Spend more time reading the Senate records when the bill was being passed. It does mention foreigners. In fact, those records are where we learn that children of diplomats do not obtain birthright citizenship. This case will turn on the original intent of the writers of the amendment, not the amendment itself.

It is not. Arguments that the 14th amendment did not apply to non-citizen children born here have been an issue for over 100 years. The Wong Kim Ark ruling is what gave us the liberal interpretation we have today. A conservative SCOTUS can certainly overturn it... and that essentially becomes law for another 100 years.

You're viewing this from the lens of 2024. It's not the first time this case has come to the Supreme Court and in fact, the 1899 Wong Art Kim ruling is how we understand the 14th amendment today. If the court could overturn Roe v. Wade, they can overturn Wong's ruling.

That same court essentially made the president a king and agreed he could kill his political enemy and get away with it, as long as he says it was in the national interest. We all said they would not overthrow Roe v. Wade... and here we are. You vastly overestimate this court.

What you'll find is justices reverting to what the framers intended, not the most liberal interpretation of that phrase in 2024. If they went that direction, the EO likely stands. The best way to reverse the EO is to have no one challenge it for 4 years, and how a Dem wins in 2028.

An EO is not intended to change the Constitution, it is simply an Executive decision (that the executive branch of government must comply with - including those issuing US passports), so long as it does not violate any rights. The EO was intended to bait someone with standing to file a SCOTUS suit. The lack of standing is why no one has filed a 14th Amendment suit until now. They think they will have 5 justices to overturn the Wong Art Kim decision. At that point, it's game over.

The EO does not overturn the 14th Amendment. It is intended to force a court to reinterpret the meaning of "subject to the jurisdiction thereof." There is already information indicating that the writer of the amendment did not intend it to be interpreted broadly.

So I am a current PhD student. I had a visa interview (renewal) for 12th and was supposed to travel in to Nigeria on the 8th. The airline canceled the trip and rebooked us for 10th. Meaning we’d arrive Nigeria a day before our interview. Unfortunately, we missed that flight and we couldn’t meet the interview.

The F2 allows you to stay with your husband for the duration of his visa. The B1/B2 is for short-term visits, which is what you indicated you want. Frankly, the VO was not inclined to give you a visa. Newly married, no kids... basically no ties.

Best bet is to wait a few months and reapply. Next time, i'd simply state the F2 is like a B1/B2 in your view. It allows you to visit your husband as often as you are financially able while avoiding the need for repeat visa applications until your husband is done with his studies.
