Benin – A Senior Advocate of Nigeria (SAN), Mr Femi Falana said any president or governor who committed criminal act could be arrested while in office and taken for trials.


Falana said this while speaking on: “Limit of executive immunity” in Benin to mark the 60th birthday of the Secretary to the State Government (SSG) of Edo, Prof. Julius Ihonvebere.

Falana said that immunity did not also extend to electoral fraud.

He urged the Senate President, Bukola Saraki and his Deputy, Ike Ekweremadu to face the forgery charges against them rather than politicking about it, saying “they have no immunity to dodge the charges against them.’’

Falana said that according to the Supreme Court ruling, there was no longer absolute immunity therefore governors involved in criminal charges, including the leadership of the National Assembly must face the law.

He faulted the invitation extended to the Attorney General of the Federation, Abubakar Malami by the leadership of the senate over the forgery allegation against the senate president and his deputy.

“The senate is now politicising the issue, saying it is political victimization but not that the offence was not committed.

“As leaders of the National Assembly, you are supposed to be above board and that is even the more reason you must be careful.

“But I want to remind the senate that the Attorney General of the Federation is only answerable to his boss, who is the president and nobody else.

“The same thing applies to the states, so there is no longer absolute immunity in this country.

“And that is why what is happening in Ekiti today about money found in a bank and the governor is saying it is illegal to freeze his account that is not true.

“Any issue that is criminal in nature must be treated as such,” he declared.

Falana however described Ihonvbere as a resourceful Nigerian, who fought doggedly for the nation’s democracy.

Gov. Adams Oshiomhole, the Minister of Niger Delta Affairs, Pastor Usani Uguru, Speaker of the state House of Assembly, Elizabeth Ativie and other members of the State Executive Council were present at the occasion.

You sound clueless with your text sorry. Because the president has immunity suddenly everybody in decision making feels entitled need to apply for one.

If we start saying everyone even armed robbers would feel the need to get immunity I was expecting to see people fighting to remove immunity thing but no they are for it as if this people care about us.

Falana wants Saraki prosecuted but joined forces with other lawyers to prevent El-Dullardeen from presenting his certificate.

Still can't believe this is the same Falana I used to hold in high esteem, incredible what the lure for power does to supposedly sane men.

Is this what the law says or we want to bend the laws? They are going to destroy this ailing democracy. This Falana is really a stooge.

If we can abuse the law because we want to create a lawful state that means we've lost any idea of what the law really is in the first place.

It's like Jungle Justice on a man who stole on the streets. Justice is not just an end to the means but both the means and end must be just.

Falana should use that his half moon glasses to read Section 308 of the Nigerian Constitution (Immunity Clause) over and over again till he realizes that his statements, lies and propaganda cannot and will not supersede the Constitution even if he whispers it in Buhari's infected ear One billion times to deceive him.

I am getting worried about Falana. Since APC won the election he has been speaking, thinking and acting as a "FALZ" ( His Musician Son) rather than a "SAN" undecided

Anytime I watch this picture I feel like crying for Saraki....for crying out loud that is the Father of APC you are holding like that and that is the man you directly and indirectly offended. Indeed, ambition is a rider (respect to Tupac), truly Saraki is not smart at all. He will soon shed tears in this coming weeks.....

most of Nigeria senators does not know anything about law, including the leaders of the senate. Nigeria senators is a disgrace to our democracy in all ramifications.
