Let me be sincere here: I expect this article to get me the chastisement and ire of some unscrupulous colleagues of mine in the medical profession who have embraced illegality and wanton unprofessionalism as their guiding principles.


But like seriously.....


.......I don't give a hoot!


If this article would make even one reckless doctor or nurse or any other health caregiver to shape up and practise medicine according to the guiding principles of professional excellence, then it would have been a huge success.


It is really a sad thing, because a lot of medical practitioners commit unspeakably horrible crimes and go scot-free just because majority of Nigerians are unaware of their health rights or even when they know about them, there are no available institutions and structures on ground to investigate these cases of malfeasance to a final conclusion. Because of this, doctors and other health care practitioners arrogate to themselves the power of a god- everyone else must worship and bow before them, even if by force. This ought not to be. And as such, we must take it upon ourselves to work collectively in identifying the few bad eggs in the system, who are denting the image of this nobel profession lest they cause us all to lose our worth and social value.


The follwoing are the 5 UNFORGIVABLE medical mistakes which anyone can sue his or her doctor for:



1. BREACH OF PATIENT CONFIDENTIALITY

This one is like the holy grail of medical practice. It is talked about so much that it is impossible for any doctor who trained from an accredited medical school to claim to be ignorant of it. And the rule is simple: at no time should a doctor or any other member of the health team discuss or disclose the patient's medical information or state of health to anyone who is not part of the medical team caring for him or her. The patient's medical information must be kept confidential at all times, except at such a time when it becomes inevitable to discuss the said patient with another doctor or member of health team in order to reach a final diagnosis or agreement on the best treatment modality for the patient. If evidence, at any time, abounds that a doctor has disclosed your medical information to someone who should not be privy of such information, you have the legal backing to sue that doctor and take away his/her practicing medical licence!



2. FAILURE TO GET INFORMED CONSENT

What is informed consent? It the permission (in the form of a signed document) granted in full knowledge of the possible consequences, given by a patient to a doctor for treatment with full knowledge of the possible risks and benefits. A bit technical, right? Here is what it means- before any doctor performs any medical procedure on you, that doctor must first explain the procedure in detail, including all the risks involved with that procedure to you, after which you can decide to give or not give the doctor the go ahead to carry out the procedure. Without your approval, it is an offence for any doctor to perform any medical procedure on you, EXCEPT at such a time when you are unconscious or in a very critical situation during which no family member of yours is available give assent to the procedure on your behalf. Any doctor found culpable of this offence can and should be sued.



3. ASSAULT OF PATIENT(S)

Assault, in any form, is an offence, even more so in the medical profession where there is zero tolerance for such. It is considered a rare privilege that we, medical practitioners, find ourselves in a position where we can save people's lives and determine the quality of life they live subsequently. This is very rare privilege that must never be abused but should instead fill the caregiver with so much compassion to treat patients with some respect and dignity. This is the standard practice. It is part of the hippocratic oath of medical practice. So really, it becomes very worrying and quite appalling when patients complain about doctors or nurses who assaulted or are assaulting them. It is evil and criminal for a doctor to assault you physically, sexually or psychologically. If you the courage to expose that evil doctor or health care practitioner to the right authorities, he or she would adequately sanctioned and dealt with.



4. SOLICITING SEXUAL FAVOURS BEFORE TREATMEMT

This is one that is quite common in this part of the world. I first encountered it when a friend of mine told me of an instance when she visited a particular hospital (name withheld) for treatmentg for some condition she didn't want her immediate family members to know about. The doctor who saw her, after she had made it clear she didn't want her immediate family to know about it, threatened to expose her if she refused sex with him! Yes, it happened here in Lagos. That is just one incident out of thousands of other unreported cases. And it is very disgraceful and evil and sick. Any doctor, male or female, who solicits sexual favours from his or her patient in return for treatment is culpable of professional misconduct and hence liable to be sued and jailed! In fact, the code of medical ethics prohibits sexual relationship with a doctor and a current patient (when the patient is still undergoing treatment). So really, except a medical practitioner wants to risk litigation, it is to his or her benefit to desist from soliciting or accepting sexual gratifications, even when willingly offered to the doctor by the patient during the course of treatment.



5. COMPLICATIONS RESULTING FROM FAILURE OF THE DOCTOR TO REFER A PATIENT AT THE RIGHT TIME

Standard medical practice makes it very clear that a doctor must, quickly and without delay, refer his or her patient to the next doctor with the requisite skills to treat the patient's condition when it becomes apparent that his (the first doctor) skill or experience is not sufficient to give the patient the best possible treatment.This is how it should be. But trust some doctors to hold on to their patients, ceasing the opportunity to extort and milk them dry until the patient's condition detoriates to a critical stage where complications arise, and in some unfortunate instances, even death occurs. This is pure wickedness from the pit of hell! Now, if it can be proved that the said doctor truly did hold on to a patient even when he or she knew that prompt referral was mandatory and the next line of action, he or she can and should be sued for gross professional misconduct. It is one of the unforgivables of medical jurisprudence.

For the purpose of enlightening the young lady (Ezionye) and others, I'll explain.

It really depends on the doctors clinical acumen and his clinical diagnosis.

You may examine areas that are apparently totally unrelated to the complaints, if you feel they may help your diagnosis.

For example, if someone comes complaining of ONLY headache or dizziness or change in vision, you may examine the breasts for milky discharge that may suggest a prolactinoma. (a type of brain tumor).

If someone complains of cough, you may examine the breasts to check for a lump, that may be metastatic breast cancer.

In both examples above, you could actually be sued for negligence if you did not examine the breasts and it turns out to be the key to diagnosing the problem.
Despite the fact that the patient has NO breast complaints whatsoever when coming to you.

As a real life example, I've had a patient come with just cough and difficulty in breathing due to a pleural effusion, and the cause turned out to be a very small breast lump (breast cancer) which was not noticed by the patient, her husband, or previous doctors. (The woman had large breasts, and she was a young woman o). She had absolutely NO BREAST COMPLAINTS.


So its possible for a doctor to wish to examine the breasts or vagina for seemingly totally unrelated complaints, it depends on what he is thinking about as his diagnosis.
If the patient declines, he just documents it, and is covered.

I had to clarify this, so that some poorly informed patients will not go around and start calling a doctor a quack because he requested to examine their breasts, when their complaints appear totally unrelated to those areas.

Besides, as a doctor, we are taught in medical school to do a full body examination as the standard, as that has saved lives in many cases by picking up things in the early stages that the patient might not have noticed, whether or not they are related to the patient's primary complaints.
Its just the practical constraints of time and a busy clinic that prevent most people from doing this.

I can't fault your point, but the whole essence of taking a detailed clinical history is so that you could be able to narrow down your likely diagnosis to the possible one. You mentioned Prolactinoma, the lady has clearly stated that she complained only of headache and cough, she didn't mention that she was feeling dizzy, even if she was, anaemia comes first as the likely cause before Prolactinoma, even if she had milky discharge, does that make it prolactinoma? Has he ruled out pregnancy? Have we asked her if she was on any medications that can increase PRL secretion? Prolactinoma is not diagnosed clinically, you need a visual of the anterior pituitary gland via a CT or MRI (so because of headache and cough you would have ordered for a CT Abi) you also mention Breast Ca, how common is breast ca in that age group and did the patient complain of other constitutional symptoms of malignancy? Even if she did, did the doctor in question ask her if she felt any breast lump? if she replied that she hasn't done SBE before, why can't the doctor ask her to go check in the rest room or wherever? And the vagin.a examination he did was to check for Cervical Ca too abi? We were told to do holistic examination of the most likely diagnosis and when you're writing differentials, malignancy should come last, it's what you can cure that should come first. Age is also very important, she couldn't have been up to 25yrs at that time and you're ruling out Breast cancer and prolactinoma for her. #WehdoneSir

@Ezionye I repeat that the guy took advantage of you if you didn't complain of any other thing besides the Headache and cough( the most likely diagnosis of which is lower respiratory tract infection which doesn't require a breast or Va.ginal examination )

What about wrong diagnosis?

Diagnosis is a matter of best or reasonable judgement/opinion in the face of presenting symptoms, signs and when necessary results of investigation. No doctor should be criminalized on the basis of a perceived error of diagnosis unless if it is proven he personally stood to gain from such diagnostic error. Therefore a patient can have quite legitimate multiple diagnoses, that are called differentials. For those who would like to sue and make tons of money from the doctor on account of 'wrong diagnosis' you have to understand these limitations.

Most cases of perceived wrong doing or wrong diagnosis occur where there has been communication breakdown or the subject seeks an alternative opinion and the new doctor in an effort to be seen as 'superior' begin to castigate and undermine the previous doctor. It happens all the time especially with the young, immature and inexperienced doctors. In the end, the patient suffers harm even dies as a result of unnecessary ego trip.


The temptation is always there to deal with a doctor who is rude and disliked. This has nothing to do with professional misconduct. Infact hardly any profession lends itself to the possibility of slander, accusation and abuse of the professional than the medical profession. Unfortunately owing to the innate bad behaviour of some doctors, this decision is made rather quite easy for some members of the public. At other times it is facilitated by other doctors who do not know enough about why certain decisions had to be made

Indeed some accusations have basis while others are outrightly frivolous meant to malign. An innocent person accused of stealing remains a thief in the eyes of the people forever. Doctors have no protection under the law from frivolous accusations. Unfortunately this is an unwritten burden every doctor has to carry.

When you seek medical attention from a doctor, it is good to understand that submitting your entire body for examination is part of the deal. You cannot complain that he examined your vagina.

But you can raise legitimate complaint if he did that in a way to disrespect you, failed to provide sufficient privacy, or if he did it without a chaperon present. He can even stimulate your cliitoriis to assess your autonomic response.

you are not making sense at all....the guy u quoted is more knowledgeable in medicine than you...do u know that in my centre in unth,Enugu we have diagnosed a girls of 18,24 and 32 years old of breast cancer
and as per prolactinoma been diagnosed with CT u are just partially right bc there is what we call provisional diagnosis and definitive diagnosis...CT of brain and bone window only give out definitive diagnosis as there is nothing with checking out a probable milkish discharge from the breast from breast examination

you reason too shallow......remember u can not always assume what should be wrong with a patient till u examine fully

Let me be sincere here: I expect this article to get me the chastisement and ire of some unscrupulous colleagues of mine in the medical profession who have embraced illegality and wanton unprofessionalism as their guiding principles.


But like seriously.....


.......I don't give a hoot!


If this article would make even one reckless doctor or nurse or any other health caregiver to shape up and practise medicine according to the guiding principles of professional excellence, then it would have been a huge success.


It is really a sad thing, because a lot of medical practitioners commit unspeakably horrible crimes and go scot-free just because majority of Nigerians are unaware of their health rights or even when they know about them, there are no available institutions and structures on ground to investigate these cases of malfeasance to a final conclusion. Because of this, doctors and other health care practitioners arrogate to themselves the power of a god- everyone else must worship and bow before them, even if by force. This ought not to be. And as such, we must take it upon ourselves to work collectively in identifying the few bad eggs in the system, who are denting the image of this nobel profession lest they cause us all to lose our worth and social value.


The follwoing are the 5 UNFORGIVABLE medical mistakes which anyone can sue his or her doctor for:



1. BREACH OF PATIENT CONFIDENTIALITY

This one is like the holy grail of medical practice. It is talked about so much that it is impossible for any doctor who trained from an accredited medical school to claim to be ignorant of it. And the rule is simple: at no time should a doctor or any other member of the health team discuss or disclose the patient's medical information or state of health to anyone who is not part of the medical team caring for him or her. The patient's medical information must be kept confidential at all times, except at such a time when it becomes inevitable to discuss the said patient with another doctor or member of health team in order to reach a final diagnosis or agreement on the best treatment modality for the patient. If evidence, at any time, abounds that a doctor has disclosed your medical information to someone who should not be privy of such information, you have the legal backing to sue that doctor and take away his/her practicing medical licence!



2. FAILURE TO GET INFORMED CONSENT

What is informed consent? It the permission (in the form of a signed document) granted in full knowledge of the possible consequences, given by a patient to a doctor for treatment with full knowledge of the possible risks and benefits. A bit technical, right? Here is what it means- before any doctor performs any medical procedure on you, that doctor must first explain the procedure in detail, including all the risks involved with that procedure to you, after which you can decide to give or not give the doctor the go ahead to carry out the procedure. Without your approval, it is an offence for any doctor to perform any medical procedure on you, EXCEPT at such a time when you are unconscious or in a very critical situation during which no family member of yours is available give assent to the procedure on your behalf. Any doctor found culpable of this offence can and should be sued.



3. ASSAULT OF PATIENT(S)

Assault, in any form, is an offence, even more so in the medical profession where there is zero tolerance for such. It is considered a rare privilege that we, medical practitioners, find ourselves in a position where we can save people's lives and determine the quality of life they live subsequently. This is very rare privilege that must never be abused but should instead fill the caregiver with so much compassion to treat patients with some respect and dignity. This is the standard practice. It is part of the hippocratic oath of medical practice. So really, it becomes very worrying and quite appalling when patients complain about doctors or nurses who assaulted or are assaulting them. It is evil and criminal for a doctor to assault you physically, sexually or psychologically. If you the courage to expose that evil doctor or health care practitioner to the right authorities, he or she would adequately sanctioned and dealt with.



4. SOLICITING SEXUAL FAVOURS BEFORE TREATMEMT

This is one that is quite common in this part of the world. I first encountered it when a friend of mine told me of an instance when she visited a particular hospital (name withheld) for treatmentg for some condition she didn't want her immediate family members to know about. The doctor who saw her, after she had made it clear she didn't want her immediate family to know about it, threatened to expose her if she refused sex with him! Yes, it happened here in Lagos. That is just one incident out of thousands of other unreported cases. And it is very disgraceful and evil and sick. Any doctor, male or female, who solicits sexual favours from his or her patient in return for treatment is culpable of professional misconduct and hence liable to be sued and jailed! In fact, the code of medical ethics prohibits sexual relationship with a doctor and a current patient (when the patient is still undergoing treatment). So really, except a medical practitioner wants to risk litigation, it is to his or her benefit to desist from soliciting or accepting sexual gratifications, even when willingly offered to the doctor by the patient during the course of treatment.



5. COMPLICATIONS RESULTING FROM FAILURE OF THE DOCTOR TO REFER A PATIENT AT THE RIGHT TIME

Standard medical practice makes it very clear that a doctor must, quickly and without delay, refer his or her patient to the next doctor with the requisite skills to treat the patient's condition when it becomes apparent that his (the first doctor) skill or experience is not sufficient to give the patient the best possible treatment.This is how it should be. But trust some doctors to hold on to their patients, ceasing the opportunity to extort and milk them dry until the patient's condition detoriates to a critical stage where complications arise, and in some unfortunate instances, even death occurs. This is pure wickedness from the pit of hell! Regarding the bone of contention, my own opinion is we all have our approaches to arriving at diagnoses and this is largely dependent on individual patients peculiarities and the clinical setting. This isnt medical school; a practiced doctor has to be able to tailor his history taking and examinations to align with patients peculiarities or the purpose of history taking is defeated.

However if in the doctors thinking there is a further need to probe into systems outside of the patient primary complains then explicit explanations is offered as to why.

In all, nobody likes their body to be poked over at each visits to the hospital over complaint of cough but as clinician if we feel it would help us or the patient then a thorough systems examination is always good only after letting the patient know what we are thinking.

Diagnosis is a matter of best or reasonable judgement/opinion in the face of presenting symptoms, signs and when necessary results of investigation. No doctor should be criminalized on the basis of a perceived error of diagnosis unless if it is proven he personally stood to gain from such diagnostic error. Therefore a patient can have quite legitimate multiple diagnoses, that are called differentials. For those who would like to sue and make tons of money from the doctor on account of 'wrong diagnosis' you have to understand these limitations.

Most cases of perceived wrong doing or wrong diagnosis occur where there has been communication breakdown or the subject seeks an alternative opinion and the new doctor in an effort to be seen as 'superior' begin to castigate and undermine the previous doctor. It happens all the time especially with the young, immature and inexperienced doctors. In the end, the patient suffers harm even dies as a result of unnecessary ego trip.


The temptation is always there to deal with a doctor who is rude and disliked. This has nothing to do with professional misconduct. Infact hardly any profession lends itself to the possibility of slander, accusation and abuse of the professional than the medical profession. Unfortunately owing to the innate bad behaviour of some doctors, this decision is made rather quite easy for some members of the public. At other times it is facilitated by other doctors who do not know enough about why certain decisions had to be made

Indeed some accusations have basis while others are outrightly frivolous meant to malign. An innocent person accused of stealing remains a thief in the eyes of the people forever. Doctors have no protection under the law from frivolous accusations. Unfortunately this is an unwritten burden every doctor has to carry.

When you seek medical attention from a doctor, it is good to understand that submitting your entire body for examination is part of the deal. You cannot complain that he examined your vagina.

But you can raise legitimate complaint if he did that in a way to disrespect you, failed to provide sufficient privacy, or if he did it without a chaperon present. He can even stimulate your cliitoriis to assess your autonomic response.

Best comment so far. It's important to know that suing a doctor to court isn't the same as winning in court. Actually winning a lawsuit against a doctor is very difficult except in clear cases of negligence or outright deception of the patient.
The most tricky part is for the doctor not to lose his licence as the medical and dental council would still eventually try the doctor. The doctor can win in a court of law and still have his licence seized or some other forms of punishment imposed.
The reason for some medical examination might seem unreasonable but until you know what the doctor is trying to rule out......it's premature to jump into conclusion. Unless you feel the doctor didn't conduct himself well professionally or you feel abused.....there are a million reason for those examinations.

Pls op when are you going to write an article about 5 mistakes doctors can sue patients for. I sincerely hope one of them is giving false information as presenting complaint. Medicne as a profession has taught me that nigerians are innate liars. A man would to the hospital with STI and tell the doctor that he is urinating too much. A woman will come to the hospital looking for the friut of the womb and will tell the doctor that she has come to the hospital because of stomach ache. In my exam a woman was looking for a child and came complaining of neck pain see me taking her history now, when i was presenting and my examiner asked her if neck pain was her real complaint, that is how the woman denied me o and said no, i nearly failed that exam. We doctors have a lot cut out for us and some of you patients are dificult.there was this case in a teaching hospital in lagos of a woman who was sick with chronic kidney disease, her relatives kept telling the doctors that they had no money, the doctors did all they could even contributed money but lost her, 2 day after her death the relatives came with 2 lawyers demanding for an autopsy, where did they get money for the lawyer, nigerians have bad attitude towards health and doctors and that is why the smart ones leave this country to go abroad. A colleague told me while in med school that anyone who wants to practice in nigeria is high on crack. The replies of nigerians in this thread have made me realise that he has a point. Continue o. Very soon only quacks, nurses and pharmacists will be treating you when there will be only a handful of doctors or none at all to treat you.
