My friend you are not ready simple. It clearly shows you are not a professional. You dont bring sentiments into business.

I wonder why you are afraid of FBN. I am sorry but you are just wasting your time, because you dont have a case.

No sane human being or pro bono lawyer will enter this case.
.
You are right sir.
We know the option of the court is one of the options and not the ONLY option. Do you realise that you and I won't have this privilege to comment and get your views on this unfortunate situation if it is already in the courts? We are familiar with the Nigerian court system and know what we want is not court case, if they hadn't used our design, we would have quietly gone home, the problem is that they're using it without paying us and want to use their legal to explain the reason .
We believe there are still reasonable people in this land, must everything end up in the court?

@ op I don't think you are telling us the whole truth, because I see no reason why you dont want to goto legal dept and hear them out.
Please come, let us reason togerher sir. We are going to use a familiar experience we all have, if your tailor sews you cloth, delivers it to you and you ask him to come back for you to confirm to him that the sewn cloth fits you, the tailor didn't hear from you but sees you wearing the cloth everywhere and when he comes to you to collect his fee, is it legal unit in ideal situation you refer the tailor who has served you diligently to?
Our trust was clearly broken because they had used and still using the same logo we designed. If they had held on and not used our design and if it wasn't clearly after we protested, we would go to their legal unit.
Sir, referring us to their legal unit was an afterthought because we protested against such an unfair situation and we have been threatened subtly even by people who consider our small size and resources by reminding us if we think we are ready for 15 years case or have money for lawyers to do case for years against a big brand like FBN.
Sincerely,we are not ready. We just want to get paid for our Labour. Many people need to know this and learn from this our experience with FIRST Bank

This is quite sad and painful, but I hope you are saying the truth here! Are you sure you have an agreement of contract, claim of ownership that this logo was done by you? FirstBank will want to protect its name and if there are some flops on your part, they may sue every penny out of you.

If you have any proof or claim to back this up, I will advice you store them in a cloud storage apart from your system, get it distrubted that you can have access to it.

As someone rightly said, try meet their legal team to know what they have to say, don't just assume yet, give them a fair hearing but it will be good to lawyer at this stage.

If all things fail, try to reach out to TheCable, SaharaReporters, ThePunch or Instablog9ja...

The main point is that, I hope you are saying the truth, hope in your contract there is nothing like this or breach of contract... If not, you have a.good case
Thank you so very much for your valuable advice. We have noted them for follow up action. We have nothing to hide on this issue. If you consider how long between the day we posted this news here and constrained to escalate it now, you will bear with us and understand that we were truly constrained by the email from Mrs Folake Ani-Mumuney and First Bank. In particular the continuous use of the logo we designed which we see on a daily basis while they have not paid us and still want us to be meeting with their legal unit is a troubling psychological torture we don't wish on any small Nigerian brand.

Just seeing this and i think you might want to talk more on this matter maybe not just in a public forum thoo, you can reach out to me with hopes of getting this misunderstanding(i think) sorted out.
Thank you so very much sir. We have sent you a message.
Like we stated previously, we don't want to 'win' for the big brand First Bank to lose. As a matter of fact, until we started regretting the pain they have caused us so far,we appreciated the opportunity we have as a small brand to design their 125th Anniversary logo.
We just want them to pay us for designing their 125th Anniversary logo. We have been so much stressed by FIRST Bank on this issue and struggling to survive as a small brand. We are so not happy with how the bank and particularly Mrs Folake Ani-Mumuney treated us at all but still have the hope that fair minded people will step in to help prevail on First bank to pay us.
We don't want to do case even though we are the victim in this case, we just want to get paid for our intellectual property and move on.

Why wasn't there a watermark?? Even if there wasn't a part payment..
Very intelligent question. We are their vendor and this is the tricky part of the treachery. When we finished, while we are still on the discussion of our Bill, Fbn through Mrs Folake Ani-Mumuney requested us to produce small sample of about 100 ipad covers with the logo. We did to the best of our ability.
What we found strange until now is how Mrs Mumuney believe that the vendor job of supplying iPad covers we printed same logo we designed for them gives her and the bank a licence to use our intellectual property and then when we reminded them of our Bill, she refered us to legal. We have a reason to suspect it is a scheme from the onset to cheat us as a small brand.

First of all... Meet with their legal department to hear what they've to say.... Do that and revert back....... So it won't be you're just crying wolves when actually there's none.
***** meet the legal department first... Than if Na to stage protest and block their head office, me am solidly behind you. They can come and be killing small businesses anyhow
Thank you sir. We realised it was a ploy to intimidate and delay our payment because we found it strange why they would be using the logo and then send us to legal. If it was in good faith, the use of our design should have been on hold until we finish with their legal. Using our IP and sending us to legal because we demanded for our bill while they are using our design is completely strange and unjust if you look at it closely. Besides, at no time did we raise any dispute so. We gave our best and didn't see this coming at all. Like we said, everyone should learn from our bad experience with FIRST Bank.

I think you should at least get a lawyer to write them
Thank you sir. We actually did after much persuation by others who feel we are being taken for a ride and incurred avoidable cost in this regard but we have never hidden our desire not to take the legal route at least to await the outcome of parties we had sent to them to find out. Even this route is already a constraint on us as small company and brand.
We just want to get paid for designing that logo. Foreign brands won't treat their indigenous brands like this.Even if they don't want to recognise our contribution officially, they should just pay us.

Go to the court if you are sure of all you claim and there is no Question mark in your agreement with them (which they can manipulate).

Someone was just awarded 5million naira against Mtn notwitstanding the legal infrastructure you are scared of.
"Won" is not the same as paid. We don't even want to 'win' because that would mean they lost. We just want to be paid for our intellectual property. Nothing more.

Why are they refering your brand to the legal department, there must be a reason for that which you are not telling us!
We are still as clueless on this as you.
We honestly don't know and that was why we had to send emissaries. We suspect it is the same way others may have been treated. You create, instead of paying, you are refered to legal unit so you back off since we can't match their kind of legal infrastructure.
We have maintained that we don't want that route. In fact, this option is our way to get help for them to pay us. Not an attempt to smear them. Our focus is pay us for the logo we designed and you are using for your big brand First Bank.

This is serious.
They are still using the same logo we designed(screenshot of their Twitter page and picture of their MD, Dr. Adeduntan presenting a package, carrying the 125th FBN logo we designed,to Senator Alasoadua are shown below).
We have not being paid yet she Mrs Folake Ani-Mumuney sent us to their legal unit.
Every email we send and even enquiry from Mrs Folake Ani-Mumuney by everyone we sought their help to intervene, she kept referring us to the legal unit(screenshot of her email reply)
Meanwhile, we can't pay our own bills.
Please help us tweet at them to beg them to pay us.
We are a small brand and admit that we can't match their kind of resources in Nigeria's legal system. We hardly pay our own overheads let alone paying for protracted legal case in Nigerian courts.
We just want to get paid for designing their 125th Anniversary logo. Nothing more, nothing less. We are ready to meet with their account unit not legal because we don't have business with their legal unit.

Who we are:
We are xtremecr8tivity.An indigenous small sized Nigerian company.

What we do:

Our True Passion. We are experts in creativity, our true passion lies in using the brightest ideas to strategically connect brands.

Our Plea:
That first bank pays us our bill for creating their 125th Anniversary logo. We are a small brand, don't have the deep pocket financial resources for court cases that takes so much money and years to conclude. After they pay us for this job, we will think twice before creating IP works for First Bank.

Our Campaign:
We beg and solicit for your support to help us beg the big brand First Bank to pay us. We call first bank out over its insistence not to pay us for their 125th Anniversary logo we designed.
@First Bank breached our Intellectual property rights and wants to get away with it.

Using a 125 years anniversary logo we designed and refusing to pay us is not the best way to celebrate.

Background is explained in the video and newspaper report below:

We worked hard to create the logo and when it was time to pay us, instead of paying us or referring us to accounts unit to discuss our bill, they refered us to their legal unit.Yes, we know we don't have money for 15 years case. We are small brand. And we hope other small brands will learn from our experience with big brand First Bank.
