@ IFFy Whatever agreement between you and your husband before entering the fold of Islam is not acceptable Islamically I suggest to go to the Mosque and get married again according to Islamic rules To your second question if your husband defects after the agreement and take second wife you can't just go and marry someone else right away you have to follow the procedure : -Take the agreement with you and your 2 witnesses to the QADI (Islamic judge ) and he should be able to approve the divorce instantly if every thing in order after approval you have to wait 3 months period b4 you be able to marry someone else your husband and the second wife if they are married according to the rules of Muslim marriage their relation is not considered as adultery Yes the contract of Marriage to be acceptable need 1- 2 witness 2- wakil ( guardian or representative that the woman choose ) 3- Mahr (dowry) 4- couple consent to marry 5- AQD |

Brother you get it wrong and what you said has no base in the Koran nor the Hadith and it is not in tune with mainstream views and Islamic teachings To answer you second point I am not confusing two things maybe you the one who are not comprehending what I said and it is Ok I never said and won't say that the polygamy is haram what I said was crystal clear that the verse of the polygamy has two components one legalizing the polygamy and the other one stressing the preference of having one So here you should know that the pre nuptial is permissible and to you I say no one can make haram what is halal I will be glad to accept from you any verse or hadith that say otherwise on other hand the Muslim scholars have basic rule saying the essence of everything is to be halal unless there are verses or Hadiths to say otherwise Regarding the Polygamy I can understand if someone from a polygamous background can take the issue personal but not to extent of mischaracterization from what I understand from you the aim of the verse in your view is only for men to marry two three or four The verse of polygamy came in time where the Arabs can take as many wives as they want some of the companions of the Prophet PUH had up to twenty wives so the aim of the verse mostly was to outlaw this practice and to put a limitation to the numbers of wives one can marry The companions of the Prophets PUH and his KHALIFS Abu bakr Omar Ousmane and Ali never rush to get more wives and by the way none of them were in polygamous marriage neither the daughters of the Prophets Zainab, Rakiyyah, UM Kelthum or Fatima Zahra The verse 3 of surat Al Nisa gives permission of polygamy to man but it restricts the maximum numbers of wives at four the permission is also subject to the provisio that the husband must do justice with all wives "ADL"or Justice used in this verse has not been defined however all commentators of the Koran unanimously hold that justice in this verse means equal treatment i n food clothing and lodgement but some consider that in addition to food clothing and lodging there must be equal treatment allotted for love and affection also The Koran in its verse 129 surah Al Nisaa holds that you can't deal equally with all your wives however much you wish from this veridict of the Koran ( which is in fact true statement of human nature ) and the linking of the permission with the condition of justice some scholars believe that monogamy is the rule in Islam while polygamy is the exception |
@zayhal I beg to differ with you most scholars agree that the Prenup agreement between the bride and groom is permissible no scholar ever issued a "fatwa" against it include the ones from the Hanbali school of thought known to be the most rigid and fundamentalist According to most scholars Prenuptial agreement can give more strength to the Islamic marriage contract it can also include That both wife and husband will share responsibility of cooking and others homemaking stuffs Husband will not excercice his option for a second wife Children will be raised as Muslims in home and through Islamic education Children will not be taken to church Family will not move outside the country without mutual agreement Upon that agreement both parties must fulfill their agreement Allah said "And those who fulfill their pacts when they make one "Albaqarah 177 In other ayat He said "O who you believe fulfill your contracts " Almaidah 1 The Prophet Pbuh said "Muslims are bound by their stipulations "( ABu dawud and Alhakim ) To you second question asking is there any history to point that a Husband held this prenuptial agreement and upheld it ? I will say yes and it was during the time of Omar Ibn Alkhattab Second khalif of the Prophet Mohamed According to Alkurtubi A man married a woman upon the condition that he wouldn't move her from his house the time came when he wanted to move her they took their dispute to Seyidna Omar who said to the man "your wife has the right to her stipulations " the man said in this case we will end the Marriage Omar said the rights are broken off due to the stipulations this view maintained by his successors and scholars including Saad Ibn Waqqas Muawiyya Amr Ibn Al as and many others companions To answer your last question regarding the prenupt for already married woman is it possible ? I anticipated someone might ask me this question that why if you go back to my previous post you will notice I mentioned that the clause regarding the second wife must be included before the Marriage and not after For a married woman she can't divorce in case her husband take a second wife because there is no Agreement between them before she enters the Marriage so the only opportunity for her to enter in new Agreement is in case her husband divorce her and after her ''idda'' (3 months waiting time period after the divorce ) if she want to go back to him so in this case she can ask for prenuptial agreement because they have to do a new Marriage with a new Aqd and dowry |

In that regard Allah said "And not approach the property of an orphan except in the way that is best until he reaches maturity and FULFILL EVERY COMMITMENT INDEED THE COMMITMENT IS EVER QUESTIONED Koran 6:152 Also the Hadith of the Prophet PUH stressed same view ''The First and worthiest condition of Marriage to be fulfilled by the Husband is to keep his promise or promises he made to his wife at the time he married her "((Bukhari) You asked what if the Groom dies who is gonna pay the remaining dowry ? If the Groom died the Mahr (dowry) must be paid up immediately to the widow before his inheritance or others financial settlements are considered the dowry is her property and not his if he he died broke his family has the obligation to come up with the remaining part Once again I reiterate to you that the husband has the financial responsibility of his wife even if she is rich this duty is known by every Muslim man and can't be a subject of disagreement or doubt for the simple reason that it is mentioned in the Koran "And they (women)have rights over their husbands as living expenses .)similar to those of their husbands over them as regard obedience and respect to what is reasonable but men have degree of responsibility over them and Allah is ALL MIGHTY ALL WISE "Koran 2:228 So yes Madam I am sure of this and so should be every Married Muslim man so I believe in it and practice it In Islam not taking care of all the wife expenses could be a ground for her to divorce her husband same as in mental cruelty, adultery ,desertion Incurable insanity long term imprisonment physical abuse and abandonment of Islam Last assuming the husband is unemployed or broke so what happens ? There is no difference whatever the husband is broke or unemployed the wife is not responsible of any financial duties towards the house (husband and children )because Islam didn't task her for such duties Yet Islam said it is recommendable for women to take part in the expenses out of ethical values and for the sake of social integration within the framework of the family unit so it her call and choice not her duty or obligation |

"And among his signs is that he created for you mates from among yourselves that you may dwell in tranquility with them and he has put love and mercy between you (hearts) verily in that are signs for those who reflect "Koran 30:21 In principle prenuptial agreements are accepted in Islam both spouses are allowed to have prenuptial agreements once is done it becomes binding upon them the violation of an agreement is forbidden in Islam however the terms of the agreement should not be against the teaching of Islam A great deal of heartache can be avoided by women in her marriage if she is as the bride to be agrees to and signs a carefully considered prenuptial agreements I think the prenuptial should focus mainly on those points which have bearing on protecting women rights 1-Polygamy :if a woman doesn't feel she can allow her husband to marry more than one woman at the same time then Islam allows her the right to refuse him permission to do this at the outset of their marriage however she must indicate this preference in the prenup Agreement or she will forfeit this right under Islamic law 2-Ma hr (dowry) Ma hr is a gift from the groom to the bride of either fixed financial amount or Property and usually given immediately at the time of the marriage however the woman can ask some of it may be deferred until later time where it will be payable to the wife either upon the death or divorce of her husband 3-Financial Independence According to Muslim family Law the responsibility of the wife maintenance (Nafaqa)always remain with the husband the wife has no corresponding obligation to support her husband in Islam the woman property is hers alone Period and it is not subject to division or sharing with the husband in the event of marriage break down this clause should be included in the Agreement especially if the couple live in the west where some law require the couple to split their assets in case of divorce The Koran lays down rules set out in the Koran that are essentially simple if applied and above all it enjoins people to write a will for the equitable disposition of their assets after their death however the Person is restricted to willing a maximum of one third of his estate and mainly to others than his legal heirs The inheritance laws in the Koran are to be found mainly in chapter 2 of Albaqara and chapter 4 An Nessaa a total of 14 verses there are several verses that relate indirectly to inheritance such verse 106 through 108 in chapter 5 in Almaa idah which dictate that the will be witnessed by two witnesses other verses deal with the administration of property of infants |
