Trespass to chattel not larceny or conversion...reason being that he had no specific intention of permanently depriving his madam of the chattel when he moved it. He could also be charged with larceny by trick for taking madam's key without her permission. Another offense might be Embezzlement, reason being that he formed the intention of wrongfully moving the car whilst he was in lawful possession of the car... grin

Actually he DID steal the car. Stealing by definition is the unlawful taking of someone's property WITHOUT PRIOR CONSENT.

If he had been sent on an errand with the car, and he decided to divert somewhere to a Valentine's party, that would have been a different matter. But he made duplicate copies of the car keys and sneaked it out of his boss' home without informing her. How do we know what plans he had for the car after the party? He might have sold it if he hadn't been caught.

Although his act is despicable, for an act to be termed stealing he must have the intent of depriving the owner of the property which in my view he didn't. He was called by his boss and he made a move to return the vehicle. Well, who knows... I could be wrong.. Just my 2 cents

Listen, when you take a property that does not belong to you from it's origin place to another place without the consent of the owner is a criminal offence which is stealing.

Remember that he duplicated the key of the car, took the car out of its place whereby the owner found out that the property she left at her place has been moved without her consent and she contacted the law enforcement agents reporting that her property was removed from it's original place, and the key of the said property was still intact with her. Will you now say that her property was jus[b]t taken away and when found with anybody, you now clai[b]m that it was not stolen?

Establishing that an act of crime has been done isn't sufficient to convict and the state of mind is more important.
TThe principle of law broke down the two which must Coincide.

From the fact of this case, driving back the same to the same place after long hours of removal after a simple call from his madam requesting that she wants to be taken to a place negates that intention to steal the car.

Duplicating a car key can earn him prison sentence but not for car theft.

Let me also add that if the prosecution fails to modify this charge, this guy may even walk free

Investigate him properly, if it turns out that all he wants was just for a show off, the madam should forgive him and left off the hook. Someone mentioned that it was youthful exuberance which might be true.
