Justice Lateef Lawal- Akapo of an Ikeja High Court has sentenced a court registrar, Mrs. Oluronke Idowu Rosulu to 20 years imprisonment for defrauding a former Chief of Army Staff, Lt. Gen. Ishaya Bamaiyi of $330,000 over a non-existent business. Rosulu who until arraignment was a registrar with the Lagos judiciary, was convicted by Justice Akapo for her role in the $330,000 fraud perpetrated against Bamaiyi alongside others still being sought.

She was arraigned by the Economic and Financial Crimes Commission (EFCC) on a two count charge of conspiracy and obtaining money by false pretence following Bamaiyi’s petition that Rosulu aided a Lagos socialite, Fred Ajudua to swindle him of $330,000 on the pretence that they would get him a lawyer in an attempted murder case he faced some years ago.

Although Bamayi was discharged and acquitted of the alleged attempted murder case preferred against him by the Lagos State Government, he swiftly petitioned the EFCC, alleging that he had been swindled by Rosulu alongside others of $330,000. In his judgement yesterday, Justice Akapo who formulated three issues for determination concluded that the convict was guilty as charged.

The issues, according to the judge were ‘whether or not the prosecution has proved its case; whether or not the prosecution has proved the case of obtaining money by false pretense against the defendant and whether or not the defendant had validly and properly set up the defence of “alibi” and whether it can be sustained.

All these, Justice Akapo resolved against the accused person. On the first issue, the judge held that the prosecution has indeed proved its case owing to the submissions of the second prosecution witness (PW2), ACP Garuba Abdullahi, in his evidence contrary to the view of the defence lawyer, Bamidele Ogundele that conspirators in a conspiracy charge need not meet physically to achieve their intentions.
