Since I was born, I have never witness the kind of hypocrisy, double standard and demonisation that is currently perpetrated by Muhammadu Buhari, the APC, Alhaji Sanusi, Osinbajo and their "good governance crusaders" against the person of President Goodluck Jonathan, Allison Madekwe, and other government officials.

Alhajis Buhari and Sanusi and APC have been going about using every platform to talk about a "missing $20b", cheered by their hypocritical followers that pride themselves as good governance crusaders. They have deliberately gone blind over the fraud of CBN under Sanusi as outlined by the Financial Reporting Council of Nigeria report in February 2014.

Sanusi Indicted And Removed For Fraud
According to the report (see below) Sanusi was indicted for Gross Misconduct that bothers on fraud and financial recklessness among other offence. The FRCN subsequently advised Mr President to remove Lamido Sanusi from office for further investigation and probe after the explanation of Sanusi appeared more like a tale and outrightly illogical according to FRCN. The council indicates that the explanation provided by Sanusi is “a clear display of incompetence, nonchalance, fraud, wastefulness, and abuse of due process and deliberate efforts to misrepresent facts on the part of the leadership of the CBN.”

The council advised the President to exercise the powers conferred on him by Section 11(2)(f) of the CBN Act 2007 or invoke Section 11(2)(c) of the said Act “and cause the governor and the deputy governors to cease from holding office in the CBN.”


April 2014: VP-elect Yemi Osibanjo Filed Case To Stop Sanusi Probe
Rather than Sanusi to prove his innocence in court, he filed a case in Federal High Court, Lagos to STOP FRCN and Other Security Agencies from investigating and prosecuting him through three Senior Advocates of Nigeria, Prof. Yemi Osibanjo, Dr. Kanyinsola Ajayi and Kola Awodien.

Despite the fact the President Jonathan commissioned PWC to audit NNPC books to ascertain the veracity or otherwise of Sanusi's claim, Buhari, APC, Sanusi and their online agents that parade themselves as good governance and anticorruption apostles have been crying blue murder but refused to comment on the FRCN report nor the APC's VP elect role in shielding Sanusi for probe.

April 26, 2015: Buhari's Display of Hypocrisy
In his usual hypocrisy, General Buahri vowed to re-visit the $20b allegation but said NOTHING about the FRCN report. In his own word... “Imagine a situation where the former CBN governor who by God ‘s grace would later become the  Emir of Kano raised an  issue of missing billions of money, not in Naira but in Dollars, $20 billion.
“What happened, instead of investigating to know whether it was true that the money was missing or not, they simply found a reason to remove him. So these are the issues we are talking about…"

Contrary to the lies of Alhaji Buhari, Sanusi wasn't removed because he raised alarm, he was removed because he was indicted by FRCN. Jonathan also never kept mute, he commissioned PWC to audit the books. Buhari was also blind to talk about prosecuting Sanusi for the CBN fraud. Perhaps the Emir is as "incorruptible" as him(Buhari)..

I think these are some of the few questions any sane mind will like to ask; which of the senate standing order rule was forged? Was it 1999,2003,2007,2011 or 2015? If it was the 2015 order, what was really forged? If its the 2011 order why do the senate have order rule book for with regards to each tenure, what has been the tradition in recent times. Let justice be done not on basis of eye service. Is it constitutional that leadership of the national/ state assembly must come from the ruling party? Lawyers in the house over to you.

Both the police and the so-called unity forum senators have no case.Making the standing senate rules for the incomming NASS is the perogative of the senate bureacrats led by the clerk.It can however be amended within the life of that senate by 2/3 majority of the senators.The senate rule for any senate can only be in force for the life span of that senate after which it dies.That is why the senate rules are named after each senate 1999,2003,2007,2011 and 2015

U are very wrong sir,the Senate rules for the preceding senate holds until a new senate is inaugurated.
in this case the clerk and his cohorts goofed big time because it is the subsisting rules of the 2011 senate rules that was being used to inaugurate the new house.
So your argument is not valid since the house rules of 2011 has not only been breached but was even forged.

The issue is when, where and who amended it?
The process of amendment is quite clear. So, was the process adhered to?

“The President of the Senate shall within seven working days of the receipt of the notice, cause the amendments to be printed and circulated to members. Thereafter, it shall be printed in the Order Paper of the Senate.

“The Mover or Movers of the amendments shall be allowed to explain in detail the proposed amendments. Thereafter, the Senate shall decide by simple majority votes whether the amendments should be considered or rejected.

“If the decision is to consider the amendments, then another date shall be set aside by the Rules and Business Committee whereby opportunity would be given to Senators to further propose amendments but must strictly be confined to the original amendments. “Two-third majority shall decide the amendments and such amendments shall form part of the Rules of the Senate.”

Ask yourself this question. Who drafted the senate rules of the first senate when no senate was there before it? Was it not the management of the National Assembly?

Each Senate rules dies with that senate as he said. A new senate is not bound to inherit same rules of the previous senate but can in the life of that senate amend the rules in line with what suits them

I did not say it's mandatory that it must take up to 4 months. I said 4 months because the President has interest in the matter. Files can stay in MOJ for up to 6 months. In fact, sometimes we send the files to the SCIID (Police) for more discrete investigations. However, I know the instant case will be treated with urgency. We have such files whereby we are warned that the Govt has interest. When we are assigned with such files, we set aside every other thing and handle them first.
pls stop misinforming the public,many of these bureaucracies can be stepped aside to achieve quick prosecution

3. The Director of Public Prosecutions will peruse the file and assign to a Counsel, giving him about a week to write a legal opinion.
4. The counsel writes the opinion. Sometimes he has other pending opinions to write so it might take him two weeks to submit. In the instant case the counsel will be warned to keep to time as the President has interest in the matter.
5. When the counsel is done with the writing of the opinion, he submits it on the table of the Chief Litigation Officer.
6. The Chief Litigation Officer takes the file to the Office of the Director of Public Prosecutions.
7. The Director of Public prosecution reads the opinion of the counsel, and thereafter assigns it through the Chief Litigation officer to another counsel (most times a senior to the 1st counsel) for his perusal and vetting giving him a week to vet.
8.The counsel takes about a week, sometimes two weeks (depending on his work load and his attitude towards work) to vet.
9. The counsel sends the file to the office of the Chief Litigation Officer for submission, after vetting.
10. The Chief Litigation officer sends the file back to the office of the Director of public Prosecutions.
11. The Director sends it to another counsel (mostly a Chief Counsel) for re-vetting after which he submits to the Chief Litigation officer who in turn submits to the D.P.P.
12. The D.P.P assigns the file to an Assistant Director for review within a week.
The Assistant Director reviews within a week or 2weeks and sends the file to the Office of the Chief Lit. Officer for submission.
13. The Chief Lit. Officer sends the file back to DPP.
14. The DPP sits down to study all the opinions and adopts the ones he wants to adopt and criticise the ones he disagrees with. He might even end up not adopting any of the opinions but have a different opinion entirely. (mind you all the opinions must be backed with authorities, that is cases and (or) Sections of the Law.
15. The DPP sends the file back to the office of the A.G.
16. The A.G uses his discretion to either adopt or oppose the Legal Opinion. His decision is final. He sends the file back to the DPP.
The DPP assigns the file to a counsel to draft a legal advice based on the DPP's Legal Opinion or the A.G's opinion if the A.G has a contrary Opinion.
17. When the counsel is done with the Legal Advice, he sends it back to the DPP through the Chief Lit. Officer.
18. The Director corrects the Legal advice and sends it back to the counsel to effect the corrections after which he signs the Legal advice and dispatch to the Police.
19. The Police cannot charge the suspect to a High Court without an Information which must be written by the Office of the DPP.
20. The DPP assigns a counsel to draft the information based on the recommendations of the DPP or AG in the Legal Opinion.
21. When the Counsel returns the Information to the DPP through the Chief Lit. Officer, the DPP re-assigns the Information (charge sheet) to another counsel for vetting. When the Director approves the Information, he signs and sends back to the Chief Litigation Officer for filing.
22. The information will be filed and the Defence Counsel is to be served with a copy by a court bailiff.
The above listed procedure can take 4 months to complete. Sometimes information is not filed till after a year (though the judges seriously frown at that and can grant a suspect who is in prison custody bail for lack of filing of information by the Govt counsel except in capital offences or very serious offences though bail can still be given in special circumstances).
My dear fellow Nairalanders, especially APC supporters, don't rejoice yet.
The journey has just begun.

Sister Christinie, thanx for this exposition. But let's not forget that the legal advice can be written within 24 hours. More so in this case when the facts are clear. We all know that in the civil service laziness rules and this is buried in elaborate, albeit unnecessary, procedure. There's nothing in the rules that stops the Dpp from rendering the legal advice and the SG vetting it (in the absence of AG). lf the Dpp of federation can't give legal advice on this case within 48 hours (to be generous) then something is wrong somewhere.

I don't knw why some people are crying for the head of the Clerk. The Clerk of the Senate maintained that his management has the prerogative to amend the rules in time of vacuum. The question is "is this a valid argument"? When people say forgery, then it means there will be original version. Where is the original?

Thank you for this enlightenment. l still have some questions. Does it mean that it is mandatory to amend the senate standing rules to produce that for the succeeding year? Since there was no such 2/3 amendment of the 7th senate standing rule, does it mean there is now no senate standing rule 2015? Meaning that what was allegedly forged was Senate standing rule 2011 since there is no 2015 standing rule? Because one can only forge what had been in existence not something that has never existed. Pardon my ignorance please, l'm just a lay man trying to understand the scenerio.
You're very correct my brother..what we have as standing order 2015 is invalid because it contains some amendments from that of 2011, and those amendments were not agreed upon by the simple majority in the house. Only a few persons cooked up those amendments. It's only after a call for amendments have been made by this 8th Senate and approved accordingly after the necessary steps that we can have what is called Senate standing order 2015(as amended);and none of these have been done to the best of knowledge. Otherwise that of 2011 would still subsist for 2015. As it stands now, the clerk and his partners in crime have a case to answer with the judicial system. Cheers.

Asking for the original version of Senate Rule 2015 is like asking for the original version of 2015 Nigerian Constitution. Laws don't die because government changes. That's why even coup plotters first suspend the Constitution before enacting any Decree. Right now what I expect APC to do is discuss the way foreword; just incase the court upholds that the rule on which Senator Saraki was elected Senate President is a nullity. If APC attempts to remove Saraki and install its preferred candidate, PDP could win the Presidency of the Senate with its members plus the aggrieved APC members. The Police report has suddenly thrown the National Assembly into more confusion.

I did not say it's mandatory that it must take up to 4 months. I said 4 months because the President has interest in the matter. Files can stay in MOJ for up to 6 months. In fact, sometimes we send the files to the SCIID (Police) for more discrete investigations. However, I know the instant case will be treated with urgency. We have such files whereby we are warned that the Govt has interest. When we are assigned with such files, we set aside every other thing and handle them first.

On the contrary the senat would remain very active for the next four years and will work hard to ensure that Buhari's paeroto principle of 97% and 5 % is not actualised!!!! About the so-called forgery.The idiots and their masters know they have no case else they would have been in court long before now.All the do is to sponsor propaganda in the media just like this one to decieve the gullible ones

I don't knw why some people are crying for the head of the Clerk. The Clerk of the Senate maintained that his management has the prerogative to amend the rules in time of vacuum. The question is "is this a valid argument"? When people say forgery, then it means there will be original version. Where is the original?.. ...
