So, what happens, that's the clarification you seek?. First, let us recall that Mr. Abubakar Atiku also filed petitions against the electoral umpire, both candidates of the APC, and APC herself. Why and what effect would his litigation have on the outcome of the justice's decision?. In any case, I can assure you that Mr. Tinubu did not receive more votes than Mr. Atiku Abubakar did. This truth will be extrapolated from materials and witness statements presented at trial. Likewise, Mr. Tinubu's votes count ultimately remained below Peter Obi's as the trial insight will show. So, what to do?. Let's consider these scenarios: Mr. Atiku overcomes Mr. Tinubu and Mr. Obi vote count, but failed to secure 25% in the FCT. Mr. Obi scored more votes than Mr. Tinubu and and Mr Atiku and also secures 25% in the FCT. Mr. Tinubu remain below Mr. Obi and Mr. Atiku vote count and also received less that 25% of votes cast in FCT This is the likely scenario, but what is the common denominator here?. Now, pay very close attention. Tinubu!. He received the least amount of votes among his closest competitors, Mr. Atiku and Mr. Obi. Further, both Mr. Atiku and Mr. Tinubu missed the FCT 25% mark. Let's go back to what the constitution said: Section 134: 1. A candidate for an election to the office of President shall be deemed to have been duly elected, where, there being only two candidates for the election- a. he has the majority of votes cast at the election; and b. he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja. 2. A candidate for an election to the office of President shall be deemed to have been duly elected where, there being more than two candidates for the election- a. he has the highest number of votes cast at the election; and b. he has not less than one-quarter of the votes cast at the election each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja. 3. In a default of a candidate duly elected in accordance with subsection (2) of this section their shall be a second election in accordance with subsection (4) of this section at which the only candidate shall be- a. the candidate who scored the highest number of votes at any election held in accordance with the said subsection (2) of this section; and b. one among the remaining candidates who has a majority of votes in the highest number of States, so however that where there are more than one candidate with majority of votes in the highest number of States, the candidate among them with the highest total of votes cast at the election shall be the second candidate for the election. In the event that the justices comes to a conclusion that Mr. Tinubu neither scored the highest number of votes, nor received 25% votes cast in FCT, he is automatically disqualified, and the next question is, who next is most qualified, taking the dictates of the constitution into cognizance. If they elect to order a rerun, who are the likely candidates?. I will only go so far for now, but I'm interested in what you think will be the next logical outcome. NB: For some of you who may to be tempted to launch your usual asinine attacks on the messenger in place of the message, I am able and capable in the various ways you operate. Let's keep it civilized and gentle, if you will. That's my preference, hopefully, yours too. |

You are well-informed regarding Section 134 (2) of the Constitution of the Federal Republic of Nigeria 1999 as amended and I quote verbatim: “A candidate for an election to the office of President shall be deemed to have been duly elected where, there being more than two candidates for the election, he has the highest number of votes cast at the election; and must have nothing less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory (FCT), Abuja.” Having regard to the very letter or even the intent of the forgoing, the conjectures or innuendos vis-à-vis what the real intent of the writers is, is a discretionary exercise. Will you also make these same arguments if any of Peter Obi or Atiku Abubakar are sitting in Aso Rock tonight?. I understand what's at stake, but we must endeavor to stand on the side of the truth as much as possible, or better still, at all times. This is one of such times. |
