Good. Examples of attorneys for industry professionals are

https://www.hooyou.com/
https://messersmithlaw.com/

There are others but I know industry professionals, engineers, accountants that have successfully used those two above.

What of Vesti Naija Fintech? How good are they?

Hello everyone, I have done WES evaluation but I have not received the report yet. Is it possible to include unofficial WES evaluation report, which I downloaded from my dashboard, along with my EB2 NIW petition? I chose standard delivery method while applying for the credential evaluation.

Pls can someone help me with the link for any telegram group for EB categories?

Well done with doing the evaluation. Standard delivery will mess you up if your delivery address isn't a US address and it may never arrive (mine did not arrive till date, since June 2022).
I suggest you re-order the report using a US address and Standard delivery or pay the courier fees, which is of course higher and deliver outside the US with ease.
Best wishes.

Thanks a lot. Initially someone told me that WES send electronic copy, so I decided to go for the standard delivery method, not knowing that the electronic copy is unofficial. I will re-order the report using the US address (with help of a friend), as suggested. Thanks once again.

Friends,

Do you have any idea on when PD date of November 14 for EBE-2 NIW category may become current. It appears it might be a long ride

Guess you mean Nov 14, 2023. Well, just to give an estimate...don't hold me by my words, only NVC knows better.
By next VB (April 2024), it should move up to 3 months - Feb 21, 2023 (new quarter, as it looks like NVC allows more movement of the dates quaterly). Then a week movement each for May to June 2024 VB (let assume a month movement, which takes the date to March 21, 2023. Then July 2024 VB, we anticipate 3 months movement again, which can take the date to June 2023....then the trend continues

Hello all. Greetings… first time here. I need a little clarification with the EB2 notice of action letter (approval) that we got (hubby is the petitioner, I’m a derivative beneficiary)
It says “the petition has been approved. The petition indicates that the person for who whom you are petitioning is in the United States and will apply for adjustment of status”
Then the part that shows consulate has “NVC”

The concern here is, we didn’t indicate that we were in the US. We indicated consular processing. So it’s confusing why the letter says otherwise. And we still haven’t gotten any welcome email from NVC.
Priority date is 4th Jan 2024.
Is there anyone that is also filing from Nigeria with this kind of letter? Cos we checked online and saw that those doing consular processing has a different worded letter.
Someone please help 🙏🏼

You can write to NVC regarding any issue and they will respond to you.

Hello Everyone,

I am a newbie. Just need clarification on the advanced degree for the EB2-NIW.

My question is that I have MSc Finance and BSc Statistics. My job duties in the last 10 years has been in data science field with current 5 years in government establishment as a data scientist. I am planning to go through route of Advanced Degree (MSc Finance). Does the MSc degree have to relate to:

1. My work experience? or
2. the proposed endeavour?

Thank you.

Not compulsory to include undergraduate transcripts. Although, I included that in my petition. Since undergraduate awards or scholarships would add flesh to the petition, it is not bad to include undergraduate degree.

As mentioned somewhere on this page, You can you the International Education Evaluation (IEE) for your degree evaluation. With IEE, you can include all degrees at the same cost, and you don't need to send any official or hard copy transcripts; all you need is the pdf of your student copy or any copy you have. Also, it is very cheap and fast. With 80 USD or so and within one week, you are done. They will mail you the pdf of the report.

Hello guys, I am in the third year of my PHD...

Would it be necessary to also add the evaluated copy of my PhD transcript? Cos It seems as though uncompleted programs could be evaluated on the IEE portal

Should i just send only my masters documents to uscis?

I am not absolutely sure about this. In which country are you doing your PhD?
But I think you should add it, especially if your petition is research/academic based. You might have presented parts of your research and/or written/submitted Manuscripts (even if not yet accepted/published), which will help to prove your case.

My friend is doing his PhD in the US and included it in his petition.

It can also help to show that you are active in your field. Especially if not doing any other job

I agree with Olig’s response to you.

“ USCIS may grant a national interest waiver as a matter of discretion if the petitioner demonstrates eligibility by a preponderance of the evidence

The above is quoted from the EB2NIW policy manual, this should be your guide.

There is nothing like too much of evidence with USCIS. The fact that you’re in a PHD program (and yes, you need to include the evidence) is one of the reasons to show that you’re academically well positioned to carry out your proposed endeavor (2nd prong), you can also use that to make a case in the 3rd prong that you have a unique educational background/knowledge that may not be highlighted if you were to go through the labor certification process where only the minimum qualifications are required.

Include as much evidence as you can that can help your case!

Hi, just thought to let you know that generally, with EB2, you can do the minimum membership requirements for any professional society you belong. I’m not sure what this computer society membership you were asking about entails though. But if with the £25 option, you can get some sort of proof of membership, you might want to go with that.

What is your proposed endeavor to start with. Data science, statistics and analytics cuts across almost every field you can think of, especially finance!. There’s a lot of analyzing and making data driven decisions in finance. Just look for a way to phrase your proposed endeavor and petition letter in a way that it makes your degrees and work experience align.

Hi ma’am, please I really need Independent Recommenders.🙏🙏

Hi, apologies for the late response!

I’m not really sure where I come in here. I’m afraid that I’m unable to provide a recommendation at this time for personal reasons.

Note: I don’t know who sold this idea of independent recommenders to people. All my recommenders were people that I had a professional (academic/work-related) relationship with.

Hello everyone,

Please, what is the recommended method of paying the I-140 filing fee outside the U.S.? I have tried to contact the U.S. embassy in the country where I live now, as USCIS advised, but they are not responding. Those who filed from Nigeria, how did you make your payment?  Can someone do it for you in the U.S. using a personal check or money order?

And please kindly tell me which of the USCIS addresses is used when sending documents from outside the U.S.?

Thanks

Please, can you help clarify if there are restrictions on Green Card issued to someone through NIW. Must the person always be in the same profession or research as the proposed endeavor? Will there be a problem for someone if he switches job or research after getting the GC?

Hmmm, this is a dicey question that comes up often. I am not certain that USCIS does any follow up or keep tabs on an applicant’s professional track post green-card approval. And the likelihood that a person who has satisfied all the immediate requirements of the NIW (and met all the required professional qualifications) will become dependent on public funds and not contribute to the economic growth of the US is very slim.

Here’s what I usually advise people, while filling the I-140 form, pick a broader category as your SOC Code, here: https://www.bls.gov/soc/2018/major_groups.htm

For example; In my case, my proposed endeavor and occupation had to do with working as an Infectious Disease Epidemiologist, there is a specific occupation code for Epidemiologists on the Bureau of Labor Statistics website, but I did not choose that, I went for the broader category occupational code for medical scientists (which covers for epidemiologists, physicians, pathologists etc doing research related work). That way, I am not boxing myself up into a narrow field or just my immediate proposed endeavor. Should I decide to spread my tentacles and do other things with my career in the near or far future, I should be good to go!.

NOTE: Please try to maintain the same profession AT LEAST till you get your greencard, I watched a video on YouTube where a guy mentioned that the USCIS interviewing officer noted this and gave him kudos for still maintaining the same profession as his proposed endeavor while conducting his greencard interview.

I hope this is helpful, Goodluck!😊
