The Electoral guidelines for Osun elections is purely different from the electoral guidelines for the February elections. In the electoral act, INEC determines the mode of transmission. In the February elections, INEC chose the electronic mode of transmission in its guidelines and jettisoned it in the middle of the game. 3 Likes |

Ofunaofu: INEC guidelines can't supersede the electoral act and the constitution below is the section 60 you mentioned and no where it says electronically transmitted.... in law you can't do anything outside the Act and constitution. [/b]Section 60.—(1) The Presiding officer shall, after counting the votes at the polling unit, enter the votes scored by each candidate in a form to be prescribed by the Commission as the case may be. (2) The form shall be signed and stamped by the presiding officer and counter signed by the candidates or their polling agents where available at the polling unit. (3) The presiding officer shall give to the polling agents and the police officer where available a copy each of the completed forms after it has been duly signed as provided under subsection (2). (4) The presiding officer shall count and announce the result at the polling unit. (5) The presiding officer shall transfer the results including total number of accredited voters and the results of the ballot in a manner as prescribed by the Commission. (6) A presiding officer who wilfully contravenes any provision of this section commits an offence and is liable on conviction to a fine not more than N500,000 or imprisonment for a term of at least six months.[/b] 4 Likes |

Racoon: Section 149 of the Electoral Act says: Notwithstanding any other provisions of this Act, any defect or error arising from any actions taken by an official of the Commission in relation to any notice, form or document made or given or other things done by the official in pursuance of the provisions of the Constitution or of this Act, or any rules made thereunder remain valid, unless otherwise challenged and declared invalid by a competent court of law or tribunal. Meaning whatever a competent court (In this case Appeal court and or Supreme court) declares on this issue overrides the the act and becomes the new law. So if the supreme court says INEC is at liberty to use any means to transmit their results, and the same INEC chose to transmit manually, it doesn't matter what their guidelines say anymore, their decision is final. 8 Likes 2 Shares |

Law is law, no matter how you want to interprete it, when we reach court right interpretation go suffice. Judges are not biased or sentimental. The law can not jeopardize or contradict itself...I laugh at people who say Abuja votes are special, when our constitution clearly says, "all votes are equal". 6 Likes |

This judgment was intentional so as not to set a precedence for the presidential tribunals! They needed to be very careful! That being said, the summary is you can spend all the money on fancy spancy technology and big big names but if the system is corrupt, you might as well not bother! INEC needs to do better! They are compromised |
