Pay Or Go To Court. by Blackfire(m): 4:08pm On May 31, 2018
Pardon my English.

Last week a guy was trying to hit me from the side, I took the decision to move away, I bashed the car in my front, who also hit the one in the front, the guy who try to hit me who caused the accident, zoomed off.
The car in the fore front asked me to forget about it that it wasn't my fault, and left, the one in my front, called the police, and they took everyone to station. Now when the man was asked what he wanted he said I should repair the car, he called mechanic, who gave estimate of 140k, I agreed to pay, so we were told to come the next day to finalised, the man cameback with extra 350k, totally 490k.
Now I don't know if I should pay him the money... Or go to court.

Don't you have insurance?

You can take your own auto mechanic to give you an estimate. If it is lower, tell the man that you can't afford it. He should kuku kee you. Ahn ahn, 490k can get you a nice and clean Nigerian used vehicle

Contact your insurance company.

2. get 2 other quotes

3. seek a peaceful resolution

I fell on the ground for this man, but he remains adamant, like I remind him of someone he needs to deal with.

Contacting insurance company and the protocols, my vehicle will be there for months, I just bought the vehicle some weeks ago

The front bumber + the back number,
The windscreen front.
The two airbags.
That was what they calculated to 140k.

Later on the day we were to settle, after begging and pleading for forgiveness, the man brought extra 350k

1. Insist on collecting you initial deposit back, you can get a lawyer to enforce it.

2. get your 3RD PARTY insurance involved, they are liable for repairs of up to 1M naira

3. Get comprehensive insurance with Axamansard on this platform for future purpose.

In lagos no de do gentle man o! The police know it's an insurance case, but you splashed the money out too quickly. show with a charge and bail Lawyer and insist on going to court, every one will mellow.

since u are the one paying for the job, u have to hear from atleast 3 other mechanic, bt my advice is this, since the man wants trouble allow him to take the matter to court, u did nt kill anybody, tell the court that u would have loved to pay for the damages bt u can't afford to pay it at once, like 20k every month, i have done it b4 and it worked, the man had to let go of everything...... Finally next time don't run away because someone wants to hit u, because if u do u won't see them, instead allow them to hit u...

Thanks for those words.
When that incidence happened, when the guy that caused the accident zoomed off, one thing came to my mind, to so the same thing.
But I reasoned it was wrong, now am nearly regretting it now, with this mans character
Now my question is how do I remove my vehicle from the police station
Re: Pay Or Go To Court. by andyanders: 6:32pm On May 31, 2018
Your 3rd party should take care of the man's car. You should get your own mechanic to cost the damage and give you the cost. If he doesn't want, let them charge the case to court and they will agree on your own terms since you never killed anybody. The bill is high. He is a wicked person. Just allow your car to stay there what if your enemy died. Bd strong and face the man.

I really don't want this in my life right now.
But like you said, I have to be strong.
Who knows what could have happened, if this didn't happen.
Thanks Andy

You welcomed. Just handle it with care. God has a reason for this. I can understand you're not a trouble somebody. The issue here is the extra bill he added to the 140k, to pump up the bill to such high amount. Is he now asking 4 the cash to be given to him or to the mechanic? People are wicked.

Listen, the intimidation and the new bill could be the man's plan with the police hence the sudden change of the amount. They want to extort from you and knowing that you just bought the car and you should be loaded. If you have a close friend who is a lawyer, discuss with him or insist you cannot pay more than the 140k, but have in mind that you will still settle police. Or go to the DPO and discuss terms and take care of things and they will call the man to order. Just budget 200k for everything. If they don't accept that, take it to court.

since it was the man that took the matter to the station, removing ur car now would cost u nothing less than 100k (bribe )make sure that atleast a lawyer friend of urs knows about the issue, and also take a photo of the car in the station, if nt ur tyres may vanish one by one... Once the matter gets to the court and they agreed on a particular amount that u are to be paying, then the court may give orde for the release of ur car, because it could be the source of ur income..... Jst calm down, don't be in a hurry to remove the car yet...
Re: Pay Or Go To Court. by DelTel(m): 8:30pm On May 31, 2018
Op, you have no cause to worry since you have a Third Party insurance.

The Third Party insurance covers any third party vehicle or property up to #1m.

Only caveat is that it must have been procured from a registered insurance company duly licensed by the insurance regulator in Nigeria NAICOM.

The case at hand doesn't warrant the police to seize/impound your vehicle (except an injury/death to person or public property); we can't blame the police alone thou as you & the third party should know the law (don't forget ignorance is not an excuse remember).

In case of any road traffic accident, no one should ever admit liability (guilt), most of us don't know the road traffic law entirely, it's expressly stated in the insurance certificate you carrying; as your insurance company will take it up.

You can send me the insurance certificate on WhatsApp & I could help resolve esp if you are in Lagos. You might not even need a lawyer on your expense but the insurance company's bill.

The lessons here are many, but mostly importantly is the importance of INSURANCE on all assets we acquire, not just motor vehicles.

Contact your insurance company for the third party damage, it might take time, but they will take it up on your behalf, but make sure you don't advance cash to the third party, let the insurance company inspect the car first and make all necessary adjustments with the estimate. But you will still need to settle the police to get your car out.
