– Barrister (Dr) Anthony Orunkoya explains what the law prescribed – Dr Orunkoya says he will not in any way support the violation of anybody’s right under any disguise – The lawyer says there is nothing stopping the security agencies from still arresting Dasuki A human right lawyer, Barrister (Dr) Anthony Orunkoya, has reacted to the rearrest of former national security adviser, Col Sambo Dasuki by the Economic and Financial Crimes Commission (EFCC) over the alleged embezzlement of $2.1 billion arms procurement fund. Barrister (Dr) Anthony Orunkoya during the interview. Dr Orunkoya, who is the Africa president world alliance against terrorism, violence and inhuman treatment, explained in details what the law prescribes. During an interview with Naij.com, the legal practitioner was asked his take on Presidency Muhammadu Buhari alleged refusal to let Dasuki walk, he said: “Well I want to first correct the impression that Mr President, Muhammadu Buhari refused to let some people out of jail, I want to correct that impression, it is a misconception and a failure of our people to understand the way our law works and the way the judiciary also work.” Dr Orunkoya, who is also the national president movement for the survival of democracy, said as a human right activist, he will not in any way support the violation of anybody’s right under any disguise. He said: “But we must understand that there are procedures in court, certain persons were arrested, they were arraigned in court and were granted bail, they could not fulfill the bail conditions that was granted by the court, it took them some time, some days to fulfill the bail conditions, am speaking in respect of Col. Sambo Dasuki (rtd), the former national security adviser.” According to him, Dasuki was granted bail, he did not perfect the bail condition on that particular day, it took him some days before the bail condition was perfected, after the bail condition was perfected, he was rearrested not on the same reasons or the same grounds that he was arraigned before he was granted bail. “He was arrested for other reasons, and there is no law in our criminal jurisprudence that says once you are arrested and arraigned in court, you cannot be rearrested again or arrested again over other criminal issues. The law is so clear, if somebody is discharged in a criminal case, that person can still be arrested over that same case if it is just a discharge, if somebody is, however, discharge and acquitted, he cannot be rearrested and be arraigned over the same matter again, but in a situation where he was arrested, arraigned before the court, he has not even be discharge, he has not been acquitted, he was only granted bail and his bail condition was perfected and on stepping out of the court, the security agencies felt he has a question to answer on other issues,” he said. The lawyer noted that there is nothing stopping the security agencies from still arresting him to come and answer questions on those other issues, and for them to investigate those other issues to see if really he has case to answer over those other issues. “So that was what actually played out but people term to play to sentiments, he was arrested, he was arraigned in court, he was granted bail and they rearrested again, they are infringing upon his right. No! the court that even granted him bail, when the matter came before the court for it to look into the propriety of his arrest, the court said it cannot stop the security agencies from re-arresting him over other issues that are not connected either directly or remotely to the issue before that court. The court ruled that they cannot be stopped from arresting him to investigate him in respect of other complaints. For example, if a man is arrested for fraud of over N50 million and he is arraigned in court, and granted bail to go home and there issues to show the he embezzled another N200million, does he mean that the first arrest will now foreclose the second issue? It will not,” he said. An Abuja High Court on March 4, refused stay of trial proceedings sought by the former national security adviser Dasuki. Justice Peter Affen, in his ruling said the second defendant (Dasuki) has not convinced the court that the EFCC which its order of December 21, 2015 was made to disobeyed court orders. – The death over 300 people is causing serious concerns from President Buhari – The president embarks on a proactive measure following the deaths – Buhari sends condolences President Muhammadu Buhari has ordered an investigation into the clashes between herdsmen and four communities in Agatu, Benue state which left at least 300 persons during the past week, NAN reports. This was contained in a statement by Mallam Garba Shehu, the senior special assistant to the president, in Abuja, on Sunday, February 28. According to Shehu, President Buhari is in deep shock at the latest incident during the past week. “We will conduct an investigation to know exactly what happened; the only way to bring an end to the violence once and for all is to look beyond one incident and ascertain exactly what factors are behind the conflicts,’’ the statement quoted the president as saying. Buhari further stated that all Nigerians must learn to live together as one, in peace and unity. “We are all one nation and one people. “There should not be any reason why Nigerians of any group or tongue cannot now reside with one another wherever they find themselves after decades of living together.’’ President Muhammadu Buhari has ordered an investigation into the clashes between herdsmen and four communities in Agatu, Benue state. Buhari also expressed his condolences to the government and people of Benue, particularly the people of the Agatu communities. He assured the affected communities that the government would do everything possible to ensure that no such incident ever occurred in their midst again. “Once the investigations are concluded, we will act immediately to address the root of the problem,’’ he said. Naij.com recalls that about 300 suspected militants besieged Agatu community in Benue state last week. According to former Senate president, David Mark, who tweeted the incident via his official Twitter handle, an ‘army of militants has stormed the community. Days after, over 300 persons were confirmed dead following a siege on the community.

Nigeria is currently cash strapped but the federal legislators in both the Senate and House of Reps have planned to get exotic cars for reach members. Already, the Senate president and chairman of the national assembly, Bukola Saraki, reportedly took delivery of cars worth 330million naira. But in a report by Punch newspaper, the House which is yet to pick the brand of cars it intends to buy would make the purchase at the appropriate time. “Look, all these talks will not stop us from buying our utility vehicles. We haven’t bought the vehicles because there is no money yet. “We are going to buy the cars at the appropriate time. If a minister, who is junior in the order protocol to a legislator, has up to four Land Cruiser SUVs as officials vehicles, why do people think that just one Camry or Peugeot 508 is too much for a member? “What is the uproar about? That a member is asking to buy a Camry to use for oversight duties is too big?,” an unnamed legislator told the newspaper. Also, the chairman, house committee on media and public affairs, Mr Abdulrazak Namdas, said the House had neither ordered nor taken delivery of the controversial vehicles. “I think this car issue has generated too much hues and cries. The House has not bought any cars for now. We will buy cars and the public will know about it because there is nothing to hide, really,” he added. Meanwhile, the Senate president has dismissed claims that Saraki spent over N330million to acquire vehicles, stating that only the official vehicle of the Senate president, a MercedezBenz, was changed and that the spare car in the convoy is the old one he inherited which he has been using since he assumed office June last year. In a release through his special adviser on media, Yusuph Olaniyonu, on Saturday 27, Saraki faulted the reports that classified “vehicles provided for security agencies like the police and State Security Service by the National Assembly management for their operations as vehicles bought for the Senate President”.
