Mr Aboki: Now this is just down right stupiid..

All we have to prove is that the act is capable of causing death?! I'm sorry hommie, but you are a slowpoke with regards to Legal matters. No disrespect meant here, just stating a pure fact!

Now!! based on your comment;

1. A slap is capable of causing death. A knock on the head is capable of causing death. A punch is capable of causing death. Giving groundnuts to a person allergic to groundnut can cause death. Shiiiiit! My Aunty died in the middle of a verbal quarrel with a person from Hypertension (Meaning shouting at a person with High B can cause their death).

SO!!! Two young men full of testosterone that were fighting and in the process, one punches the other in the head which then causes death.. Can we comfortably charge him with MURDER?

hahahahahaaaa.. Dude you need to stop! You are embarassing yourself.
Though is sounds silly to respond to the above, I will still respond for record purposes. A slap is not capable of causing death. Neither is a punch capable of causing death except you can prove the person was hit in a very dangerous place like his private part or if the attacker is a trained professional like a black belt holder or a trained combatant! A mace is capable of causing death. You are sounding more silly with every post. Leave it alone. I am even helping to break it down for you, that is why you notice I have not been using legal terms. I want people reading it to be able to follow.

theoctopus: To prove motive in court, all you need do is show an event prior to the act that proves the offender had a reason to do what he did. That is all you need to do. A jury for example does not need to go searching wikipedia like you to understand these rudiments. You are clueless. You guys are even helping to provide that motive with your claim that Chinda attacked him earlier. He has also helped to provide motive by claiming he was attacked and ended up in the hospital before he came back to the chamber to attack Chinda. That is why I found it funny when some of you kept claiming he was attacked first. what you didnt realise is that you were all providing a proof of motive

So how can you prove that his intent was to KILL and no to just Beat him to a pulp?!

You are thick..
You dont need to prove his intent was to kill. Go back and read my posts again. The next thing you have to prove is that the act was capable of causing death. Please stick to your day job. You are clueless

Let me help you a bit.

You dont have to bring a weapon from home before it can qualify for a weapon that can be used for attempted murder. That your post actually made me laugh for like 2 minutes. You are so funny dud.
PoliticsRe: Chidi Lloyd Charged With Attempted Murder By Police by theoctopus: 10:45am On Jul 30, 2013
Mr Aboki: Reasobns why a case for attempted murder cannot stick;

1. For murder to be the case, two components must be present;

- The Mens Rea: In criminal law, it is viewed as one of the necessary elements of some crimes. The standard common law test of criminal liability is usually expressed in the Latin phrase, actus non facit reum nisi mens sit rea, which means "the act is not culpable unless the mind is guilty".

- The Actus Rea: Sometimes called the external element or the objective element of a crime, is the Latin term for the "guilty act" which, when proved beyond a reasonable doubt in combination with the mens rea, "guilty mind", produces criminal liability in the common law-based criminal law jurisdictions

Now we can say we have the latter, but proving the former would be extremely tough. All you keep shouting is 'The video'. Well.. How can you prove beyond reasonable doubt that 'Chidi lloyd conspired to kill Ihunwo with a mace'?!

Remember:

The mace was a weapon of chance. Chidi came into that hall empty handed and only grabbed that mace because it was the nearest weapon he could find. If it were not there, he would either have attacked them with his fist or with a computer or a camera stand or any other weapon of chance he could spot. This in itself removes the 'Mens Rea' which is necessary for murder to occur.. Even if Ihunwo had died from the Mace blows, the highest Chidi can be charged with would have been 'Manslaughter'.

This is the law not 'emotions'..
This is the most hillarious thing I have seen this morning. You took over 25 minutes to go to wikipedia and came back with a copy of whatever you found there, pasted it here and you think it actually supports your point? You must be a good comedian. Justice is blind, it is what you can prove in court that will make the case.
Again, you expose your ignorance. Have you ever heard the term multiple count charge? Do you even know you can be acquitted of some charges and found guilty of others and punished accordingly? dont argue stuff like you know what you are saying when you obviously dont. Btw, how did Amaechi win this one, when one of his staunchiest supporters in the state, Lloyd, is in police custody and facing jail time
I wanted to mention that before but I just dont have all the inspiration to engage these guys because they sound too childish. A man does not die in attempted murder. If he actually dies, it becomes manslaughter or premedidated murder charge, not attempted murder.

Mr Aboki: Hahahahaaaa..

Another dumb fvck who thinks calling others ignorant makes his point more intelligible than others..

First of all, let me test your intelligence and ask you a simple basic LAW 101 question; What are the factors that must be present for somebody to be charged with murder (attempted murder).
Let me give you the benefit of doubt and engage you. The most important factors in attempted murder are
1. Motive and
2. That the action is capable of causing death.

That video delivers that on a platter of Gold.

Just to add that attempted murder is not the only charge that will be on the charge sheet.

You can rant and throw your insults all you want, it makes no difference to me. I will say it as it is. It is very childish of you guys. You lots forget one thing. There are many people on NL who dont comment. They just read the comments and laugh at what some of you say. It is very childish. Defending a man who the whole world saw on camera hitting a fellow legislator with the mace is very childish. If you think you can convince anyone otherwise with your crap posts, then I feel sorry for you. Only fellow kids like you will take you serious. The thread on age groups on NL revealed a lot. I saw the age range of some people who posts here and I just realised why they post the crap they do.
PoliticsRe: Chidi Lloyd Charged With Attempted Murder By Police by theoctopus: 9:53am On Jul 30, 2013
Mr Aboki: Hahahahahaaaa...

ATTEMPTED MURDER!!! Who the fvck is the Police Lawyer?! How can you charge him with attempted murder?! Are they intentionally trying not to win the case?! You cant charge hin with attempted murder, because you cant prove that he was trying to kill him..

Conspiracy?! Like seriously?! When did he conspire?! My god! The Nigerian police force are really good for nothing more than to train Nama.

This just goes to show you how stupid the Nigerian Police truly are.. Even I sitting here could have easily told them that the 'attempted murder' charge can never stick. Neither the conspiracy charge. Rather charge him with 'Assault with a 'potentially' deadly weapon' or 'Maliciuos assault'.. Thats all they can do. And this is not a crime but a misdemeanor. grin

AMAECHI WINS!!! AGAIN!!
The problem with NL is that you have very ignorant people like you making comments like they know what they are talking about. That video will deliver a case of premeditated attempted murder anywhere in the world. It is such an easy case for the police. The part where they held the man down and Chidi Llyod raised his mace and brought it down will deliver a case of premeditated attempted murder against everyone in that scene. Your ignorant comments on NL cannot change that.

On another note, it is very shameful that you are trying to defend such an act. Your political inclination should never make you defend such an act. When you do that, you negate every right you have to call for equity and justice for any other event or person. Defending evil just because it soothes your political leaning is the bane of a failed society.
PoliticsRe: Chidi Lloyd Charged With Attempted Murder By Police by theoctopus: 9:44am On Jul 30, 2013
There is nothing like legislative immunity for Nigerian legislators. The only protection for legislators is protection from libel for things they say in their discussions within the chamber. Only Nigerian presidents and governors have immunity. Most of you ACN supporters here on NL are not only childish, but you are very stup1d too. And there is no way a court will throw a case out in the first day of sitting. The first day will actually be spent soliciting for things like bail for the defendant.

All of you ACN kids on NL make PDP look so good. Your attitude, tribalism and hypocrisy will actually help to deliver 2015 to PDP. If this is what ACN has sent you guys out to do, then they are very stup1d too.
PoliticsRe: True Picture of the Light Situation in Anambra State.!! by theoctopus: 6:41am On Jul 30, 2013
If you are really intelligent, you would have noticed that it was an opposition person that even said it in that guardian report. Do you think Ngige is working for PSP or what. They have told you what is happening there. If you ain't satisfied, take a glass of water. The fact is that even if they say anambra is having uninterrupted power, there will still be some areas that will not be part of it because of other issues like bad transformer. But the generality of the state or state capital is what the report is referring to.
PoliticsAnambra Celebrates 3 Weeks Of Uninterrupted Power Supply by theoctopus(op): 11:24pm On Jul 29, 2013
ONITSHA—Vice Chairman, Senate Committee on Power and Steel, Senator Chris Ngige, Monday, said concerted efforts by the committee to salvage epileptic power supply in Nigeria had started yielding dividends, following the celebration in Awka, Anambra State, of three consecutive weeks of uninterrupted electricity supply.
Residents of such places as Agu-Awka, Ekeh Awka market, have expressed relief from the air and sound pollution of power generating sets.
Speaking with newsmen in Awka, Senator Ngige, who represents Anambra Central senatorial district, explained that the development was part of his developmental programme for the zone.
He added that the new transmission line at Agu-Awka power station was being test-run and would officially be commissioned in no distant time.
Ngige also said it was part of the IPP programme being carried out by government to alleviate suffering of Nigerians over the epileptic power supply in the country and save small and medium scale industries from closing shops.
He said: “This is part of the IPP programme of government on the power sector. What we have in Agu-Awka power station is a new transmission line that is under a test run and that explains why in the past three weeks, major parts of Awka have been enjoying uninterrupted power supply.
“As a result of this, the load in those areas has reduced and also improved power supply in places as Nibo, Mbaukwu, Umuawulu and Amawbia towns of Awka South local government areas.
“When the issue of IPP and transmission lines were being put in the front burner at the National Assembly, areas such as Onitsha–Nnewi were included as well as Awka –Enugu-Abakaliki.
“So, that of Awka has come on stream and I am happy to tell you that this is one of my constituency programmes for Anambra Central.
“Due to my position as Vice Chairman, Senate Committee on Power and Steel, I was able to network major towns in Anambra State, including the Ala Oji power station in Abia State, and also towns like Onitsha-Ihiala Owerri- Oguta –Aba and Nnewi areas.
“It would be recalled that when the Senate Committee on Power started its oversight functions it was discovered that 21 containers of transmission lines imported by the Federal Government’s contractors were auctioned by the Customs to unknown buyers whose addresses could not be identified.”
Ngige noted “that the probe on power and customs over the auctioned transmission lines had yielded dividend and that is why Awka has witnessed a major boost in power supply.”
He hinted that in less than three months, the improvement in power supply would be more, lamenting that no fewer than 16,000 small scale and over 20,000 medium and large scale industries had closed shop due to failure in the power sector in the South East zone since 1999.

http://www.vanguardngr.com/2013/07/anambra-celebrates-3-weeks-of-uninterrupted-power-supply/

The Only funny part of this report is that Ngige was actually trying to take the glory for it. lol. This credit goes to the FG transformation agenda and to no other.

ssii: Are you in anyway exonerating Bipi after watching his confession? Whatever reasons you have for supporting illegalities, get ready because what goes around, comes around. While Lloyd faces the music for his acts, there should be fairness and neutrality on the part of gej's fed govt. Bipi ought to be arrested as well based on his confession because he started the crisis. Gej is towing a wrong but familiar path
Your anti gej sentiments gives you up easily. What criminal offence did you say Bipi commit? Attempting to impeach a speaker even if you are only 2 people is not a criminal offence. Bringing "thugs" to the assembly is not a criminal offence, except they actually carried out a violent act. Even is you were to charge them for disturbing public peace, that is still a very minor offence. You have no proof that they used a fake mace. You just cooking that up to support your argument. All in all, you still cannot bring a valid offence against Bipi, but you sure want him arrested to make you happy or to score one for your beloved partisan agenda. You ACN folks are too transparent

PoliticsRe: Barbaric And Satanic Fashola Must Pay For This!!! by theoctopus:
Yorubas are starting a trend in Nigeria that is going to escalate into something very very disastrous soon. Some Yoruba kids come to this forum to support this evil but I pity them. There are Yoruba people all over Nigeria and in their thousands. This is not like 1967 where there were few Yorubas in other regions. The situation is very different now. Yorubas are foiling a new culture of hate and tribalism in Nigeria and they foolishly believe it will not hurt their people. There are so many Yorubas making a living in PH, Onitsha and other states. So many of them are in the oil industry(Mobil, Shell, etc). This growing trend of tribalism and hatred is one that nobody has a monopoly of. If it escalates, then I feel sorry for the Yorubas living outside the south west. Some kids can continue to post rubbish on NL, but the reality on the ground will be far different from what you see online. This is wrong. There is no way it can be defended. If you dont want other people to live in Lagos then stop collecting federal allocation. Simple as that. If you think you can go on on your own, then declare your own country. The economy of Lagos is based on its population, nothing else. Lagos in itself has no natural resources of serious economic worth. It depends largely on its former status as capital of Nigeria and present status as a business capital, which it attained when it was federal capital. If the non indegenes move out of Lagos, there wouldnt be enough people to generate the money it currently generates. The money does not fall from the skies. It comes from the people on the ground and majority of these people are from states around the country, from the extreme north to the extreme south. Aliko Dangote practically controls 80% of Apapa port. It isnt controlled by a Yoruba man or a Lagosian. Silver Bird is owned by a non indegene, so is AIT, Channels, Thisday, Guardian, etc, just to mention a few. This tribalism will spark something very serious soon and we will all recall that Fashola started it
