Any website or mobile App operator should have its own “terms of service”, “Terms Of Use” or “terms and Conditions”, these gives the users the conditions under which the suite or App is to be used.
This document is an effective contract between you, the operator and the User, it governs your relationship over the use of the website or App.

So, it’s very important, to say the least that the user should affirmatively accept the terms beforehand.
Most websites or App stipulates the users must agree to the terms of service before registration or purchase and also provide a link to the terms and service.

Once such user has affirmatively accepted the terms of use, it very important that such record of acceptance be kept for future purpose or as evidence. Some, Operators, even go as far as sending users email confirmation of acceptance, then including in it the terms of service and then archive such email as proof of acceptance.
Terms of service is a tool used to shield the website, company, App from litigation, liabilities and so on, to the user.

          Change Of terms Of Service

Any form of change or variation in a pre-existing terms of Service agreement which users already signed originally, it must, as a rule be brought to the notice of the user and must be by agreement, to accept or decline.

Such new terms of Service is necessarily a new contract between user and operators. The user have to go through the process the process of accepting the new terms of Use for it to be binding on him. Such operator may notify the user of the change in terms of service and that such continuous usage after a reasonable stipulated time constitutes acceptance on the part of the user. If the user continue using the website or App after such time,stipulated in the notice, such new term of use is binding on the user.
