddling of graft by this President. If former Head of State, Gen. Ibrahim Babangida, believes that his administration should be considered an angelic being regarding corruption compared to Jonathan’s, then this administration must be the unrepentant Lucifer of larceny and a dashing baron of daylight robbery that ever existed in the annals of Nigerian history. We all remember Babangida and his men. When the President said that corrupt government officials will not see the four walls of a prison under his authority, it was an announcement that depraved minds will always have a free pass with him. Incarceration of those adjudged corrupt, Mr. President, is a very powerful deterrent for those who steal public funds. |
