Procedure:
1)Seller & Buyer sign the Sales and Purchase Agreement (SPA) and lodged with their respective banks. The SPA will be exchanged by Electronics Data Transmission EDT and will be considered as legally binding and enforceable.

2)The Buyers bank sends a letter to the Sellers bank via secured Fax or Email to confirm the Buyers Readiness, Willingness and Ability (RWA) to purchase the cargo (By swift) and the RWA verbiage is at the end of the SPA/contract.

3)Upon sellers confirmation of Buyers RWA, the Sellers Vessel Master positions the loaded vessel at Ghana international waters. The vessel captain declares their presence to the Ghana Port Authorities and sends a copy to the Buyer for confirmation.

4)Buyer provides Seller with Buyers Authority to Board (ATB) Format, which must include a photocopy of the passport data pages of Buyers Supercargo and nominated Inspector along with Tugboat/Helicopter details, if any and receipt of inspection fee to any inspection agencies of their choice preferably SGS Geneva or their affiliates in Ghana.

5)Vessel master issues a confirmable Marine ATB and Buyers Inspectors board the loaded vessel for Q&Q inspection at Buyers expense. 

6)Upon successful Q&Q verification and conclusive positive results, the Buyers bank issues via Swift MT103 for the total value cargo to the Sellers bank and commission accordingly to Intermediaries banks.

7)Seller confirms Buyers Swift MT103 and introduces the Buyer to NNPC Local Vessel Handler for proper vessel re-charter processes.

Seller releases all transaction documents in Buyers name to Buyers bank for payment.

9)Buyer instructs his bank to wire payment through KTT/SWIFT Wire Transfer directly into the Sellers nominated bank account and Facilitators/Intermediaries bank accounts within 72 hours.

10)The loaded vessel is allowed to sail to the Buyers nominated Port of Discharge.

NOTE: The success of any oil deal is in the procedure. Always pay attention to that. The bank cost of writing an RWA and sending it by SWIFT is about $68. The bank will not write it if Buyer does not have 100% funds for the deal in his account. Based on the verified RWA, seller now moves loaded vessel to Ghana waters. When he arrives Ghana waters, he declares himself or his presence known to Ghana government. Its legal and works.
