In less than two hours, supporters of no fewer than 10 members of the National Assembly yesterday watched in disbelief as the eye popping judgment of the Election Petition Tribunal in Katsina State stripped their lawmakers of their victory in the April 9 poll.

They are two senators and eight House of Representatives members elected on the platform of the Congress for Progressive Change (CPC).

One of the upset recorded at the tribunal brought smiles to the daughter of late President Umaru Musa Yar’Adua, Mariam, candidate of the ruling Peoples Democratic Party (PDP) in Katsina Central Federal Constituency and nine others, who urged the panel to swing victory in their favour.

The Justice S. A. Akinteye ordered the Independent National Electoral Commission (INEC) to conduct a fresh election in each of the constituencies within 90 days from the date of the judgment.
Other titans of the PDP whose petitions were upheld included Senator Ibrahim Ida (Katsina Central Senatorial District), Senator Kanti Bello (Katsina North Senatorial District) who left Senator Ahmed Sani Stores and Senator Abdu Yandoma beaten to a tight corner.

The House of Representatives members who could not surmount the challenges that trailed April 9 victory are Umaru Abdul Dankama, Murtala Isah Faskari, Muntari Dandutse, Amniu Ashiru Bindawa, Umaru Adamu Katsayan, Mohammed Tukur and Tasiu Doguru. The blanket failure of the CPC lawmakers to wrigle out of the petitions against them, according to the tribunal, was grounded in an earlier judgment of the Appeal Court, which held that they were neither validly nominated nor sponsored by the opposition political party to contest the April poll.

The panel also dismissed the allegations of the lawmakers that it lacked the competency and the jurisdiction to entertain the petitions because they were based on nomination of candidates, which, they insisted, remained an internal matter of their party. The tribunal upheld the submission of counsel to the petitioners, Uyi Igunma and Mustapha Abubakar, contrary to the stance of the respondents counsel, Festus Okoye, that the petitions were properly brought before it and it had jurisdiction to entertain it.

The justices however refrained from awarding automatic victory to the PDP standard bearers, saying that would deny the electorate the right to elect the candidates of their choice. Reacting to the judgment, Uyi Iguna said they would be magnanimous in victory by refraining from demanding for cost against the lawmakers, but his counterpart, Okoye simply thanked the tribunal for its tolerance and asked when they could get copies of the verdict.

When a Federal court of Appeal decision is challenged at Supreme Court, does the Appeal Court decision still stand in judgement or it is deemed null until the verdict of the supreme court is known?, I need a lawyer's opinion please

Also, are election petition tribunal suspose to hear pre-election matters?

This judgement appears to be based soley on the COA decision which is been challenged at the Supreme Court and the question the begs for answer is; Should INEC conduct the re-run and the Supreme Court rule in favour of the CPC legislators, what happens to the new legislators who will emerge from the re-run?

Governor Rotimi Amaechi was a beneficiary of a similar kind of judgment, and we were all happy for him. I think all parties should get thier internal politics right, after all it was late President Yaradua who encouraged due process.

Well we all want is due process and due process has taken its full charge and delivered judgement so be it. If CPC are not satisfy with the ruling they can appeal the ruling. What is applicable to PDP, ACN, ANPP and others is also applicable to CPC its all about due process and fair judgement as some would say if it were to be a reverse case or other party involved.

one party system and that is the target of this administration.
we were here when jonathan appointed jega we all watched him give out well over N80B naira for what nigerians and observers call the most free and fair elections in the history of man. today 8 has been sacked and that is in the area where pdp lost. who said boko haram is not good? my take against boko haram is that they target innocent and poor nigerians leaving these criminals (politicians) to be enjoying our national funds. tinubu, the only strong oposition of pdp from the west is in court while cpc the northern oposition is facing tribulation yet in the hands of pdp. any judge that is not working for pdp faces the axe and we all seat and watch just few men that are above the law use us as tools.
i am from imo state but i am ready to die if that will bring pdp down and send all these devils' incarnets to jail or grave.
why is tinubu a gov facing tribunal when all the federal excutive members who are pdp members are not answering any case anywhere even in the presence of siemens, harliburton and numerious scandals in the country.
did tinubu and cpc give out contracts on our federal roads? did tinubu gave out us$16B electricity contract?
it is a shame that nigerians are not ready to stand up against these mini devils as we are seeing in egypt, tunisia, algeria and libya.
God will punish all of them and their families for all these deciets, betrayals and lootings exposing us the masses to unquantifiable sufferings and pains.
