Justice John Fabiyi who on Thursday temporarily halted the corruption trial of Nigeria’s Senate president Bukola Saraki at the Code of Conduct Tribunal (CCT) retires in two weeks, according to sources at the Supreme Court.


By law, Justice Fabiyi is required to mandatorily retire from the judiciary on November 25 when he turns 70.  He was born on November 25 1945
 
Justice Fabiyi today led four other judges who gave an order to halt the trial of Saraki pending the determination of the Senate President’s appeal before the court.  Saraki is seeking an order halting his trial for falsely declaring his assets.

The Senate President has done everything possible to halt his arraignment on 13 counts of false declaration of assets, using various maneuvers in an effort to get judges of different courts in Nigeria to stop his trial.

[b]A source told SaharaReporters that prior to today’s ruling, Toyin Sanusi, one of his aides, drove a Black Toyota Corolla car, license plate YAB 595 KZ, to a meeting several times with the Supreme Court registrar at No. 17, Mandela Street in Asokoro, Abuja.  It was in the  house that Saraki’s agents reportedly met some justices. 

Saraki intensified his plot to stop the CCT trial when officers of the Economic and Financial Crimes commission (EFCC) went last week to see a lawyer with a letter and two cheques that prove he bought a property through a proxy, Tunde Morankinyo, and didn’t declare it.  The EFCC has invited that lawyer to their office tomorrow. 

The property in question, Plot 37A Glover Street, Ikoyi, was paid for with cheques for N309Million and N15.45Million respectively.  The house, which has six luxury flats, was bought in 2008.  When the EFCC officer confronted Morakinyo with evidence of the cheques, he reportedly buckled under the pressure, sending Saraki into panic mode.[/b]
 
Justice Fabiyi is the infamous judge of the Court of Appeal who in 2007 read the lead judgement of that court proclaiming the election of Umaru Yar’adua to have been “free and fair” and in conformity with the electoral rules.  He was elevated to the Supreme Court after giving that judgement, but Yar’Adua himself subsequently admitted that the election had been massively rigged.

how come Judges are the only free citizens in Nigeria? even when they are the most collectors of bribe.
am yet to hear a judge in court for corruption charges.

CCT chairman wey suppose dey EFCC hand dey still fight the SP.

by the way will the SP still go free now that we have a minister of Justice. since they said CCT chairman is not qualified without the CJN.

Hon. Justice John Afolabi Fabiyi CFR

Justice John Afolabi Fabiyi from Kogi State was born on the 25th of November 1945.

He graduated from Ahmadu Bello University in 1969, and was called to bar after having attended the Nigerian law school in 1970.

Prior to entering public service in 1975, he spent 5 years as a legal practitioner with Noel Gery & Co. Kano. Immediately after his stint in private practice, he joined Kwara State Judiciary serving as magistrate, chief registrar, and High Court judge. He served as chairman of the Election petition tribunal, Anambra State (1994 to 1998).

He was appointed as a justice of the Court of Appeal in 1998, and subsequently rose to presiding judge of the Court of Appeal in Ibadan (2006 to 2009), after which he was appointed as justice of the Supreme Court of Nigeria in 2009.

In recognition of his service to the judiciary, he was awarded Commander of Order of the Niger (CON) in 2009, Officer of the Order of the Federal Republic of Nigeria (OFR).

He has attended many conferences nationally and internationally.

He is married with children, and enjoys reading and gardening.

In the Crusade against corruption, you will always have some apostles of corruption amongst the congregation.
Nowadays, of every 12 Apostles, there are 11 Judas.
Saraki succeeded in picking one out of the many corrupt Judges around just to slow down his trial.
It won't end this way. Justice shall prevail.

Which is the allegation. Is it that the judge is to old to have delivered judgement or is it the black and white shoddy case of bribery. As a reporter with years of diligent experience, I would say this is poor investigative journalism by Sahara Reporters.

As if it was not FG counsel, Rotimi Jacobs that requested for the court to suspend the CCB proceeding pending the determination of the appeal court ruling on it's sitting.

Can we kindly respect the sanctity of the judiciary, there should be no undue pressure on the bench because a decision did not favour some stupid godfathers... I ll continue to speak out against SR until this mudslinging on the judiciary is halted and done away with
