The Special Presidential Investigation Panel for the Recovery of Public Property has sealed off suspicious assets and property belonging to Senator Peter Nwaoboshi, located in Warri, Asaba in Delta State, and Lagos State.

The Presidential Panel carried out the action on the premise of last week’s ruling of a Federal High Court sitting in Abuja which ordered an interim forfeiture of property belonging to Nwaoboshi, who represents Delta North senatorial district.Ruling in suit no FHC/ABJ/CS/1127/18 filed by the Special Presidential Investigation Panel for the Recovery of Public Property on behalf of the Federal Government, Justice Taiwo O. Taiwo also placed a post-no-debit order on 22 bank accounts linked to Nwaoboshi.

The embattled lawmaker was recently referred to the Office of the Department of Public Prosecutions, Federal Ministry of Justice by the Special Presidential Investigation Panel led by Chief Okoi Obono-Obla for allegedly making false assets declaration in his Form CCB1 submitted to the Code of Conduct Bureau.

According to the ruling, 14 properties and 22 bank accounts linked to the senator are to be temporarily forfeited to the federal government.Aside sealing off the properties, the Panel also wrote to several banks including Zenith International Bank Plc ; United Bank of Africa ; Sterling Bank Plc and Access Bank Plc to block Senator Nwaoboshi from operating multiple accounts maintained by him in these banks pursuant to the Order of the Interim forfeiture given by the Court.

Some of the properties sealed by the Presidential Panel included: Summing Electrical Company located at Asagba along Asaba Airport Road, Asaba, Delta State; PON filling station along Asaba Airport Road, Asaba, Delta State, and a Multibillion Naira Estate under construction at Maryam Babangida Road, Asaba, Delta State.Others are: Cartage Cinema located at Okpana Road beside Rain Oil Petrol Station, Asaba, Delta State; Newbridge filling Station along Airport Road, Warri, Delta State and a house at No 8 Monu Olanrewaju Crescent, GRA, Asaba, Delta State.Senators Nwaoboshi’s properties sealed in Lagos are Guinea House, No 27, Marina Road, Apapa: A multi-billion building located at 41, Burma road, Apapa, Lagos.In Abuja, House No 25 6932 road, Adban Estate, Gwarimpa; and Plot 3011B Kuranakh Close, Maitama were sealed. Also, a number of plots of land were also sealed by the Panel.

The Coalition of Lawyers against Corruption, COLAC has hailed the Senate for reconvening to look into the controversial suspension of the Chief Justice of Nigeria, Walter Nkanu Onnoghen.

In a statement signed by the National Coordinator of CACOL, Barr. Olusegun Bamgbose, made available to PoliticsNGR on Sunday morning, the group warned the Senate not to allow President Buhari to decimate the Judiciary. The statement read;

"We want to sincerely commend the National Assembly for planning to reconvene on Tuesday to look into the illegal, unconstitutional and obnoxious suspension of Justice Onnorghen as the Chief Justice of Nigeria. This is quite appreciated and commendable. We equally want to thank the US, EU and UK for rising up to the occasion to express their deep concern for this odious act of the Presidency to subvert and subjugate our Constitution.

"It's very clear that this government has gone ga ga in its attempt to cause confusion ahead of the Presidential elections coming up on 16th February 2019.

Buhari must respect our Constitution which he swore to uphold on the 29th of May, 2019 or honorably vacate the State House. He has no business occupying the State House if he will not respect our Constitution. We want to assure concerned Nigerians and the International community that there is no cause for alarm as there would be no election in Nigeria except the offensive decision is reversed. We shall leave no stone unturned until sanity returns.

We shall explore all lawful means to cut the President to size. We shall within the ambits of the law resist any form of executive rascality and recklessness. The law must have his way. We want to assure Nigerians that there will be no going back until the decision is reversed.

No one messes up with Judiciary and go scot free. We want to tell the parties to continue with their campaigns as there are strong moves to restore the dignity and the integrity of Judiciary before the 16th day of February this year. We will equally want to alert the National Assembly to speak with one voice come Tuesday.

We are quite aware that the Presidency is seriously engaged in lobbying members of the National Assembly in order to cause confusion as the Senate reconvene on Tuesday. However, we urge them to resist all attempts to use them to destabilize the polity."

Below is an article written by Audu Bulama Bukarti on the recent suspension of the Chief Justice of Nigeria, Walter Onnoghen, made available to PoliticsNGR. Read Below;

"Given the supersonic speed at which the CCB & CCT are moving and the uncharacteristic enthusiasm of the FG to comply with judicial orders, I am suspicious of the motive behind the prosecution of the CJN.

I am also concerned with the time of the whole thing. But this is just a marginal note; a statement by the way side. I will keep it for another day.

Now, turning to the topic at hand, I do not see anything wrong or illegal with the suspension of the CJN and swearing-in yesterday of Hon. Justice Ibrahim Tanko. The action of PMB is constitutional. Nay, he had a duty to act in the way he did. Here are my seven reasons:

1. PMB did not act on his own motion. He acted on an Order of the CCT.

2. The CCT has an inherent power under Section 6 of the Constitution to issue any order that will promote the Rule of Law and ensure the smooth conduct of its proceedings. I believe this order does both. See point 7 below.

3. Some lawyers have argued that CCT’s Order is illegal or even unconstitutional. But this is not PMB’s business. He can’t question the legality of a judicial decision as doing so will tantamount to the president sitting on appeal on the Judgement of a Court.

4. Under our constitutional system, PMB has no option than to obey the said Order. That is why we have been urging him to obey the Orders on Dasuki and Zakzaky. I repeat the same call here toady;

5. The provisions of Section 292 cited by the NBA and others do not apply to this matter as the CJN was not “removed”. He was “suspended” pursuant to a valid and subsisting Order. The removal envisaged by and under Section 292 of the Constitution means “the dismissal of someone from a job” while suspension as in the present case means “[to] temporarily prevent from continuing or being in force or effect.”

6. The CJN is the head of the all Nigerian courts and Judiciary as well as the Chairman of the National Judicial Council which, under his Chairmanship, exercises supervisory and disciplinary role on all judges and judicial officer in Nigeria. This means any decision reached by CCT may likely go on appeal up to the Supreme Court where the CJN is at the helm of affairs.

7. It is against the rule of Natural Justice for Justice Onneghen to remain the CJN and Chairman NJC while facing trial under the same judges whose promotions, disciplinary and other related matters are under him;

8. I believe this action will facilitate quick dispensation of justice in this matter. Before the Order, the “generous SANs” representing the “poor” CJN had started taking steps that are clearly intended to frustrate his trial. They had started raising frivolous issues and making empty applications because they knew that their client had an upper hand. Now that he has been suspended, the defense counsel will be serious to prosecute the matter to its conclusion so that their client might be reinstated as quickly as possible if he is not found guilty.

9. Assuming, without conceding, that there are any anomalies in the procedure adopted. I would rather forgo any such anomalies for the crushingly disappointing alleged acts of the person who is suppose to hold those who violate our laws to account. I feel we must get the bottom of the allegations against the CJN whatever and punish him if he is guilty."

A Former Commissioner of Police, Abubakar Tsav has hailed President Muhammadu Buhari for suspending the Chief Justice of Nigeria, Walter Onnoghen, saying that the move has saved Nigeria's Judiciary from shame.

In a statement made available to PoliticsNGR, Tsav wrote;

"The swearing in of Justice Ibrahim Tanko Muhammed as the Acting Chief Justice of Nigeria (CJN) by President Muhammadu Buhari is a welcome development as it would pave the way for the former CJN, Justice Walter Onnoghen, to now have the focus necessary for him to clear himself before the Code of Conduct Tribunal (CCT).

It must be noted that Justice Onnoghen’s date with the CCT is about explaining how and why he operated series of domiciliary bank accounts in violation of the law. His arraignment before the Tribunal is not in connection with a ruling he gave or the way he conducted himself in court so the distraction he caused by claiming that only the National Judicial Council (NJC) could discipline him does not apply in this instance.

President Buhari must be commended for acting to save the judiciary and the image of our country which was fast being reduced into a circus as the erstwhile chief interpreter of the law was about setting a dangerous precedent of ignoring court summons for him to be arraigned. It took the decisive call of Mr. President to save the judiciary from shame and save Nigeria’s democracy from the collision course that the ex-CJN’s behaviour had set it.

The Nigerian judiciary came to a low point that still requires intensive damage control. The clear cut matter of the former CJN appearing before the Tribunal to defend himself against the charges of false asset declaration preferred against him by the Federal Government became something that was being argued and interpreted at beer parlor joints while the accused repeatedly exploited ridiculous loopholes to evade appearing in court.

Had he persisted in office when it was imperative that he should vacate the position to ensure that his case before the CCT was not unduly influenced by his position, the entire democratic structure of Nigeria would have been compromised since all post-election litigations that would produce questionable rulings would have Onnoghen’s handprint all over them.

The law is no respecter of persons so Justice Onnoghen should prove to Nigerians that he believes in the treatment he had dished to them for several decades now; he himself admitted committing the infractions. It is now up to him to argue extenuating circumstances in defence of his action.

It is most unfortunate that this bold step towards saving the judiciary from itself is being given both political and ethnic coloration, which is most unfortunate as the arguments be pushed forward by some of those speaking in favour of Onnoghen are in reality casting aspersion on his integrity for a judicial officer of his stature should not be portrayed as being a card carrying member of a political party for its chieftains to rise in his vehement defence.

Any Nigerian who is not happy with the suspension of billionaire Justice Onnoghen after all the revelations which he (Onnoghen) has not deneid, is irredeemably corrupt, wicked and is undeserving of making contributions to the ongoing discourse around the reforms needed in the judiciary.

Meanwhile, acting CJN Justice Tanko should see the events leading to his appointment as a wake-up call to initiate the reforms and anti-corruption crusade needed to sanitize the judiciary in Nigeria while ensuring that the era of justice being put on sale is a thing of the past."

The Minister of Information and Culture, Alhaji Lai Mohammed, has described as a face-saving measure the decision by the PDP to pull the brakes on its electioneering campaign over Justice Walter Onnoghen's suspension, saying the PDP's campaign never gained traction in the first instance.

Responding to reporters’ question in Ilorin, the Kwara State capital, on Saturday, on the suspension of the PDP's campaign, the Minister said: ''Which Campaign? Their campaign was over a long time ago. There is nothing to suspend. We said it that their campaign had floundered. You can now see. What they are doing now is looking for a face-saving way out of a dead and buried campaign.''

He wondered why the PDP is crying more than the bereaved, and asked the opposition party whether Justice Onnoghen is one of its members.

“And in any event, let’s ask them this question: Is there something that they know that we don’t know? Is there something between them and the suspended CJN? Otherwise, we did not see why they should suspend their campaign anyway, but I can understand that their campaign was bound to end this way,” Alhaji Mohammed said.

He said while Nigerians have been trooping out in large numbers wherever the President’s campaign ship berths, the PDP supporters have been dwindling by the day.

On the outcry by some people and organizations over Justice Onnoghen's suspension, the Minister said it’s troubling that those who are crying foul over the suspension of the CJN have actually ignored the fact that a serving Chief Justice not only amassed millions of dollars in his account, but admitted that he forgot to declare same in his Assets Declaration Form.

“For anybody who read Mr. President’s address yesterday, two things stood out. The first is that additional evidence has just been revealed that the suspended CJN refused to declare millions of dollars in his possession. More worrisome is the fact that when the suspended CJN was confronted with the petition that he failed to declare his assets, he added that it was a mistake, that he forgot.

“Now, I would have been a happier person if the same people who are now crying tyranny and dictatorship could really address the issue raised by the President, in his address on Friday, that addition investigations have revealed that several millions of dollars were found in the CJN's account. And when the CJN was confronted with the original allegation, he admitted that he forgot to make full declaration, and that it was a mistake,'' he said.

On the constitutionality of the CJN's suspension, he faulted those claiming that the President acted outside of the Constitution, adding that in suspending Justice Onnoghen, the President merely carried out an order of a court of competent jurisdiction directing him to suspend the Chief Justice pending the final determination of the cases against him at the Code of Conduct Tribunal.

The Speaker of the House of Representatives, Yakubu Dogara has weighed in on the recent suspension of the Chief Justice of Nigeria, Walter Nkanu Onnoghen by President Muhammadu Buhari.

Dogara, in a statement made available to PoliticsNGR, raised alarm that Nigeria's democracy was 'on fire'. The Statement read;

"With the unconstitutional suspension of the Chief Justice of Nigeria (CJN) by President Muhammadu Buhari, the world has been served with notice that Nigeria is now a full-blown dictatorship. This did not come as a rude shock except to those that have been blind to the gradual but progressive erosion of democratic values in the polity as President Buhari’s Government has never hidden its disdain for the rule of law."

"We have watched in disbelief as the Government recklessly deploys institutional prerogatives; routinely flouts the rule of law; subverts and assaults democratic Institutions; refuses to accept opponents as legitimate; suppresses citizens civil liberties(especially those of opponents) and trample underfoot the media. In short, the Government’s tyrannical and authoritarian credentials are loathsomely legendary."

"No provision in Sections 157 and 292 of the 1999 Constitution as amended supports the President in purporting to suspend the CJN or swearing in an acting CJN. The whole idea of a limited government is that the President’s powers is limited by law and it is ultra vires his powers to act in the absence of explicit legislative authorization. That is representative democracy at its best which our 1999 Constitution as amended guarantees."

The Inspector General of Police, Idris Kpotum shunned a Senate hearing into the circumstances surrounding the arrest Senator Dino Melaye on Wednesday.

PoliticsNGR gathered that the IG instead visited a Birnin Gwari, a town in Kaduna state to assess the security of the area.

A statement by the Nigerian police force on the IG's whereabouts today read;

"IGP Ibrahim K. Idris, NPM, mni and GOC 1 Division Kaduna, Gen. Mohammed Mohammed, visit Birnin Gwari, Kaduna State to assess security needs of the people".
