Just imaging. Those that desecrated the supreme court are now turning around to advice how the law should be upheld. Rubbish.

When you were there you took bribe to arm twist the law.

Now the monster you and your colleagues alike created doesn't make sense again.

If the supreme court were not laden with corrupt Judges I don't think Buhari would have had the effrontery to put a Sharia judge like Tanko there. He wouldn't even dare.

I want to believe the learned judge has been misinterpreted

Stare decisis does not apply to the Supreme Court. It is the only Court that can do and undo and in fact, it is trite principle of legal interpretation, that laws must be interpreted in the context of changes in the climes.

The learned justice could not have made the statement attributed to him.

The points he noted that affected the weak and the poor I liked.
- Convicted persons should be made to serve after being convicted. Many people are locked up in prison without trail for a year or more which isn't appropriate.

- Also the right of Female child to inheritance to their fathers wealth. If possible too the right to inheritance of a child born out of wedlock. ( some call it illegitimate child)

- National security must be visibly threatened before suspending the rights of an individual. If only they can apply this the nation wouldn't have been in this era of insecurity.

Justice Vivour is correct.The people of Nigeria should be hailed for swallowing the courts ridiculous judgements without violent reaction.

The supreme court judge are members of political parties just like the army chiefs. Some are radicals.

Take a look at the court order to enforce hijab in missionary schools.You will understand why some court judgement don't make sense again.

1.) He, therefore, recommended that the Electoral Act should be amended to shift the burden of proof to INEC to prove that it conducted a fair and reasonable election.

2.) He however made a U-turn on Monday, stressing that national security must be visibly threatened before anyone is denied his rights.

3.) The retired jurist said he had in his verdict in Ukeje V Ukeje (2014) 11NWLR (Pt. 1418) P. 384, held that “a customary law which disentitles a female child from partaking in her deceased father’s estate, is in breach of section 42(1) and (2) of the Constitution, a fundamental rights provision guaranteed to every Nigerian.
“The said Customary law is void as it conflicts with session 42(1) and (2) of the Constitution.
“Female children are entitled to an inheritance”, he added.

4.) On the issue of convicts, Justice Rhodes-Vivour said he was of the view that they should be allowed to serve their prison terms only after their appeals are exhausted.
“The reason being that some convicts serve several years in prison before their appeals are heard and decided.
“Their appeal may be found to be meritorious. They are then released. No compensation paid for the time spent in prison”.[/b]

Head or tailed, the supreme court have entered a political culdesac with its judgement on Imo guber case.Hence, whether it reverses itself or not, the reputation of the apex court have been bastardized already.

Justice was badly dispensed thus giving rise to a judicial logjam this case will forever be referred to in generations to come.
