An 18-year-old Disc Jockey, Ugbede Iyeh was on Thursday remanded in prison custody by the Lokoja Chief Magistrate’s Court 1 for allegedly killing his friend, Ikani Amodu, with a pestle.

Mr. Levi Animoku, the chief magistrate who gave the order in his ruling after the arraignment of the accused in Lokoja, Kogi State, said the count of culpable homicide preferred against the defendant and the manner in which the act was allegedly committed was horrifying.

The police prosecutor, Sergeant Tuesday Ganagana, told the court that the case was reported to the police by one Samson Ebenehi, the elder brother of the deceased.

It was alleged that the accused had on August 28, at about 8am, gone to the shop of the deceased, who was a barber, to download some music from the deceased’s laptop.

The prosecutor said the accused in the process deleted all music in the late barber’s laptop, which caused a misunderstanding between them.

He added that in the ensuing altercation, the accused “criminally took a pestle and hit the deceased on the head.”

“As a result, the barber fell down and became unconscious and was rushed to Peace Hospital, Anyigba, for treatment, but was confirmed dead on arrival,” Ganagana said.

The prosecutor submitted that investigation into the matter was still ongoing, pleading that the court should adjourned till another day.

He reminded the court that the offence of culpable homicide, under Section 221 of the Penal Code, was not bailable and therefore, urged the court to remand the accused in prison custody.

Animoku said the offence carried the highest penalty “in our law. Bail is not granted as a matter of course as Section 341(1) of the Criminal Procedure Code precludes the court.”

“The accused shall be remanded at the Federal Prison, Dekina. The case is hereby transferred to the Chief Magistrate Court, Dekina,” he added.

He also adjourned the case till September 27, 2016, for mention.
