and the ruling on over voting brought up by oyetola, The BVAS quoted by the judges in this instance was on the incidence of over voting, accreditation

The Electoral guidelines for Osun elections is purely different from the electoral guidelines for the February elections. In the electoral act, INEC determines the mode of transmission. In the February elections, INEC chose the electronic mode of transmission in its guidelines and jettisoned it in the middle of the game.

Hehehe! Why are the APC and their e-rats so scared of their own shadow? This is have they have made brazen lies, deception, and propaganda official policies of government in a 21t century world.

Why is it that it is anything APC that have been speaking for INEC on the transmission of election results while the amended electoral Law have long bind into do so electronically. INEC have no choice about that.

Meanwhile INEC national went to Chatham House last year to reassure the whole world that it would ensure the electronic transmission of election results right from the voting Centre till the collation center. Hence when that failed to happen, Chatham House called out INEC with a screaming headline "INEC failed to abide to its own electoral guideline"

INEC have even issued a press release prior to the election to debunked the allegations that it won't transmit election results electronically. So why is the APC running like headless chickens frying in futility to defend INEC? Why is the APC sore afraid of this concept that will enhance our electoral/democratic processes even in a 21st century world? They are also scare of live transmission of the tribunal proceeding. They must be under a spell.
Even with the results uploaded on the IREV APC still won with large margin

INEC guidelines can't supersede the electoral act and the constitution below is the section 60 you mentioned and no where it says electronically transmitted.... in law you can't do anything outside the Act and constitution.

unit, enter the votes scored by each candidate in a form to be prescribed by
the Commission as the case may be.
(2) The form shall be signed and stamped by the presiding officer and
counter signed by the candidates or their polling agents where available at the

officer where available a copy each of the completed forms after it has been
duly signed as provided under subsection (2).
(4) The presiding officer shall count and announce the result at the
polling unit.

of accredited voters and the results of the ballot in a manner as prescribed by
the Commission.
(6) A presiding officer who wilfully contravenes any provision of this
section commits an offence and is liable on conviction to a fine not more than

Go read this piece to educate yourself better oga. What Exactly Did The Electoral-Act-2022 Say About The Election Results.?

Section 149 of the Electoral Act says: Notwithstanding any other provisions of this Act, any defect or error arising from any actions taken by an official of the Commission in relation to any notice, form or document made or given or other things done by the official in pursuance of the provisions of the Constitution or of this Act, or any rules made thereunder remain valid, unless otherwise challenged and declared invalid by a competent court of law or tribunal.

Meaning whatever a competent court (In this case Appeal court and or Supreme court) declares on this issue overrides the the act and becomes the new law.

So if the supreme court says INEC is at liberty to use any means to transmit their results, and the same INEC chose to transmit manually, it doesn't matter what their guidelines say anymore, their decision is final.

Law is law, no matter how you want to interprete it, when we reach court right interpretation go suffice. Judges are not biased or sentimental. The law can not jeopardize or contradict itself...I laugh at people who say Abuja votes are special, when our constitution clearly says, "all votes are equal".

Secondly, The Labour Party and PDP petitions are centered on BVAS not IREV.

Again, BVAS exposes Over voting while IREV exposes votes manipulation and reassignment by criminal minded INEC agents and APC didn't contest vote reassignment as in the case with LabourParty petition

INEC is bound by the Electoral law and it's election guidelines to transmit results electronically. The INEC chairman made that point clear severally at different foras that the results of the 2023 general election, i.e polling units results will be transmitted electronically to the IREV real time on the election day

This judgment was intentional so as not to set a precedence for the presidential tribunals!

They needed to be very careful!

That being said, the summary is you can spend all the money on fancy spancy technology and big big names but if the system is corrupt, you might as well not bother!
