Sincerely, reading the responses of some of the residence APC loyalists here, I have come to the conclusion that some youths are not ready for the future we talked about. They are just okay with the crumbs that are given to them by the politicians while the politicians kids eat the best food at the table and happy with the feelings that my party is winning. Sincerely, we are not ready because how can a reasonable person condemn Obi on this? |

The Nigerian Bar Association (NBA) has filed a public interest suit at the Federal High Court, Abuja, challenging the legality of the Nigeria Police Force’s newly introduced tinted glass permit policy. The decision to litigate the matter was one of the key resolutions of the NBA’s National Executive Council (NEC) at its pre-conference meeting held on August 23, 2025, in Enugu. In April 2025, the Inspector General of Police introduced a policy mandating motorists to obtain annual tinted glass permits through a digital portal (possap.gov.ng) managed by a private vendor, with associated fees payable into a private account. The policy, initially slated for enforcement on June 1, 2025, was later postponed to October 2, 2025. Despite this extension, the NBA noted widespread reports of police officers harassing and extorting motorists at checkpoints under the guise of enforcing the policy. The Association described the development as a clear violation of constitutionally guaranteed rights, including the dignity of the human person, privacy, freedom of movement, and ownership of property. The Association further questioned the statutory basis of the policy, citing the Motor Tinted Glass (Prohibition) Act of 1991 as an outdated military-era legislation incapable of meeting the test of a law “reasonably justifiable in a democratic society” under Section 45 of the 1999 Constitution. It also pointed out that the Act contains no provisions for annual renewals or payment of fees, thereby exposing the policy as lacking legal foundation. Of particular concern to the NBA is the fact that payments for the permits are being made into a private account—PARKWAY PROJECTS, Account No. 4001017918—instead of the Federation Account, raising transparency and accountability questions. Consequently, on September 2, 2025, the NBA, through its Section on Public Interest and Development Law (SPIDEL), instituted Suit No. FHC/ABJ/CS/182/2025: The Incorporated Trustees of the Nigerian Bar Association v. The Inspector General of Police & Anor. The action is spearheaded by SPIDEL Transition Committee Chairman, Prof. Paul Ananaba, SAN, and the Section’s Public Interest Litigation Committee led by Mr. Olukunle Ogheneovo Edun, SAN, whose coordinated efforts ensured the swift filing of the case. Speaking on the matter, Prof. Ananaba emphasized that the NBA would pursue the litigation to its logical conclusion. He urged all parties to respect the judicial process, suspend enforcement of the policy, and allow the courts to determine its legality. “As the conscience of the nation, the NBA cannot stand by while the rights of Nigerians are trampled upon under a policy riddled with constitutional and statutory irregularities,” Prof. Ananaba said. The matter is currently awaiting assignment to a judge of the Federal High Court. LAGOS TO INTRODUCE AND ENFORCE MONTHLY HOUSE RENT. While this is commendable, however, I doubt the effective implementation of this policy and let me borrow the language of our politicians, "Lagos State is not ripe for this". Permit me to highlight some issues and also make some recommendations based on my personal experience as a lawyer, landlord, property manager and employer of labour. In the countries where this is practiced, the court and enforcement systems are working efficiently. If you refuse to pay your rent as at when due, you will meet your load outside (your loads will be thrown outside for scavenger to feast on) but here, you must serve quit notice, 7 days owners intention to recover possession, file suits in court if the tenant refuses to deliver possession, spend months in court, after the judgment, the tenant will appeal and you will probably spend years at the appeal court and after judgement, you will still spend another money and time for the enforcement and execution of the judgment. While all these processes are going on, the tenants are living rent free in your house and you can't result to self help. We need to strengthen the enforcement institution and processes before the implementation of the policy. Secondly, government should also live by example, you can't continue to increase your approval fees or introduce new fees every time and expect the landlord not to recover their investment on time. Thirdly, we need to also consider landlords/developers that obtained loans to build the properties, we need to also consider the repayment plans and the likely accrued interests. These need to be regulated too. Furthermore, government should also build affordable houses and estates for people to choose from. Jakande did it, if we have more of that, the landlord will be forced to comply with the policy. The law of supply and demand will play critical roles in this. I want to add that, some other facilities in the houses are provided by the landlords e.g boreholes, Security and in some cases, access roads etc. Government should provide these as this will reduce the cost of building new houses, especially in developing areas. Government should also look into the books and styles of employers who do not pay salary as at when due. Some pay 15th of the other month. This will also affect when tenants pay rents to the landlords. Governments should also improve the economy and reduce the inflation. Presently for a project I am working on, I bought cement at N10,500 per bag, N600,000 for 30 tons of granite, N210,000 for 20 tons of sharp sand, N110,000 for 20 tons of filling sand and N750 per 6" block. How do you expect the landlord to cope with the monthly rent with the current rates of building materials? I wish to add that the minimum wage should be increased and mandate that employers should pay good wages as this will encourage the landlord to collect good monthly rates from tenant. A situation where tenants are paying N4k per month for a room is a bad investment. In London, some Nigerians pay as high as £2000 pounds monthly for a flat. That is about N4,500,000 per month. Can anybody pay that amount monthly for a two bedroom flat now in Nigeria? The answer is No. Finally, we can make the system work if all stakeholders are sincere and ready to make sacrifices to build a better Lagos. Itesiwaju Eko, ajumo ṣe gbogbo wa ni. |
