Your lies are being exposed. You didn't cite the laws you're referring showing prostitution between adults to be illegal in state or federal law or constitutionally. Don't forget to cite Penal Code you're referring to. We're not talking about child sex trafficking, rape or abduction so the criminal Code sections you referenced are irrelevant to the conversation.

Prostitution and brothels is not yet banned in Nigeria that is why we concerned Nigerians started this New movement to call upon Nigerians and Nigeria authorities to stop this Prostitution menace that is making Nigerians to become victims of circumstances and by which Prostitution is destroying the lives of Nigerians like nuclear weapon: wether underage Prostitution and adult Prostitution, both are crimes against humanity and must be stop in Nigeria.

Generally, in Nigeria, there is no federal enactment that expressly prohibits prostitution. The principal penal laws of Nigeria which are the Criminal Code Act applicable in the Southern Region, and the Penal Code Act applicable in the Northern Region, do not have an express provision prohibiting prostitution. Section 36(12) of the 1999 constitution provides that a person shall be convicted of a criminal offence only if the act and or omission so committed or made constitutes a defined offence in a written law, having a penalty ascribed to it. The question consequent upon the perusal of the above constitutional provision is whether there is any written law that defined and proscribed the act of prostitution.

By definition of an offence, the provision so defining must highlight the physical and mental elements of which when present renders one criminally liable for the offence. There is no such provision in Nigerian laws. However, under the Sharia Law which is a native law applicable in the Northern Region, prostitution amounts to an illegal act.

Notwithstanding the fact that prostitution is not expressly defined in Nigerian laws, there are some provisions of the law that made allusions to prostitution from which an inference could be drawn to the effect that prostitution is abhorred in Nigeria. Section 223 of the Criminal Code Act deals with procurement of women or girls. Subsection 2 of the said section expressly mentioned “prostitute”. The section makes punishable with two years imprisonment, the act of procuring a woman or a girl in order to become a common prostitute.


Further in subsection 3 and 4 of the same section 223, a person who procures a woman or girl to become a brothel inmate for the purpose of prostitution is punishable with two years imprisonment. Section 223 deals specifically with procurement of another for the purposes of prostitution. If follows logically therefore that as long as ones does not procure another to get involved in prostitution, there is no liability for prostitution.

Another relevant provision is section 224 of the Criminal Code Act deals with procuring women by threats, fraud, or by administering drugs on them for the purpose of defiling them. Under this heading, common prostitutes can be liable only if the prostitute procured another for defilement by threat, fraud or by administering drugs, and the provision of section 225 of the Criminal Code applies to a similar extent if a girl is abducted for the said purpose.

Another section up for consideration is section 225A of the Criminal Code Act which deals with trading in prostitution. The section punishes males who live on the earnings of prostitution, or who persistently solicits for immoral purposes in a public place, or a male or female who has control and influence over prostitutes in a manner suggesting that he is aiding, compelling or abetting them, and also the use of one’s premises for prostitution. The offence is punishable under the section. Keeping a brothel is equally punishable under section 225B. The exercise of control of the movements of a prostitute is also punishable by section 250 of the Criminal Code Act which deals with Rogues and Vagabonds.

In the Penal Code Act, section 405(d) prohibits the indecent or disorderly behaviour of a common prostitute in a public place who persistently solicits for prostitution with two months imprisonment. This provision is in pari material with Chapter 532 of the Federal Capital Territory, Abuja Penal Code.

Section 15 of the Trafficking in Persons (Prohibitions) Law Enforcement and Administration Act also referred to and prohibits with punishment, procurement of persons for prostitution. An interesting thing about the Act is that it made use of “any person’, thus, it recognizes the fact that procurement of prostitution is not only restricted to women or girls.

Prostitution is illegal in all northern states that practise Islamic Penal Code. In southern Nigeria, the activities of pimps or madams, or underage prostitution and the operation or ownership of brothels are penalized under section 223, 224 and 225 of the Nigerian Criminal Code.

Section 223:

“Procuration”

“Any person who procures a girl or woman who is under the age of eighteen years to have unlawful carnal connection with any other person or persons either in Nigeria, elsewhere or procures a woman or girl to become a common prostitute either in Nigeria, elsewhere or procures a woman or girl to leave Nigeria with intent that she may become an inmate of a brothel elsewhere procures a woman or girl to leave her usual place of abode in Nigeria, intent that she may, for the purposes of prostitution, become an inmate of a brothel either in Nigeria or elsewhere, is guilty of a misdemeanour and is liable to imprisonment for two years. A person cannot be convicted of any of the offences defined in this section of this Code upon the uncorroborated testimony of one witness. The offender may be arrested without warrant Nigeria or elsewhere, is guilty of a misdemeanour and is liable to imprisonment for two years. A person cannot be convicted of any of the offences defined in this section of this Code upon the uncorroborated testimony of one witness. The offender may be arrested without warrant

Section 224:

Procuring defilement of woman by threats or fraud, or administering drugs”

“Any person who by threats or intimidation of any kind procures a woman or girl, to have unlawful carnal connection with a man either in Nigeria or elsewhere or by any false pretence procures a woman or girl to have unlawful carnal connection with a man either in Nigeria or elsewhere or administers to a woman or girl, or causes a woman or girl, to take, any drug or other thing with intent to overpower her in order to enable any man, whether a particular man or not, to have unlawful carnal knowledge of her, is guilty of a misdemeanour and is liable to imprisonment for two years. A person cannot be convicted of any of the offences defined m this section upon the uncorroborated testimony of one witness.”

Section 225:

“Abduction of girl under eighteen with intent to have carnal knowledge”

“Any person who, with intent that an unmarried girl under the age of eighteen years may be unlawfully carnally known by any man, whether a particular man or not, takes her or causes her to be taken out of the custody or protection of her father or mother, or other person having the lawful care or charge of her, and against the will of such father or mother or other person, is guilty of a misdemeanour and is liable to imprisonment for two years. It is a defence to a charge of any of the offences defined in this section of this Code to prove that the accused person believed, on reasonable grounds, that the girl was of or above the age of eighteen years.”

Even though Nigeria law does not legalize commercial sex work, it is vague if such work is performed by an independent individual who operates on his or her own accord without the use of pimps or a brothel. The Nigeria criminal system prohibits national and transnational trafficking of women for commercial sex or forced labour, Nigeria is a signatory to the 2000 United Nations Protocol to prevent, suppress and punish trafficking in persons especially women and children, perceptions of prostitution are based on culturally determined values that differ between societies. In some societies, prostitutes have been viewed as a member of a recognized profession; in others, they have been shunned, reviled and punished by stoning, imprisonment and death. Few societies have exercised the same severity towards clients indeed, in many societies clients suffer few of any legal repercussions.

Prostitution, brothels, homosexuals and lesbians are giving NIGERIA as a Nation bad reputation and Nigerians will longer be quiet but will continue their protests on another level.

Prostitution, brothels, homosexuals and lesbians are not legalize in Nigeria and so any persons involving in this criminal activities will soon be arrested by Nigerians and handed over to the Nigeria Security agencies.
