kayzat: What I gave you is an example, so don't get caught up in the example else you'll miss the essence of whats being said. I' am not a lawyer to go into specifics, but you don't need to be a lawyer to know the fuction of the court.. Remember what this thread is about is the decision of the court. The constitution gives power to the courts to deliver justice. If they set a thief free, that's their decision. If they sentence the same thief to death, that's their decision. You may or may not like their decision, but you must aceept it as the right decision. Unless you understand this,, you'll never understand why every lawyer on here has said the OP don't have to re-pay the lost money. |

odysey: Was the trial in a high court or at a Magistrate court? If it happened in a Magistrate court, ask your lawyer to move the case to High Court where he can ask for a judicial review of that trial citing bias of the judge to the other party. Ask for damages from the police and your former employer for trampling on your fundamental human rights detailing how you were detained in their cell for two weeks and all the bribes you were forced to pay them apart from the N30,000 you paid him at their station. If you institute a case of fundamental human rights on this issue, they will either come and beg you or forget about the money because the police knows what is involved. |

That u were convicted, jailed or paid fine does not change the fact that money got missing under your watch. And since the law does not believe that things disappear and since you agreed that the money got missing under your care, it is assumed that you know the whereabout of the money but decided to play smart. But in a criminal proceeding, punishment other than recovery is their main aim, that's why you were not told to pay back but punishment meted on your. Don't mind those asking you to appeal, you will put yourself in more trouble. Since you agreed with your employer that the money got missing under you, its an admission of guilt, hence sentence was given. Nothing wrong there. Through civil claim, your employer can get his money back and you will be also asked to pay the legal fees. I suggest you meet with your employer, explain to him how all happen and make arrangement how to pay back if he insist. Unless you are sure he doesn't have any plans to pursue a civil case against u... |

I am certain that the op probably used the money to play virtual sport. Money that he is meant to use for sales.
