The person of interest arrested in connection with the shooting of a Texas state judge has been identified as a defendant who she was prosecuting.

Chimene Onyeri, 28, was detained in Austin on Monday on suspicion of a recent theft in Louisiana.

Police also believe he played a role in the shooting of State District Judge Julie Kocurek, who suffered an 'extremely serious injury' when she was shot in the driveway of her Austin home on Friday night.

Onyeri was in the process of being prosecuted by Kocurek in a fraud case from 2012.

He will now be questioned about the shooting as he is indicted for the Louisiana theft.

Kocurek had been receiving threats after presiding over controversial cases.

She was taken to hospital in a serious condition on Friday and has since been upgraded to a stable condition.

Police said her injuries are not believed to be life threatening.

They refused to comment further on the arrest.

Kocurek's neighbor said she 'just heard four pops', according to the Austin American-Statesman.

No one else with Kocurek was shot.

Dozens of police officers searched the area following the shooting, which was reported at 10.16pm, and interviewed neighbors.

Crime-scene tape was seen around a white SUV in front of the judge's Scenic Drive home, where a security gate cuts across the driveway in the neighborhood of $1million and $2million homes.

Kocurek is the presiding felony judge of the 390th District Court for Travis County and was formerly a prosecutor.

She was appointed by then-Governor George W Bush in 1999 and was the only Republican elected to a state district judgeship in the heavily Democratic county.

In 2006, Kocurek switched to the Democratic party.


The judge is currently presiding over the case of Samantha Dean, an expectant mother whose accused killer is a former Austin police officer, according to KXAN.

VonTrey Clark is currently awaiting trial.

Kocurek was also recently overseeing cases related to a man convicted of killing a woman and charged in the death of another, as well as one involving a mother who kidnapped her daughter.

Mark Norwood is set to go on trial for the 1988 murder of Debra Baker this month. He is already behind bars for the 1986 murder of Christine Morton.
