Very good one from south african authorities.

When ICC has prosecuted American presidents for war crimes in Afganistan, Libya, Iraq, etc. Then, they can come and demand for Al-bashir.

According to Fela, wetin unite for United Nations, One veto vote is equal to 98 or more. Which kain sense be that?

You have to look at the periods each event took place. I think the Rome Satute was signed after the apartheid regime.. if thats the case, then it may only be applied afterwards and not in retrospect. Am not sure but that's what it seems.
If the rome statute was signed after the apartheid regime, then I would be detailing this thread if I push my displeasure concerning apartheid further. That said, it's high time african heads of state rose up to their duties. The AU should unite and find a way to develop our region as the westerners cannot and would never develop 'mama Africa' for us.

Yes, the President as committed many atrocities, but it is unjust for SA government to hand him over to ICC on their own soil...if ICC want him...they should arrest him in SUDAN...grin
American soldiers did worse in Afghanistan... Iraq and the likes, not a single soldier has been prosecuted by the ICC...scallywags!
America is not a member of international criminal court to the best of my knowledge. Hence american citizens cannot be prosecuted for now .

SA has a mandate under the Rome Statute to handover suspects to the ICC. This move should have been successful considering the high level of international crimes and impunity in Africa. Nevertheless, the Court's indictments of African leaders should not be interpreted as being "bias" neither a tool of "imperialism". Rather it is the collective fight against impunity in the black continent.

That has been the argument: America is not a state party to the Rome Statute that established the ICC. Thus the lack of jurisdiction over its citizens. But the United Nations Security can refer a situation from America to the ICC just like the Sudan(Bashir) and the Libya(Ghaddafi) situation. Despite the war crimes committed by many Western Powers, the UNSC had refused to refer any situation to the ICC except African situations which brings the accusation of 'double standards' and 'imperialism'.
