Justice Ibrahim Buba of a Federal High Court in Lagos, on Monday fixed Dec. 14 for trial of former NIMASA boss, Patrick Akpobolokemi and five others, charged with N2.6 billion theft. Akpobolokemi is standing trial alongside Ezekiel Agaba, Ekene Nwakuche, Amaechi Juan and two companies; Blockz and Stonez Ltd., and Al-Kenzo Logistic Ltd., on a 22-count charge bordering on conversion and theft.

The Economic and Financial Crimes Commission (EFCC) dragged the accused persons to court. The accused were first arraigned before Justice Saliu Saidu on Dec. 3, on a 30-count charge, bordering on conversion and stealing. They were, subsequently, arraigned before Justice Ibrahim Buba on Dec. 4 on fresh 22 count charges, also bordering on conversion and theft.

They all pleaded not guilty to the charges and were each granted bail in the sum of N50 million with two sureties in like sum. The court had also ordered the accused to sign an undertaking not to unnecessarily delay the trial. Buba then adjourned the case to Dec.14 for trial.

When the case came up on Monday; the counsel to the first accused, Mr Joseph Nwobike (SAN), prayed the court for a short adjournment to enable him regularise and prepare for trial. Following his application, Justice Buba adjourned the case to Dec. 14 for commencement of trial.

In the charge jointly signed by Mr Festus Keyamo and Mr Rotimi Iseoluwa, the accused were said to have committed the alleged offences between December 2013 and March 2014.

The prosecution alleged that in February 2014 in Lagos, the accused persons conspired to convert about N437 million belonging to NIMASA. They were also accused of converting about N66 million to their private use on Jan. 9, 2014, and between April and August, 2014, they converted N21 million and N53 million, respectively, to their use. The offences, the prosecution said, contravened Sections, 15 (1), 15 (3) and 18 (a) of the Money Laundering (Prohibition) Act, 2012.

As more facts appear in relation to the botched $2bn arms purchase and the circumstances surrounding it, the Economic and Financial Crimes Commission (EFCC) have stumbled on fresh clues indicating that loots recovered from the late Head of State, Sani Abacha may have been diverted to the arms purchase.

There are suspicions that the looted funds formed the main sources of extra-budgetary expenditures which were disbursed to some chieftains of the People’s Democratic Party (PDP) for the 2015 campaign.

It was gathered that following the recovery of the looted funds, running into billions of dollars, Jonathan raised a four-man team headed by ex-Finance Minister, Dr. Ngozi Okonjo-Iweala on how to use the loot.

Although there was pressure on the committee chairperson to divert the loot to security matters, she was said to have resisted the proposal.

It was, however, gathered that the committee later recommended that 60 per cent of the Abacha loot be used for development and 40 per cent for security challenges and arms purchase.

A source said: “We are looking into fresh clues that apart from the $2 billion, some looted funds recovered from the Abachas were also diverted into the arms purchase and other security-related needs.

“There are different clues we are probing. While some alleged that the looted funds were domiciled in the ONSA, others claimed that the funds were directly managed by the Presidency.

“We may check records at the Federal Ministry of Finance accordingly on Abacha loot.”

Meanwhile, the EFCC is thinking of ways to ask former president Goodluck Jonathan to explain his role in the arms deal.

The EFCC has asked some of the suspects to produce relevant written approvals from the ex-President on some of the expenditures.

It was learnt that more suspects have named Dr. Jonathan in the approvals and withdrawals of huge cash from the Office of the National Security Adviser (ONSA) and the Central Bank of Nigeria (CBN).

The former National Security Adviser (NSA), Col. Sambo Dasuki (rtd), and the Emeritus Chairman of Daar Communication, Chief Raymond Dokpesi, claimed that they got approvals for all projects they were accused of running.

It was learnt that some of the suspects acted on verbal approvals to carry out transactions.

“Either way, the EFCC may need to clarify a few things from the ex-President”, a source said last night. He pleaded not to be named because of the “sensitivity” of the matter.

It went on: “Some of the high-profile suspects have told us that they got approvals from the ex-President. Equity demands that we should hear from his side too.

“We are certainly weighing options to avoid any act capable of derailing these ongoing investigations. We can have audience with the ex-President in confidence; we may isolate issues for him to help us clarify in writing; he may also volunteer on his own to clear the air on a few issues through the highest quarters and we may allow our ongoing comprehensive investigations and evidence to be sufficient for prosecution. The onus will then be on the suspects to present written approvals in court.

“This is not the first time we will be investigating past presidents. We will draw our experience from the previous exercises. You know, we investigated two former heads of state and a prominent traditional ruler on the $184 million Halliburton case and none of them was invited. We handled it in a meticulous manner.”

A former member of the Federal Executive Council (FEC), said: “The ex-President has expressed doubts on some of the approvals being bandied about. I think Jonathan has a way of reaching out to the Presidency in order not to overheat the polity. He will certainly do so.”

The Economic and Financial Crimes Commission (EFCC) have revealed that the Emeritus chairman, Daar Communications Plc., Chief Raymond Dokpesi will have to account for about N10 billion votes given to him for publicity.

It will be noted that Daar Communications was granted the broadcast right for the U-17 World Cup in 2009 by the Federation of International Football Associations. But in an intriguing plot, Dokpesi approached then President Umaru Yar’Adua demanding payment for broadcasting the football tournament. In an invoice sent to the central government entitled, DAAR-FIFA HOST BROADCASTER BUDGET, Dokpesi demanded N5billion to defray the company’s cost.

Former president Umaru Yar’Adua refused to pay him on the basis that the Federal Government did not enter into any agreement with him and the facilities he used to broadcast the tournament belonged to NTA, a government owned station.

According to an EFCC source ”We have been trying to reconcile records with Dokpesi and he has about N10 billion to account for.”

Apart from the payment of N2.1 billion, a highly-placed source within the Commission listed more issues against Dokpesi as follows: payment of $50 million by ex-President’s campaign organisation; alleged plot to hack into number 60959146 with Sort Code 201334 belonging to one Dr. Haggai I. Ali with Barclays Bank, Queens Road Branch and Bristol, UK; alleged indebtedness of about N3.3 billion to Fidelity Bank out of N7.5 billion; operating DAAR Communications account alone despite the fact that it is a publicly quoted firm; and over-payment of more than N8 billion for the transmission of U-17 Junior World Cup (2009) and non -payment of dividends to shareholders.

The source added: “So far, Dokpesi has to account for over N10 billion and he has been confronted with some evidence which he admitted were some of the transactions he engaged in.

“We have discovered that Dokpesi was paid N8,047,275,290.99 on January 27, 2012 through account number 2017679134 with Maitama branch of First Bank Plc. We have proof of acknowledgement by the bank on January 28, 2012.

“In spite of the fact that the technical facilities used for the World Cup belonged to NTA, Dokpesi presented a bill which varied from N5 billion to N3.5 billion between 2009 and 2010 to N8.047 billion.

“Records showed that ex-President Umaru Yar’Adua rejected the bill and the National Broadcasting Commission advised against the payment of such outrageous amount.”

Asked when the suspects will be arraigned in court, the source simply said: “Very, very soon.”

The Department of State Services (DSS) wishes to inform the general public that the Service has arrested two (2) out of five (5) of its Staff involved in the robbery and sharing, on 20th November, 2015, of the sum of three hundred and ten million naira (N310m) belonging to a Bureau De Change operator in Abuja. While three (3) of the DSS staff are now at large, the Military Authorities have commenced a detailed investigation of five (5) of its personnel involved in the crime.

Preliminary investigations have revealed that Abdulrasheed Ahmadu MAIGARI of the DSS, conspired with four (4) other colleagues of his namely: Solomon INUSA, Peter OKOYE, Patrick ISHAYA and George Mwatapwa IBBI, to carry out this reprehensible act. The five (5) military personnel were led by one Capt. Hussein Ishaku MSHELIA. Meanwhile, the Service has arrested MAIGARI and IBBI; and MSHELIA equally arrested by the Army authorities. Efforts are ongoing to apprehend those still at large. A total of Sixty-Six Million Four Hundred and Thirty Seven Thousand, Four Hundred and Forty-five Naira (N66,437,445.00) and Six Thousand Two Hundred Dollars ($6,200) have so far been recovered, while efforts are being made to recover the remaining amounts. It is to be noted that security agencies now act in concert, thus the joint investigation undertaken with the Police, Army and the DSS.

Those so far arrested have been suspended pending the completion of investigations. The Economic and Financial Crimes Commission(EFCC) has arrested eight consultants/contractors of the Presidential Amnesty Programme, Daily Trust has gather‎ed.

According a source in the EFCC the suspects arrested include: Kanmi Adediran, Tumo Yetunde. Collins Omokhojie, Oluboye Adedokun, Ugala Jaachinma, Olukoya Olusegun Godwin, Oyinmi-ebi Bribena and Olukayode Raimi.

Daily Trust learnt  ‎that they were taken into custody early today (Sunday) and are still being quizzed by a team of operatives at the Abuja headquarters of the EFCC.

The source further disclosed that the arrest of the suspects is in continuation of the Commission’s investigation of the tenure of Kingsley Kuku as head of the Presidential Amnesty Office. 

Kuku has been out of the country for health reason after news of the investigation was reported in the media.

Daily Trust gathered that the suspects are being grilled over issues of contract scam running into billion of naira, as their companies are alleged to have underperformed after collecting heavy mobilization fees from the Amnesty office. 

‎"In some of the cases, almost 95 percent of the contract value was paid the contractors, yet the structures on ground are a far cry from the amount collected," the source said.

It further said: "It is also being alleged that most of the contracts did not follow due process, ‎Among the contracts affected include the ones for the vocational training centres in Ondo and Bayelsa State."

Some of the companies fingered in the alleged scam include, Delse  Project Limited, Masterpiece Construction Company Limited, Eternity Consult Limited, Zomy Civil Construction Limited and Tolsega Consul Nigeria Limited. Others are Stracosplan, Sourme Global Creations limited, Riddle Construction Limited and Revelation Pact Limited

President Muhammadu Buhari has summoned an emergency meeting of the Federal Executive Council, (FEC), expected to consider the Medium Term Expenditure Framework (MTEF) ahead of the final preparation of the 2016 Appropriation Bill.

The Minister of Budget and National Planning Senator Udoma Udo Udoma told State House Correspondents yesterday at the Banquet Hall of the Presidential Villa, Abuja, that his ministry would this week approach council to seek for approval of the MTEF.

The Monday’s FEC scheduled for the Council Chambers would be second time the meeting will be holding after the inaugural one held on November 11, shortly after the Council was inaugurated by the President.

He said, “As you may know, this administration is introducing zero based budgeting, which means that every activity must be justified in accordance with the principles of the administration.

Vice President Yemi Osinbajo had said that government plans to use a zero-based budgeting format for the 2016 budget planning to achieve a policy driven approach to governance, especially the proposed social intervention policy of the administration.

The Vice President, himself made a brief appearance at a meeting at the Banquet Hall where he supervised the work of technical teams put together by the ministry to clean up the zero budgeting template, ahead of the appropriation document.

Udoma explained that the meeting at the State House was to give the officials handling the document cleanup all aspects of the document. We invited the Vice President who graciously accepted to come and see what we are doing. He said yesterday’s meeting would be followed up with bilateral, discussions with the various Ministries, Departments and Agencies.

According to the Minister, “We are going next week to seek approval from the council for the MTEF, after that we would then have hard numbers to give them. So, we are working flat out to make sure the budget is out before the end of the year.”

According to sources tomorrow’s council meeting, FEC will now hold when the pressing policy issues to discuss, unlike in the previous government the cabinet met every Wednesday.

The source, who pleaded anonymity because he was not authorised to speak told reporters that “FEC will no longer be all about awarding contracts but a serious discussion of policy issues and appraisal of ministerial performance”.

He said “in the past decisions on such matters as purchasing of cooking stoves and waste bins were discussed at FEC.”
